The Trump administration is&nbsp;<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2026\/03\/removing-regulatory-barriers-to-affordable-home-construction\/\" target=\"_blank\" rel=\"noreferrer noopener\">taking an ax<\/a>&nbsp;to several of them, and it just received a big boost when a U.S. District Court repealed a measure burdening low-income and first-time home buyers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Specifically, on March 5<sup>th<\/sup>, an Eastern District of Texas decision vacated a 2024&nbsp;<a href=\"https:\/\/www.hud.gov\/stat\/cpd\/mes-notice\" target=\"_blank\" rel=\"noreferrer noopener\">requirement<\/a>&nbsp;from the Department of Housing and Urban Development (HUD) that new homes qualifying for federally-backed mortgages must comply with the 2021 International Energy Conservation Code (IECC). Thankfully, the court in&nbsp;<em><a href=\"https:\/\/www.texasattorneygeneral.gov\/sites\/default\/files\/images\/press\/HUD%20Opinion.pdf?utm_content=&amp;utm_medium=email&amp;utm_name=&amp;utm_source=govdelivery&amp;utm_term=&amp;source=email\" target=\"_blank\" rel=\"noreferrer noopener\">Utah v. HUD<\/a><\/em>&nbsp;found the agency\u2019s actions in violation of the law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The IECC is a spare-no-expense assault on residential energy use \u2013 for example, by requiring far more insulation than makes sense and necessitating costlier appliances. A number of&nbsp;environmental organizations&nbsp;advocated for the IECC\u2019s building code dictates, saying they would ensure that \u201clow-income homeowners and residents are prioritized in a climate-aligned future.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But even HUD conceded that the requirements would reduce the number of new homes by 1.5% and raise construction costs by an estimated $2,800 to $6,800, according to documents filed with the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And those figures may be on the low side. The National Association of Homebuilders (NAHB), which filed the case along with 15 state attorneys general, estimated costs between&nbsp;<a href=\"https:\/\/www.congress.gov\/119\/meeting\/house\/118590\/witnesses\/HHRG-119-IF03-Wstate-HughesB-20250909.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">$9,600 and $21,400<\/a>, likely well in excess of any&nbsp;<a href=\"https:\/\/www.nahb.org\/-\/media\/NAHB\/advocacy\/docs\/top-priorities\/codes\/code-adoption\/2021-iecc-cost-effectiveness-analysis-hirl.pdf?rev=7a1bd7900732483885f80d483f21aa36&amp;hash=707DE5D2CE419E81506D7D87832ADBE9\" target=\"_blank\" rel=\"noreferrer noopener\">additional energy savings<\/a>. For perspective, the NAHB also estimates that every $1,000 increase in the median price of a home disqualifies about&nbsp;<a href=\"https:\/\/www.nahb.org\/news-and-economics\/housing-economics\/housings-economic-impact\/households-priced-out-by-higher-house-prices-and-interest-rates\" target=\"_blank\" rel=\"noreferrer noopener\">156,000 potential buyers.<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Fortunately, the court took notice that the underlying law places limits on the authority of the HUD to adopt these provisions, namely that the agency must first \u201cmake a determination that the revised codes do not negatively affect the availability or affordability of new construction\u2026\u201d&nbsp; Despite its own evidence of such negative impacts, HUD went ahead anyway \u2013 all too typical of the climate craziness that prevailed in Washington at the time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And mind you, this was HUD \u2013 not the Environmental Protection Agency \u2013 an agency whose core mission is to make housing more affordable. Yet it was trying to impose these expensive environmental requirements on the very Americans who need federal help to qualify for a mortgage. In fact,&nbsp;over 80%&nbsp;of HUD-backed mortgages have gone to first-time buyers with lower credit scores and smaller down payments than those served by conventional lenders.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.hud.gov\/aboutus\/leadership\/scott-turner\" target=\"_blank\" rel=\"noreferrer noopener\">Scott Turner<\/a>, Trump\u2019s Secretary of HUD, recognized the problems with these costly building code provisions and&nbsp;<a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/02\/03\/2026-02184\/final-determination-adoption-of-energy-efficiency-standards-for-new-construction-of-hud\" target=\"_blank\" rel=\"noreferrer noopener\">delayed their implementation<\/a>. Now, thanks to the court decision, they are gone for good.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Trump administration is also reconsidering these and other green housing measures inherited from his predecessor, such as several ridiculous \u2013 and ridiculously expensive \u2013&nbsp;<a href=\"https:\/\/cei.org\/studies\/free-the-appliances\/\" target=\"_blank\" rel=\"noreferrer noopener\">home appliance regulations<\/a>.&nbsp;It is also revisiting a number of environmental permitting roadblocks that have impeded housing construction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But, thanks to a federal court in Texas, what was quite possibly the single most expensive green requirement hampering housing affordability was found to be illegal \u2013 and that is great news for every prospective new homeowner.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>This article originally appeared at&nbsp;<a href=\"https:\/\/www.themortgagenote.org\/federal-court-rejects-costly-green-housing-policy\/\">The Mortgage Note<\/a><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Biden administration\u2019s obsession with climate change has contributed to the housing affordability challenges Americans face today, and there are many harmful green policies that need to be undone.
