Whether you look at its high&nbsp;<a href=\"https:\/\/poweroutage.us\/electricity-rates\" target=\"_blank\" rel=\"noopener\">electricity<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/gasprices.aaa.com\/\" target=\"_blank\" rel=\"noopener\">gas<\/a>&nbsp;prices, resulting from its \u201cgreen\u201d approach to energy that has caused the state to lose&nbsp;<a href=\"https:\/\/www.argusmedia.com\/en\/news-and-insights\/latest-market-news\/2819382-california-fuel-imports-soar-after-refinery-closures\" target=\"_blank\" rel=\"noopener\">17% of its refining capacity<\/a>&nbsp;over the past seven months and reduce&nbsp;<a href=\"https:\/\/www.utilitydive.com\/news\/natural-gas-generation-falling-california-solar-rising\/806404\/\" target=\"_blank\" rel=\"noopener\">natural gas\u2019s use in electricity generation<\/a>&nbsp;at a time of&nbsp;<a href=\"https:\/\/www.eenews.net\/articles\/evs-data-centers-to-drive-50-rise-in-california-electricity-demand-state-predicts\/\" target=\"_blank\" rel=\"noopener\">growing demand<\/a>, or its barriers to build that have led to an overpriced and underpromised&nbsp;<a href=\"https:\/\/www.independent.org\/article\/2025\/06\/16\/california-zombie-bullet-train\/?gad_source=1&amp;gad_campaignid=1476762230&amp;gbraid=0AAAAADr3r6j1xKXJN8-QJZGhw63Qgj2Mb&amp;gclid=Cj0KCQjwzqXQBhD2ARIsAKrIeU_JFgF5BkvILUxnlgYzchm1JYwDEabqlGIEEmEIItowOvQ9iGqEnzMaAoNWEALw_wcB\" target=\"_blank\" rel=\"noopener\">high-speed rail system<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.foxbusiness.com\/lifestyle\/why-californias-housing-market-remains-unaffordable-many-americans\" target=\"_blank\" rel=\"noopener\">housing shortage<\/a>, there are many avenues of attack.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Knowledge of the burdens California imposes on producers and developers has become increasingly pervasive throughout American society, providing evidence that the famous phrase, \u201cpolitics is downstream of culture,\u201d also works in reverse. Exhibit A: HBO\u2019s Euphoria, whose Season 3 premiere amassed&nbsp;<a href=\"https:\/\/variety.com\/2026\/tv\/news\/euphoria-season-3-premiere-ratings-1236723567\/\" target=\"_blank\" rel=\"noopener\">8.5 million viewers<\/a>&nbsp;in the first three days after release.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One should be forgiven for questioning what a show that takes the amount of drama, drugs, sex, and violence to a new extreme \u2014 and then even further \u2014 would have to do about public policy. Believe it or not, however, the showwriters decided to make California\u2019s strict environmental standards play a key role early in the season. Specifically, a major part of the plot hinges on the inability to build on the site of an endangered flower.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Without going too deeply into the show\u2019s plot or revealing too many spoilers, Nate Jacobs (played by Jacob Elordi) runs a real estate construction company that is trying to build a senior-living home, but runs into trouble when some \u201cwhite fritillaries\u201d are found on the site. This discovery causes the project to halt construction until an environmental review can be conducted at the site, setting off a chain of events that leaves Jacobs in debt and misery.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While this situation involves significant dramatization, the basic facts match reality. Commonly known as the&nbsp;<a href=\"https:\/\/cnps-yerbabuena.org\/fragrant-fritillary-fritillaria-liliacea\/\" target=\"_blank\" rel=\"noopener\">fragrant fritillary<\/a>, the flower is listed on the California Native Plant Society\u2019s List 1B: 1-2-3, a classification that denotes that the flower is \u201crare, threatened, or endangered in California; rare but found in sufficient numbers and distributed widely enough that the potential for extinction is low at this time; endangered in a portion of its range; and endemic to California.\u201d Because it is listed as \u201crare, threatened, or endangered,\u201d if a developer encounters a fragrant fritillary, the California Environmental Quality Act (CEQA) requires a local or state agency to address how the project will affect the flower in environmental documentation before construction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Passed in 1970 \u2014 the same year as the federal National Environmental Policy Act (NEPA) was signed into law \u2014 the&nbsp;<a href=\"https:\/\/oag.ca.gov\/environment\/ceqa\" target=\"_blank\" rel=\"noopener\">CEQA<\/a>&nbsp;\u201crequires that state and local agencies disclose and evaluate the significant environmental impacts of proposed projects and adopt all feasible mitigation measures to reduce or eliminate those impacts.\u201d&nbsp;<a href=\"https:\/\/www.aqmd.gov\/home\/rules-compliance\/ceqa\/frequently-asked-questions\" target=\"_blank\" rel=\"noopener\">Like NEPA<\/a>, it \u201capplies to projects undertaken, funded or requiring an issuance of a permit by a public agency,\u201d invoking different levels of review depending on the level of the environmental effect. For instance, a \u201cdetailed\u201d environmental impact report (EIR) is required when an agency \u201cfinds substantial evidence that the project may have a significant effect on the environment.\u201d EIRs involve a&nbsp;<a href=\"https:\/\/www.fresno.gov\/wp-content\/uploads\/2023\/08\/EIR-Handout-Seda.pdf\" target=\"_blank\" rel=\"noopener\">multi-step<\/a>&nbsp;process of notice, draft, public review, and certification before a project can move forward, and the report must include a mitigation monitoring and reporting program.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The problems with the CEQA resemble those with NEPA. Procedural requirements lead to substantive delays and costs as interest groups weaponize the law to obstruct projects they dislike.&nbsp;<a href=\"https:\/\/sd11.senate.ca.gov\/news\/senator-wiener-introduces-fast-focused-ceqa-act\" target=\"_blank\" rel=\"noopener\">Examples<\/a>&nbsp;of projects delayed by the CEQA include a food bank and a housing project for the homeless. According to a 2022&nbsp;<a href=\"https:\/\/www.pacificresearch.org\/wp-content\/uploads\/2022\/02\/CEQA_Report_Final.pdf\" target=\"_blank\" rel=\"noopener\">report<\/a>&nbsp;by the Pacific Research Institute, agencies take between 13 and 38 months longer to approve projects subjected to an EIR. Importantly, this doesn\u2019t include litigation, which could take anywhere from eight months to two years. And because California\u2019s courts grant almost anyone \u201c<a href=\"https:\/\/www.theregreview.org\/2022\/05\/05\/mckeen-inequalities-of-californias-environmental-quality-act\/\" target=\"_blank\" rel=\"noopener\">beneficially interested<\/a>\u201d in a project standing, the chances of substantial projects facing lawsuits are increased. Even without lawsuits, the risk of litigation adds an extra layer of expense and time that project developers have to be wary of, which can create enough uncertainty that some projects never even start.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Both&nbsp;<a href=\"https:\/\/oag.ca.gov\/environment\/ceqa\" target=\"_blank\" rel=\"noopener\">CEQA<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.epa.gov\/nepa\/what-national-environmental-policy-act\" target=\"_blank\" rel=\"noopener\">NEPA<\/a>&nbsp;attempt to perpetuate the conditions where \u201cman and nature can exist in productive harmony,\u201d but they result in an unproductive \u201charmony\u201d of quiet work sites and full courtrooms. By allowing a flower that\u2019s not even at risk of extinction to stand in the way of economically beneficial projects through longer reviews and opportunities for litigation, California makes it clear that human welfare is subservient to nature.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It should be no surprise that knowledge about California\u2019s woes has seeped into its very own media industry. The state\u2019s present policy outlook stands in sharp contrast to its cultural and commercial dominance, embodied by Hollywood and Silicon Valley, respectively, and that paradox should inevitably raise some eyebrows.
