Environmental Protection Agency’s (EPA) 2009 Endangerment Finding which determined that greenhouse gases (GHGs) like CO\u2082 endanger public health and welfare was predetermined politically rather than based on open scientific deliberation.<\/p>\n\n\n\n

This finding, issued under the Obama administration, concluded that six GHGs (taken in combination) from new motor vehicles cause or contribute to air pollution that endangers public health and welfare. <\/p>\n\n\n\n

It stemmed from the Supreme Court’s 2007 Massachusetts v. EPA ruling, which required the EPA to assess whether GHGs qualify as pollutants under the Clean Air Act. <\/p>\n\n\n\n

The finding provided the legal foundation for subsequent federal regulations on vehicle emissions, power plants, and other sources\u2014underpinning much of U.S. climate policy for over 15 years.<\/p>\n\n\n

The most important climate decision in modern U.S. history is quietly being dismantled<\/strong>.<\/em><\/p>\n\n\n\n

According to reporting by The Wall Street Journal, the Trump administration is moving to repeal the EPA\u2019s 2009 Endangerment Finding<\/strong> \u2014 the regulatory keystone that enabled fifteen years of<\/strong> climate rules<\/strong>, vehicle mandates<\/strong>, power-sector controls<\/strong>, and trillions of dollars in compliance costs.<\/strong><\/em><\/p>\n\n\n\n

\"Headline<\/figure>\n\n\n\n

And yet, remarkably, almost no one is talking about the science<\/strong>.<\/em><\/p>\n\n\n\n

The public conversation is almost entirely about process:<\/strong> whether the repeal will survive legal challenges, whether agencies followed the correct procedures, whether industry benefits too much, and whether courts will intervene. What is missing, again,<\/strong> is a serious discussion of whether the Endangerment Finding was ever scientifically or legally justified in the first place.<\/strong><\/em><\/p>\n\n\n\n

That omission is not accidental<\/strong>. It is the defining feature of modern climate policy.<\/em><\/p>\n\n\n\n

A Decision Made First, Justified Later<\/strong><\/em><\/h4>\n\n\n\n

The EPA\u2019s Endangerment Finding followed the Supreme Court\u2019s Massachusetts v. EPA decision,<\/strong> which merely allowed greenhouse gases to be considered under the Clean Air Act. It did not require the EPA to declare carbon dioxide a danger<\/strong> to public health or welfare. That judgment was left to the agency.<\/em><\/p>\n\n\n\n

And the agency chose its answer early.<\/em><\/p>\n\n\n\n

A recent investigation by the Government Accountability & Oversight Office confirms what many of us suspected at the time: the Endangerment Finding was built around a conclusion that had already been reached<\/strong>. The scientific process that followed was not designed<\/strong> to test whether CO\u2082 posed an endangerment, but to defend a regulatory outcome deemed politically necessary.<\/strong><\/em><\/p>\n\n\n\n

Oversight finding:<\/strong><\/em><\/h4>\n\n\n\n

This is the core argument I laid out in my earlier Irrational Fear piece, \u201cMr. Zeldin, Will You Rescue America From the EPA\u2019s Climate Fraud?\u201d, where I traced how a single bureaucratic determination metastasized into economy-wide control over energy and mobility.<\/strong> I expanded that case in \u201cClimate Lawfare\u201d, showing how courts later shielded massive climate spending programs rooted entirely in the Endangerment Finding\u2019s authority.<\/em><\/p>\n\n\n\n

None of this was hypothetical. It was documented.
It was observable. And it was ignored.<\/strong><\/em><\/p>\n\n\n\n

What the Endangerment Finding Never Confronted<\/strong><\/em><\/h4>\n\n\n\n

A genuine scientific assessment of endangerment would have required confronting inconvenient facts.<\/strong> The 2009 finding did not.<\/em><\/p>\n\n\n\n

It never seriously addressed the role of natural recovery from the Little Ice Age,<\/strong> a period of unusually cold global conditions that peaked well before industrial CO\u2082 emissions and from which the planet has been rebounding for more than a century. Treating all post-19th-century warming as unprecedented and dangerous required quietly discarding that context.<\/em><\/p>\n\n\n\n

It also failed to grapple with the net benefits of modest warming to human societies.<\/strong> Cold is far deadlier than heat. Agricultural productivity improves with longer growing seasons. Energy access reduces vulnerability. These realities undermine the simplistic harm narrative embedded in the finding.<\/em><\/p>\n\n\n\n

Most conspicuously, the EPA excluded the benefits of CO\u2082 fertilization,<\/strong> despite mounting observational evidence, now overwhelming, that higher CO\u2082 concentrations have increased global leaf area, improved plant water-use efficiency, and boosted crop yields. Satellite data did not support a story of planetary decline. They supported one of widespread greening.<\/em><\/p>\n\n\n

The Absurdity of Calling 420 ppm \u201cUnclean Air\u201d<\/strong><\/em><\/h4>\n\n\n\n

Perhaps the most fundamental flaw<\/strong> in the Endangerment Finding is conceptual.<\/em><\/p>\n\n\n\n

For most of Earth\u2019s history, atmospheric CO\u2082 levels were<\/strong> not 280 ppm or 420 ppm, but 1,000 to more than 4,000 ppm.<\/strong> Life did not collapse under those conditions. It flourished. Forests expanded. Biodiversity increased. Entire ecosystems thrived.<\/strong><\/em><\/p>\n\n\n\n

Against that backdrop, the claim that today\u2019s atmosphere \u2014 at roughly 0.04% CO\u2082 \u2014 constitutes \u201cunclean air\u201d collapses under minimal scrutiny. Carbon dioxide is<\/strong> not mercury. It is not sulfur dioxide. It is not lead. It is an essential molecule for life.<\/strong><\/em><\/p>\n\n\n\n

Years of Writing, One Conclusion<\/strong><\/em><\/h4>\n\n\n\n

At Irrational Fear, I have spent years examining these issues from multiple angles:<\/strong> disaster statistics, sea-level records, hurricane data, climate costs, adaptation, and the repeated failure of model projections to match observations. I submitted those findings formally to the EPA<\/strong> in my public comment supporting reconsideration of the Endangerment Finding, drawing directly on hundreds of prior analyses.<\/em><\/p>\n\n\n\n

The conclusion has remained consistent: the evidence never supported a finding of endangerment.<\/strong><\/em><\/p>\n\n\n\n

What has changed is not the data. What has changed is<\/strong><\/em>
the legal and political tolerance for pretending otherwise.<\/strong><\/em><\/p>\n\n\n\n
