Numerous stakeholders have criticized IRIS for dramatically overestimating the toxicity for certain industry-specific compounds to many business\u2019 detriment.&nbsp;<strong><a href=\"https:\/\/dailycaller.com\/2026\/05\/06\/lithium-minerals-united-states-china-appalachian-mountains\/?utm_medium=organic&amp;utm_campaign=related&amp;utm_source=website\" target=\"_blank\" rel=\"noopener\">(RELATED: America Just Made Its Biggest Critical Mineral Find In Years \u2014 But There\u2019s A Problem)<\/a><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">IRIS was implemented via administrative action and has never been approved by Congress. IRIS toxicological assessments are far-reaching enough that over 80 disparate industry groups signed on to an American Chemistry Council (ACC)&nbsp;<a href=\"https:\/\/www.documentcloud.org\/documents\/25871801-acc-jan-2025-letter-to-epa-re-iris\/\" target=\"_blank\" rel=\"noopener\">open letter<\/a>&nbsp;to EPA Secretary Lee Zeldin in January 2025.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">IRIS-generated&nbsp;<a href=\"https:\/\/www.epa.gov\/iris\" target=\"_blank\" rel=\"noopener\">toxicity values<\/a>&nbsp;include carcinogen estimations and daily pollutant exposure considered safe for human life. EPA program offices nationwide have used these metrics to establish climate superfund cleanup standards, air quality rules, and inform chemical risk evaluations under the Toxic Controlled Substances Act. Climate superfunds are&nbsp;<a href=\"https:\/\/www.law.georgetown.edu\/environmental-law-review\/blog\/the-pending-fate-of-climate-superfund-statutes\/\" target=\"_blank\" rel=\"noopener\">state legislative initiatives<\/a>&nbsp;that force fossil fuels companies to pay damages for supposed climate change harms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhile&nbsp;the&nbsp;IRIS&nbsp;program&nbsp;was&nbsp;designed&nbsp;originally&nbsp;to&nbsp;promote&nbsp;consistency,&nbsp;the&nbsp;development&nbsp;of a&nbsp;risk&nbsp;assessment&nbsp;often&nbsp;includes&nbsp;science&nbsp;policy&nbsp;judgments&nbsp;\u2013&nbsp;many&nbsp;of&nbsp;which&nbsp;are&nbsp;informed by&nbsp;statutory&nbsp;and&nbsp;regulatory&nbsp;authority&nbsp;and&nbsp;objectives,\u201d Fotouhi\u2019s memo reads. \u201cOver&nbsp;the&nbsp;years,&nbsp;it&nbsp;has&nbsp;become&nbsp;more&nbsp;clear&nbsp;that&nbsp;having&nbsp;a&nbsp;single&nbsp;program&nbsp;within&nbsp;one&nbsp;office&nbsp;at&nbsp;EPA&nbsp;make&nbsp;these&nbsp;judgments&nbsp;for&nbsp;all&nbsp;hazard&nbsp;and&nbsp;dose\u2013response&nbsp;assessments&nbsp;for&nbsp;all&nbsp;of&nbsp;EPA&nbsp;is&nbsp;not&nbsp;optimal&nbsp;for&nbsp;developing fit\u2013for\u2013purpose&nbsp;risk&nbsp;assessments&nbsp;tailored&nbsp;to&nbsp;meet&nbsp;specific&nbsp;legal,&nbsp;statutory,&nbsp;and&nbsp;regulatory&nbsp;obligations.\u201d&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Deputy Administrator\u2019s letter also notes that \u201cthe&nbsp;IRIS&nbsp;toxicity&nbsp;value&nbsp;for&nbsp;ethylene&nbsp;oxide&nbsp;(EtO),&nbsp;a&nbsp;chemical&nbsp;critical&nbsp;for&nbsp;medical&nbsp;equipment&nbsp;sterilization,&nbsp;has&nbsp;been&nbsp;criticized&nbsp;because&nbsp;it&nbsp;was&nbsp;at&nbsp;least&nbsp;10,000&nbsp;times&nbsp;lower&nbsp;than&nbsp;levels&nbsp;naturally&nbsp;occurring&nbsp;in&nbsp;the&nbsp;human&nbsp;body.\u201d<strong>&nbsp;<a href=\"https:\/\/dailycaller.com\/2026\/04\/03\/power-company-faces-legal-fight-for-making-too-much-energy\/?utm_medium=organic&amp;utm_campaign=related&amp;utm_source=website\" target=\"_blank\" rel=\"noopener\">(RELATED: Power Company Faces Legal Fight For Making Too Much Energy)<\/a><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rather than using IRIS to issue hazard classifications for virtually every chemical, the EPA will devolve this responsibility to particular program offices. EPA program offices are specialized departments that exist to implement particular laws like the Atomic Energy Act and Clean Air Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Industry stakeholders responded positively to Fotouhi\u2019s memo.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cFormaldehyde is a critical chemical used by funeral directors across America. Funeral directors are taught in mortuary school how to safely use formaldehyde,\u201d National Funeral Directors Association (NFDA) Senior Vice President Lesley Witter told the Daily Caller News Foundation. \u201cOur members have been concerned about access to this critical tool due to regulations based on a flawed IRIS value for formaldehyde. We\u2019re happy to see EPA moving away relying on unrealistic IRIS assessments and relying on high-quality Gold Standard science moving forward.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The NFDA was one of the signatories of the ACC\u2019s January letter, along with groups such as the Catfish Farmers of America and the National Mining Association (<a href=\"https:\/\/dailycaller.com\/2026\/05\/06\/lithium-minerals-united-states-china-appalachian-mountains\/\" target=\"_blank\" rel=\"noopener\">NMA<\/a>).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cEPA\u2019s IRIS formaldehyde assessment set toxicity level below the amount of formaldehyde produced by human breath,\u201d added a chemical industry source granted anonymity to discuss sensitive policy matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIn the past, IRIS risk assessments have applied overly conservative approaches that have driven regulatory standards arbitrarily lower\u2014sometimes even below background levels\u2014while offering little to no benefits,\u201d an NMA spokesperson agreed. \u201cWe applaud the EPA\u2019s revised approach through its newly formed Office of Applied Science and Environmental Solutions to conduct fact-based assessments moving forward.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Society of Chemical Manufacturers &amp; Affiliates (SOCMA) also supports Fotouhi\u2019s rescission of IRIS. \u201cSOCMA has previously raised concerns about the EPA\u2019s IRIS Program, particularly regarding transparency and the use of the best available science, and continues to support risk assessment approaches that are scientifically robust and predictable.\u201d SOCMA is the only U.S. industry association representing boutique and specialty chemical manufacturers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cToxicity values in IRIS\u2019 hexavalent chromium assessment would result in drinking water standards lower than average background levels of naturally occurring chromium in groundwater,\u201d another industry official told the DCNF. The official noted that the IRIS standards \u201cwould have imposed massive costs on water systems nationwide\u201d with no measurable improvement in public health outcomes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Despite the move\u2019s warm reception among the private sector,&nbsp;<a href=\"https:\/\/www.americanchemistry.com\/chemistry-in-america\/news-trends\/press-release\/2025\/acc-applauds-the-introduction-of-the-no-iris-act#:~:text=ACC%20has%20long%20advocated%20for,competitiveness%20of%20American%20chemical%20manufacturers.\" target=\"_blank\" rel=\"noopener\">ACC<\/a>&nbsp;Vice President of Regulatory and Scientific Affairs Dr. Kimberly Wise White told the DCNF there was&nbsp;<a href=\"https:\/\/dailycaller.com\/2026\/04\/21\/american-chemistry-council-chris-jahn-manufacturing-china\/\" target=\"_blank\" rel=\"noopener\">more to be done<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cACC has highlighted concerns about EPA\u2019s IRIS&nbsp;program, which has lacked scientific rigor and remains on the GAO\u2019s High-Risk List for programs&nbsp;that are&nbsp;vulnerable to fraud, waste, abuse, or mismanagement,\u201d White said. \u201cWe have called for the disbandment of the IRIS program, the return of responsibilities to program offices, and also support legislation in Congress, the&nbsp;<a href=\"https:\/\/www.americanchemistry.com\/chemistry-in-america\/news-trends\/press-release\/2025\/acc-applauds-the-introduction-of-the-no-iris-act#:~:text=ACC%20has%20long%20advocated%20for,competitiveness%20of%20American%20chemical%20manufacturers.\" target=\"_blank\" rel=\"noopener\">No IRIS Act<\/a>&nbsp;that would help ensure regulations are based on high-quality science.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Republican Wisconsin Rep. Glenn Grothman&nbsp;<a href=\"https:\/\/www.congress.gov\/member\/john-kennedy\/K000393\" target=\"_blank\" rel=\"noopener\">introduced<\/a>&nbsp;the No Industrial Restrictions in Secret (<a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-bill\/1415\" target=\"_blank\" rel=\"noopener\">No IRIS<\/a>) Act in February 2025. Grothman is attempting to codify the Trump EPA\u2019s statutory revisions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIn too many cases, IRIS assessments pushed impractical toxicity standards and emissions thresholds far below naturally occurring ambient levels. That\u2019s a direct hit on small businesses who don\u2019t have the resources to chase ever-changing or unattainable standards,\u201d the lawmaker told the DCNF. \u201cWhen you set targets that are effectively impossible to meet, you don\u2019t get better outcomes; you get stalled projects, fewer jobs, less innovation, and manufacturing outsourced to countries whose scientific standards are already more lax than the United States. That\u2019s exactly what we\u2019ve seen, particularly for manufacturers and small operators trying to stay competitive.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Republican Louisiana Sen. John Kennedy introduced the No IRIS Act to the&nbsp;<a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/senate-bill\/623\">Senate<\/a>&nbsp;alongside Grothman. It has been referred to the Committee on Environment and Public Works.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI\u2019m encouraged to see the EPA taking steps to address these issues and moving toward a more transparent, accountable process grounded in sound science.
