href=\"https:\/\/eidclimate.org\/breaking-supreme-court-to-hear-challenge-to-anti-energy-climate-litigation-campaign\/\">agreed<\/a>&nbsp;to hear arguments in the City and County of Boulder\u2019s climate lawsuit against two major energy companies. This offers&nbsp;<strong>the first real opportunity to rein in the nationally-coordinated climate litigation campaign<\/strong>&nbsp;that has sought to force policy outcomes through the courts that elected officials and voters have repeatedly rejected.<\/em><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><em><strong>What is the Boulder climate lawsuit?&nbsp;<\/strong><strong>&nbsp;<\/strong><\/em><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\"><em>In 2018, the City and County of Boulder and San Miguel County&nbsp;<a href=\"https:\/\/eidclimate.org\/after-months-silence-boulder-hold-rally-with-activists-announce-climate-lawsuit\/\">filed<\/a><strong>&nbsp;a public nuisance&nbsp;<a href=\"https:\/\/bouldercounty.gov\/climate\/impacts\/climate-lawsuit\/\">climate lawsuit<\/a>&nbsp;against Exxon Mobil and Suncor,<\/strong>&nbsp;seeking financial damages to pay for the costs of climate change. (Welsh\/English heritage)<\/strong><\/em><\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><em>After San Miguel\u2019s case was&nbsp;<a href=\"https:\/\/www.dailycamera.com\/2020\/06\/01\/jurisdiction-remains-contentious-in-virtual-boulder-climate-change-lawsuit-hearing\/\">separated<\/a>&nbsp;from Boulder\u2019s in 2021,&nbsp;<strong>Boulder<\/strong>&nbsp;spent five years fighting jurisdictional battles \u2013&nbsp;<a href=\"https:\/\/eidclimate.org\/scotus-announcement-on-boulder-climate-case-expected-soon\/\">all the way to SCOTUS<\/a>&nbsp;and back \u2013 before finally<strong>&nbsp;getting a May 2025 Colorado Supreme Court&nbsp;<a href=\"https:\/\/eidclimate.org\/boulders-climate-suit-staggers-forward-after-divided-court-ruling\/\">ruling<\/a>&nbsp;allowing the case to proceed towards discovery and trial.<\/strong><\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>The companies&nbsp;<a href=\"https:\/\/eidclimate.org\/defendants-ask-supreme-court-to-review-boulder-climate-case-amid-wave-of-dismissals\/\">appealed<\/a>, and in February 2026, the&nbsp;<strong>U.S. Supreme Court agreed to take up the case.<\/strong><\/em><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><em><strong>What questions will the Supreme Court consider and what do they mean?<\/strong><\/em><\/h4>\n\n\n\n<p class=\"has-text-align-center wp-block-paragraph\"><em><strong>The Court will hear arguments on two separate questions \u2013<br>one that goes to the heart of the entire campaign,<br>and one that could let the justices sidestep it.<\/strong><\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em><strong>The&nbsp;<\/strong><a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25-170\/369227\/20250808130855966_Suncor_pet.pdf\"><strong>big one<\/strong><\/a><strong>: can state law be used to sue energy companies for the effects of international greenhouse gas emissions on global climate change?&nbsp;<\/strong>This is what the&nbsp;<strong>climate litigation campaign<\/strong>&nbsp;has always really been about:&nbsp;<strong>using tort law as a&nbsp;<a href=\"https:\/\/eidclimate.org\/baltimore-climate-lawsuit-is-dismissed-adding-to-losses-for-nationally-coordinated-campaign\/\">backdoor emissions regulator<\/a>, extracting damages that function as a&nbsp;<a href=\"https:\/\/eidclimate.org\/attorney-involved-with-boulder-climate-case-admits-suit-is-a-backdoor-carbon-tax-as-scotus-considers-appeal\/\">de facto carbon tax<\/a>&nbsp;that Congress never voted for and voters never approved.<\/strong><\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em><strong>The companies argue that federal law forecloses exactly this kind of state-law end-run,<\/strong>&nbsp;and that issues of greenhouse gas emissions, interstate commerce, national energy policy, and foreign affairs belong at the federal level \u2014<strong>&nbsp;not in a patchwork of state courtrooms where judges can impose wildly inconsistent liability on American energy producers.<\/strong><\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em><strong>The second question \u2013 added by the Court at&nbsp;<\/strong><a href=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docket\/docketfiles\/html\/public\/25-170.html\"><strong>Boulder\u2019s urging<\/strong><\/a><strong>&nbsp;\u2013 asks<\/strong>&nbsp;<strong>whether SCOTUS even has jurisdiction to hear the case right now.<\/strong>&nbsp;If the justices rule narrowly on procedure, the broader preemption question stays unresolved and Boulder\u2019s case will continue in state court.<\/em><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><em><strong>When will the court hear arguments?<\/strong><\/em><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Arguments are expected during the October 2026 term, with a&nbsp;<strong>decision anticipated in winter 2026 or spring 2027.<\/strong><\/em><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong><em>What is the likely impact?<\/em><\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\"><em>This case has nearly<strong>&nbsp;three dozen copycats<\/strong>&nbsp;waiting in the wings. Allowing dozens of state and municipal governments to impose&nbsp;<strong>state-court liability for inherently global phenomena<\/strong>&nbsp;would fragment national energy policy, chill domestic energy production, and circumvent the democratic process by&nbsp;<strong>substituting courtroom judgments for legislative ones.<\/strong><\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em><strong>If the justices punt<\/strong>&nbsp;using the jurisdictional question, Boulder\u2019s case would return to state court, but the&nbsp;<strong>underlying legal vulnerabilities of the case would remain.<\/strong><\/em><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><em>Where do Colorado leaders stand on the case?<\/em><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\"><em>The response to<strong>&nbsp;the filing of the [Boulder] lawsuit was met immediately with&nbsp;<\/strong><a href=\"https:\/\/eidclimate.org\/leading-colorado-voices-push-back-against-boulder-climate-lawsuit\/\"><strong>strong opposition<\/strong><\/a>&nbsp;from Colorado state leaders, including the&nbsp;Denver Post&nbsp;editorial board and former Secretary of the Interior Gale Norton, who also served as Colorado\u2019s Attorney General.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Then-governor John Hickenlooper and one his top administration officials<strong>&nbsp;<a href=\"https:\/\/eidclimate.org\/after-months-silence-boulder-hold-rally-with-activists-announce-climate-lawsuit\/\">warned<\/a>&nbsp;that litigation was not the best way to pursue an environmental agenda<\/strong>. Hickenlooper\u2019s predecessor, current Governor Jared Polis, also didn\u2019t support the case and remained silent on the issue throughout his entire time in office.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Conservation Colorado, a leading environmental group in the state,&nbsp;<a href=\"https:\/\/eidclimate.org\/leading-colorado-green-group-wont-back-boulder-climate-lawsuit\/\">also declined<\/a>&nbsp;to publicly support the lawsuit and&nbsp;The&nbsp;Denver Post&nbsp;editorial board delivered&nbsp;<strong>a&nbsp;<a href=\"https:\/\/www.denverpost.com\/2018\/04\/20\/lawsuits-comparing-fossil-fuel-companies-to-the-tobacco-industry-dangerously-miss-the-mark\/\">sharp rebuke<\/a>&nbsp;to the lawsuit,<\/strong>&nbsp;writing:<\/em><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><em>\u201cWithout fossil fuels, transportation would stagger to a halt, agricultural productivity would plummet, millions would suffer from cold, heat and hunger, and untold legions would suffer premature death. That\u2019s why any comparison between fossil fuel companies and the tobacco industry, whose product is a health disaster with no redeeming economic value, is so wide of the mark\u2026\u201d<\/em><\/p>\n<\/blockquote>\n\n\n\n<h4 class=\"wp-block-heading\"><em>Who did Boulder hire as outside counsel?<\/em><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Boulder\u2019s attorneys have&nbsp;<a href=\"https:\/\/eidclimate.org\/boulders-response-underscores-why-scotus-should-take-up-climate-case\/\">admitted<\/a>&nbsp;that their&nbsp;<strong>true goals<\/strong>&nbsp;for the litigation aren\u2019t financial damages, but rather&nbsp;<strong>achieving preferred public policy outcomes.<\/strong><\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>A lead attorney for EarthRights International, a nonprofit representing Boulder,&nbsp;<a href=\"https:\/\/eidclimate.org\/boulders-climate-suit-staggers-forward-after-divided-court-ruling\/\">said<\/a>&nbsp;that a key goal of the lawsuit is \u201cto raise the price of the products\u201d like oil and gas to shift the behaviors of companies and consumers. In 2021, a&nbsp;<a href=\"https:\/\/boulder.novusagenda.com\/agendapublic\/CoverSheet.aspx?ItemID=3794&amp;MeetingID=649\">memo<\/a>&nbsp;prepared for a study session outlined the<strong>&nbsp;goal of \u201csystems-level change\u201d:<\/strong><\/em><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><em>\u201cBoulder has also been a national leader in exploring the&nbsp;<strong>use of the legal system in pushing for larger systems-level change<\/strong>. Both through its active participation in multi-jurisdiction efforts \u2014 like the Clean Power Plan Plaintiffs group \u2014 or its climate liability lawsuit with Boulder and San Miguel Counties against ExxonMobil and Suncor, Boulder has demonstrated that&nbsp;<strong>there are a range of different levers cities can take hold of to drive more fundamental systems change<\/strong>.\u201d (emphasis added)<\/em><\/p>\n<\/blockquote>\n\n\n\n<h4 class=\"wp-block-heading\"><strong><em>Why did the Supreme Court agree to hear the case this time?<\/em><\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Earlier petitions in similar cases, including Honolulu, never made it past the cert stage. This time, several things changed:<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>The biggest:&nbsp;<strong>the Department of Justice&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25-170\/374482\/20250911204722982_25-170_Boulder_FINAL.pdf\">proactively weighed in<\/a><\/strong>&nbsp;to explain why the Court should take the case \u2013 a reversal from the Honolulu petition, whether the Solicitor General&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23-947\/334791\/20241210173557425_23-947_and_23-952_Sunoco_FINAL.pdf\">argued against review<\/a>.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Beyond that, the legal landscape has shifted. Since the Honolulu petition was rejected, ten other cases have been&nbsp;<a href=\"https:\/\/eidclimate.org\/2025-year-in-review-climate-litigation-campaign-losing-momentum\/\">thrown out or withdrawn<\/a>, while two cases have been allowed to proceed \u2013 widening the&nbsp;<strong>split among state courts that warrants Supreme Court resolution.<\/strong><\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Add in the fact that the Colorado Supreme Court\u2019s ruling constitutes&nbsp;<strong>a final decision, the companies&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25-170\/369227\/20250808130855966_Suncor_pet.pdf\">argue<\/a>,<\/strong>&nbsp;giving the Supreme Court jurisdictional footing to review it.<\/em><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong><em>Does the EPA\u2019s ruling on the Endangerment Finding impact climate lawsuits?<\/em><\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\"><em>The EPA&nbsp;<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2026-02-18\/pdf\/2026-03157.pdf\">has maintained<\/a>&nbsp;<strong>the Clean Air Act will continue to preempt state common law claims<\/strong>&nbsp;and statues that try to regulate out-of-state emissions.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>As West Virginia\u2019s Solicitor General, Michael Williams,&nbsp;<a href=\"https:\/\/youtu.be\/fnrghvcZHHQ\">explained<\/a>:<\/em><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><em>\u201cBefore the Clean Air Act was a twinkle in Nixon\u2019s eye, there was this whole&nbsp;<strong>existing body of federal common law that said interstate emissions issues really are issues for the federal government<\/strong>\u2026Ultimately, I think that if you pull the Clean Air Act back, you\u2019re still left with that original preexisting body of federal common law. It\u2019s going to have the same preemptive force that it did before the Clean Air Act ever came to be.\u201d<\/em><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Some legal observers have noted that revoking the Endangerment Finding<strong>&nbsp;could&nbsp;<a href=\"https:\/\/legal-planet.org\/2026\/02\/25\/the-tangled-web-of-the-boulder-v-suncor-cert-grant\/\">actually help companies<\/a><\/strong>&nbsp;in these climate lawsuits. In the case of Boulder, the Colorado Supreme Court rejected defendants\u2019 argument in part because of the Clean Air Act, there\u2019s no federal common law and no preemptions.
