Upon learning the news on Feb 23 that the Supreme Court will be adding the effort to hear the concerns about&nbsp;<a href=\"https:\/\/www.scotusblog.com\/2026\/02\/supreme-court-agrees-to-hear-case-on-colorado-dispute-over-climate-change\/\" target=\"_blank\" rel=\"noreferrer noopener\">the&nbsp;<em>Suncor Energy Inc. v. County Commissioners of Boulder County<\/em>&nbsp;situation<\/a>, I fired off the verbatim email below to&nbsp;<a href=\"https:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/02\/Shanmugam-for-Suncor.jpg\" target=\"_blank\" rel=\"noreferrer noopener\">the main lawyer representing the energy companies<\/a>&nbsp;(I spelled out the individual web links instead of embedding each one as I\u2019ve done below; the bold highlighted words below where highlighted the same way in my email).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It bothers me no end how the defendants in the \u201cExxonKnew\u201d lawsuits argue endlessly&nbsp;<a href=\"https:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/02\/NYT-Fed-or-state-jurisd.jpg\" target=\"_blank\" rel=\"noreferrer noopener\">on esoteric jurisdiction technicalities<\/a>&nbsp;when the golden opportunity to outright kill each one of these lawsuits is practically right in front of them in every lawsuit where the claim is that they ran \u2018disinformation campaigns.\u2019 No, it\u2019s the enviro-activists who are putting out the disinformation, and this whole lawfare effort is deserving of deep investigation for fraud activity by the Department of Justice. I don\u2019t just write about that suggestion, either; I\u2019ve put in to major tip efforts to the DoJ about it.<br>\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014\u2014-<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mr Shanmugam,<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I just learned of the news about SCOTUS scheduling&nbsp;<a href=\"https:\/\/www.scotusblog.com\/2026\/02\/supreme-court-agrees-to-hear-case-on-colorado-dispute-over-climate-change\/\" target=\"_blank\" rel=\"noreferrer noopener\">a hearing over the climate cases<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Forgive me for the bluntness of my question, born out of frustration from my own&nbsp;<a href=\"http:\/\/gelbspanfiles.com\/?page_id=18\" target=\"_blank\" rel=\"noreferrer noopener\">documenting of the fatal faults<\/a>&nbsp;in the current \u201cExxonKnew\u201d lawsuits ever since they started appearing in 2017:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Are the defendants in these cases literally unaware that&nbsp;<a href=\"https:\/\/gelbspanfiles.com\/wp-content\/uploads\/2026\/01\/4-accusation-elements-Soon-39.jpg\" target=\"_blank\" rel=\"noreferrer noopener\">the core accusation elements<\/a>&nbsp;within essentially all of them in one form or another (<em>Boulder v Suncor<\/em>&nbsp;contains&nbsp;<a href=\"https:\/\/gelbspanfiles.com\/wp-content\/uploads\/2023\/09\/Boulder-v-Soon.jpg\" target=\"_blank\" rel=\"noreferrer noopener\">the false accusation<\/a>&nbsp;against skeptic climate scientist Dr Willie Soon, apparently plagiarized out of&nbsp;<a href=\"https:\/\/gelbspanfiles.com\/wp-content\/uploads\/2025\/04\/Boulder-PawaCA-v-Soon.jpg\" target=\"_blank\" rel=\"noreferrer noopener\">the 2017&nbsp;<em>San Francisco v BP<\/em>&nbsp;filing<\/a>&nbsp;<strong>are all completely without merit?<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>These lawsuits make claims that two leaked memo sets \u2013&nbsp;<a href=\"https:\/\/gelbspanfiles.com\/wp-content\/uploads\/2021\/05\/Honolulu-reposit-victory.jpg\" target=\"_blank\" rel=\"noreferrer noopener\">the notorious \u201creposition global warming\u201d and the notorious \u201cvictory will be achieved\u201d sets<\/a>&nbsp;which were&nbsp;<strong><em>never implemented<\/em><\/strong>&nbsp;anywhere;<\/li>\n\n\n\n<li>These lawsuits claim&nbsp;<a href=\"https:\/\/gelbspanfiles.com\/wp-content\/uploads\/2022\/10\/SanMatCo-NJ-non-ICE-ads.jpg\" target=\"_blank\" rel=\"noreferrer noopener\">particular old newspaper advertorials prove disinformation campaigns happen<\/a>&nbsp;where two of&nbsp;<a href=\"https:\/\/gelbspanfiles.com\/wp-content\/uploads\/2024\/04\/GP-ICE-Chicklittle-magnif2.jpg\" target=\"_blank\" rel=\"noreferrer noopener\">those ads<\/a>&nbsp;were&nbsp;<a href=\"https:\/\/gelbspanfiles.com\/wp-content\/uploads\/2024\/07\/GPOA-Doomsday-zoomed.jpg\" target=\"_blank\" rel=\"noreferrer noopener\">never actually published<\/a>&nbsp;anywhere and the third ad that was published&nbsp;<a href=\"https:\/\/gelbspanfiles.com\/wp-content\/uploads\/2024\/08\/GPOA-ChickenDoomsdayMostSerious.jpg\" target=\"_blank\" rel=\"noreferrer noopener\">is disingenuously&nbsp;<strong>cropped<\/strong><\/a>&nbsp;to wipe out ad text that&nbsp;<a href=\"https:\/\/gelbspanfiles.com\/wp-content\/uploads\/2022\/01\/Arizona_Daily_Sun_Fri__May_24__1991_.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">contains no disinformation<\/a>;<\/li>\n\n\n\n<li>These lawsuits make claims about Dr Willie Soon accepting Exxon bribes that&nbsp;<strong>are so false<\/strong>&nbsp;that they may stray into epic defamation territory (\u201c<a href=\"https:\/\/gelbspanfiles.com\/?p=17994\" target=\"_blank\" rel=\"noreferrer noopener\">List of the Climate Lawsuits Falsely Accusing Dr Willie Soon of Taking Exxon Bribes<\/a>\u201c)<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">So . . . . why is it not argued that these lawsuits should be dismissed because they do not present a&nbsp;<em>prima facie<\/em>&nbsp;case that \u2018industry disinformation campaigns employing skeptic scientists\u2019 happened?? Why is it not suggested that the collective climate litigation lawfare efforts should be referred to the Department of Justice as possible instances of widespread fraud activity? Set aside the angles about dubious science and Federal vs state jurisdiction \u2013 plaintiffs hand their heads on a silver platter to defendants over the blatantly false political accusations in these lawsuits. They think they are the good guy \u201cEqualizer\u201d bringing \u2018justice to ClimaChange\u2122 victims, and if they knew about me, they\u2019d think I\u2019m the bad guy. I\u2019m not.
