They argue the review effectively instructs the government to set a price for carbon emissions but doesn\u2019t clearly limit how the government could use that price later.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Though not legally binding, federal agencies\u00a0<a href=\"https:\/\/www.everycrsreport.com\/files\/2021-09-14_R44124_1e6e10d3d98d2948420a900a5c831c5b08b8e025.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">tend to comply<\/a>\u00a0with a report\u2019s directives, according to the Congressional Research Service. It is not clear who placed the directive into the report, E&amp;E News\u00a0<a href=\"https:\/\/www.eenews.net\/articles\/carbon-trade-measure-slips-into-spending-package\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>. The DCNF reached out to every Republican on the Senate Appropriations Committee to determine who added the language but received no responses.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cThis Senate Appropriations report quietly resurrects carbon accounting as federal policy, giving legitimacy to the same ESG [environmental, social and governance] framework driving Europe\u2019s carbon border taxes,\u201d Jason Isaac, CEO of the\u00a0<a href=\"https:\/\/americanenergyinstitute.com\/team\/hon-jason-isaac\/\" target=\"_blank\" rel=\"noreferrer noopener\">American Energy Institute<\/a>, told the DCNF. \u201cOnce Washington starts ranking U.S. products by \u2019emissions intensity,\u2019 those metrics inevitably become regulatory and trade weapons, regardless of intent. That approach contradicts the administration\u2019s effort to unwind the Endangerment Finding and the greenhouse gas reporting regime. America should be dismantling ESG, not laundering it through appropriations language written for Brussels, not U.S. consumers.\u201d\u00a0<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><strong><a href=\"https:\/\/dailycaller.com\/2026\/01\/16\/gop-republican-principles-house-7006-amendments-arctic-frost\/?utm_medium=organic&amp;utm_campaign=related&amp;utm_source=website\">(RELATED: GOP Stumbles On Core Republican Principles In Key Votes)<\/a><\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The DOE did not respond to the DCNF\u2019s multiple requests for comment.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The European Union recently&nbsp;<a href=\"https:\/\/taxation-customs.ec.europa.eu\/carbon-border-adjustment-mechanism_en#cbam-definitive-regime-from-2026-onwards\" target=\"_blank\" rel=\"noreferrer noopener\">enacted<\/a>&nbsp;an import tax on Jan. 1 that adjusts tariffs based on the amount of carbon dioxide emitted when producing certain goods known as the Carbon Border Adjustment Mechanism (CBAM).<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The report acknowledges recent EU trade policies like CBAM, then states that \u201caccordingly, the Committee directs NETL, in consultation with relevant agencies, institutions, academia, and think tank partners as necessary, to conduct a study to determine the average product emissions intensity of certain goods produced in the U.S. compared to those produced in other countries.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The report\u2019s language is notably similar to the Providing Reliable, Objective, Verifiable Emissions Intensity and Transparency (<a href=\"https:\/\/www.congress.gov\/bill\/118th-congress\/senate-bill\/1863\" target=\"_blank\" rel=\"noreferrer noopener\">PROVE IT<\/a>) Act, which was introduced in 2023 and again in 2024 but never enacted by Congress.&nbsp;Democratic Sen. Chris Coons of Delaware, Republican Sen. Kevin Cramer of North Dakota and Republican Sen. John Curtis of Utah previously introduced the PROVE It Act.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Eighty-two Senators&nbsp;<a href=\"https:\/\/www.naco.org\/news\/us-congress-passes-minibus-funding-package\" target=\"_blank\" rel=\"noreferrer noopener\">voted<\/a>&nbsp;<a href=\"https:\/\/www.senate.gov\/legislative\/LIS\/roll_call_votes\/vote1192\/vote_119_2_00011.htm\" target=\"_blank\" rel=\"noreferrer noopener\">in favor<\/a>&nbsp;of the minibus package and President Donald Trump signed it into law, Cramer told the DCNF, arguing that \u201cthe proof is in the results, not how someone else feels about them\u201d when asked about critics\u2019 opinions on the directive.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cI represent an energy-producing state, and my constituents are neither dumb nor uninformed enough to think PROVE IT makes U.S. taxpayers pay for the EU\u2019s carbon tariffs. Europe is already putting a tariff on us with its one-sided CBAM, this report helps us defend against it,\u201d Cramer told the DCNF in response to a question on how he might address constituents\u2019 concerns. \u201cI don\u2019t know any Republicans who are in favor of a carbon tax, which is why we need this program.\u201d<strong>\u00a0<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Proponents of the bill and the emissions review&nbsp;<a href=\"https:\/\/clcouncil.org\/proveit\/\" target=\"_blank\" rel=\"noreferrer noopener\">often<\/a>&nbsp;<a href=\"https:\/\/www.realclearenergy.org\/articles\/2024\/03\/04\/us_manufacturing_is_among_the_cleanest_in_the_world__lets_prove_it_1016001.html\" target=\"_blank\" rel=\"noreferrer noopener\">argue<\/a>&nbsp;that the U.S. needs verifiable manufacturing emissions data to reward cleaner producers and shield businesses from European import taxes based on purportedly less reliable figures.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Dozens of energy policy and advocacy groups&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/01\/16\/dozens-energy-experts-congress-oppose-carbon-tax-bill\/\" target=\"_blank\" rel=\"noreferrer noopener\">urged<\/a>&nbsp;Congress to oppose the PROVE IT Act, the DCNF previously&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/06\/03\/energy-groups-congress-letter-prove-it-act\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>. Signatories on a letter warning Congress about the bill included Isaac, Bakst and The Heartland Institute.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cLanguage buried in a report accompanying the energy spending bill would require a study comparable to what was required under the PROVE IT Act,\u201d Director of the Competitive Enterprise Institute\u2019s (CEI) Center for Energy and Environment Daren Bakst told the DCNF. \u201cThe lawmakers that took such an action must have properly recognized that the only way to push their global climate agenda and undermine the Trump administration agenda is to sneak it into some report.\u201d\u00a0<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><strong><a href=\"https:\/\/dailycaller.com\/2024\/05\/24\/oil-lobby-carbon-tax-republicans\/?utm_medium=organic&amp;utm_campaign=related&amp;utm_source=website\" target=\"_blank\" rel=\"noreferrer noopener\">(RELATED: Oil Lobby Working With Republicans Behind The Scenes To Push \u2018Gateway\u2019 To Carbon Tax)<\/a><\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Coons and Curtis did not respond to the DCNF\u2019s requests for comment.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Bakst noted that the Trump administration has&nbsp;<a href=\"https:\/\/dailycaller.com\/2026\/01\/07\/trump-admin-withdrawing-from-anti-american-global-climate-change-regimes\/\" target=\"_blank\" rel=\"noreferrer noopener\">worked to distance<\/a>&nbsp;the U.S. from global climate initiatives it believes are contrary to America\u2019s best interest and that it recently&nbsp;<a href=\"https:\/\/www.state.gov\/releases\/office-of-the-spokesperson\/2025\/10\/taking-action-to-defend-america-from-the-uns-first-global-carbon-tax-the-international-maritime-organizations-imo-net-zero-framework-nzf\" target=\"_blank\" rel=\"noreferrer noopener\">bucked against<\/a>&nbsp;the United Nation\u2019s global maritime carbon tax successfully.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">\u201cYet there are apparently some lawmakers, including some Republicans, who don\u2019t want to fight the European-led export of global climate regulation, they want to be a part of it,\u201d Bakst told the DCNF. \u201cThey don\u2019t want to fight Europe from taxing American companies through their sweeping new carbon border tax, which is broader than a shipping tax, they want to follow the lead of Europe and join their carbon club by helping to set the framework for our own carbon border tax.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Sterling Burnett, the director of the environmental sector at The Heartland Institute,&nbsp;told the DCNF that \u201cas evidenced by statements and proposals in the past related to similar earlier proposals, this is a wolf in sheep\u2019s clothing, setting the United States up for imposing carbon tariffs which are nothing more nor less than a carbon tax on consumers. This provision pleased and garnered support from RINO\u2019s who have no understanding of economics and have long cuddled up to the climate alarmists in the Democratic party.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Notably, some of the most aggressive Democrat lawmakers on climate issues&nbsp;<a href=\"https:\/\/bpcaction.org\/bpc-action-applauds-advancement-of-the-prove-it-act\/\" target=\"_blank\" rel=\"noreferrer noopener\">supported<\/a>&nbsp;the PROVE It Act, with Rhode Island Sen.&nbsp;<a href=\"https:\/\/www.coons.senate.gov\/news\/press-releases\/senators-coons-cramer-introduce-legislation-to-study-global-emissions-intensity-and-hold-countries-with-dirty-production-accountable\" target=\"_blank\" rel=\"noreferrer noopener\">Sheldon Whitehouse<\/a>&nbsp;signing on as a co-sponsor.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">DOE Secretary Chris Wright \u201chas [the] responsibility to exercise oversight, and to make it clear that a carbon tax or tariff based on this report, would be a mistake and is not supported by the administration,\u201d Burnett told the DCNF.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><em>All content created by the Daily Caller News Foundation, an independent and nonpartisan newswire service, is available without charge to any legitimate news publisher that can provide a large audience.
