class=\"has-medium-font-size wp-block-paragraph\">President Trump is withdrawing the United States from 66 intergovernmental organizations he has determined are \u201ccontrary to the interests of the United States.\u201d This is a big deal, especially the president\u2019s decision to withdraw from the UN Framework Convention on Climate Change (<a href=\"https:\/\/unfccc.int\/resource\/docs\/convkp\/conveng.pdf\">UNFCCC<\/a>), the foundational treaty for global climate policy.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">This action has been almost a year in the making.&nbsp;<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2025-02-10\/pdf\/2025-02504.pdf#page=1\">Executive Order 14199<\/a>, issued on February 4, 2025, directed the Secretary of State to \u201cconduct a review of all international intergovernmental organizations of which the United States is a member and provides any type of funding or other support, and all conventions and treaties to which the United States is a party, to determine which organizations, conventions, and treaties are contrary to the interests of the United States and whether such organizations, conventions, or treaties can be reformed.\u201d Upon completion of the review, the Secretary \u201cshall provide recommendations as to whether the United States should withdraw from any such organizations, conventions, or treaties.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Trump\u2019s January 7, 2026&nbsp;<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2026\/01\/withdrawing-the-united-states-from-international-organizations-conventions-and-treaties-that-are-contrary-to-the-interests-of-the-united-states\/\">presidential memorandum<\/a>&nbsp;directs executive branch agencies, \u201cto the extent permitted by law,\u201d to cease participation in or funding 66 named intergovernmental entities \u201cas soon as possible.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Although not spelled out in the memorandum, the big picture is clear. Trump aims to free the US from international commitments that hobble or imperil its pursuit of affordable energy, economic growth, and \u201cenergy dominance,\u201d a top priority of his&nbsp;<a href=\"https:\/\/www.whitehouse.gov\/wp-content\/uploads\/2025\/12\/2025-National-Security-Strategy.pdf\">National Security Strategy<\/a>. He has already&nbsp;<a href=\"https:\/\/cei.org\/blog\/trump-congress-overturn-californias-gas-car-ban\/\">taken<\/a>&nbsp;<a href=\"https:\/\/cei.org\/blog\/power-plant-greenhouse-gas-emissions-dont-contribute-significantly-to-dangerous-air-pollution\/\">bold<\/a>&nbsp;<a href=\"https:\/\/cei.org\/wp-content\/uploads\/2025\/09\/CEIEndangermentCommentFinal-September-22-2025-copyrighted-image-removed.pdf\">steps<\/a>&nbsp;to free the US energy sector and economy from climate-themed overregulation. Exiting the UN-centric world of climate diplomacy should make those achievements more durable. &nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Trump\u2019s decision to withdraw from the UNFCCC is especially gratifying to CEI. In the early 1990s, CEI Founder Fred Smith led a coalition that urged the George H.W. Bush administration not to ratify the purportedly \u201cvoluntary\u201d UNFCCC. Ratification, they warned, would legitimize and entangle the US in a global pressure campaign for energy-suppression policies detrimental to American liberty and prosperity. They were right.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The UNFCCC became the parent treaty for the 1997&nbsp;<a href=\"https:\/\/unfccc.int\/resource\/docs\/convkp\/kpeng.pdf\">Kyoto Protocol<\/a>&nbsp;and then the 2015&nbsp;<a href=\"https:\/\/unfccc.int\/files\/meetings\/paris_nov_2015\/application\/pdf\/paris_agreement_english_.pdf\">Paris Agreement<\/a>. Paris aims to mitigate climate change by \u201cholding the increase in the global average temperature to well below 2\u00b0C above pre-industrial levels and pursuing efforts to limit the temperature increase to 1.5\u00b0C.\u201d However, as energy analyst&nbsp;<a href=\"https:\/\/www.realclearenergy.org\/articles\/2026\/01\/15\/donald_trumps_cop_out_1158800.html\">Stephen Eule<\/a>&nbsp;observes, the Agreement does not specify the quantity of emission reductions needed to meet those targets.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">That important detail was still largely unknown in November 2016, when the Paris Agreement&nbsp;<a href=\"https:\/\/unfccc.int\/process-and-meetings\/the-paris-agreement\">entered into force<\/a>. The UN Intergovernmental Panel on Climate Change (IPCC) first published an official estimate in its October 2018&nbsp;<em>Special Report on Global Warming of 1.5\u00b0C<\/em>. Global carbon dioxide emissions&nbsp;<a href=\"https:\/\/www.ipcc.ch\/sr15\/chapter\/spm\/\">would have to<\/a>&nbsp;\u201cdecline by about 45 percent from 2010 levels by 2030, reaching net zero by around 2050.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Thus, the Paris Agreement both concealed and launched the&nbsp;<a href=\"https:\/\/energyanalytics.org\/wp-content\/uploads\/2025\/11\/2025-11-NCEA-Kaya-IssueBrief-Eule.pdf\">infeasible<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/lomborg.com\/news\/bidens-climate-ambitions-are-too-costly-voters\">unaffordable<\/a>&nbsp;<a href=\"https:\/\/thegwpf.org\/publications\/lack-of-energy-storage-makes-renewables-only-grids-a-pipedream\/\">net-zero agenda<\/a>&nbsp;that today contributes to rising US electricity prices (especially in&nbsp;<a href=\"https:\/\/www.instituteforenergyresearch.org\/the-grid\/blue-states-high-rates\/\">blue states<\/a>) and risks deindustrialization in&nbsp;<a href=\"https:\/\/www.intereconomics.eu\/contents\/year\/2023\/number\/4\/article\/deindustrialisation-a-european-assessment.html\">EU<\/a>&nbsp;<a href=\"https:\/\/www.cleanenergywire.org\/news\/energy-costs-uncertainty-fuel-german-industry-plans-cut-or-relocate-production-survey?utm_source=chatgpt.com\">nations<\/a>&nbsp;as manufacturers consider shifting operations to countries with lower energy costs.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Recognizing the deep incompatibility between Paris and US energy dominance, Trump withdrew from the Agreement in&nbsp;<a href=\"https:\/\/cei.org\/blog\/the-constitutional-cure-for-the-paris-agreement\/\">June 2017<\/a>&nbsp;and again in&nbsp;<a href=\"https:\/\/cei.org\/blog\/were-out-of-the-paris-agreement-again-how-trump-can-make-it-stick\/\">January 2025<\/a>. A question that remained unanswered each time was how Trump could prevent a future president from rejoining the global carbon-haters club.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Trump\u2019s challenge was formidable. The Obama administration denied that Paris was a \u201ctreaty\u201d for purposes of&nbsp;<a href=\"https:\/\/www.usconstitution.net\/xconst_a2sec2-html\/\">Article II, Section 2<\/a>&nbsp;of the Constitution. Under that provision, the president \u201cshall have power, by and with the advice and consent of the Senate, to make treaties, provided two thirds of the Senators present concur.\u201d The Obama administration therefore claimed Paris was an \u201cexecutive agreement\u201d \u2014 a pact that the president can \u201caccept\u201d (i.e., ratify) acting on his sole authority as chief diplomat. The Biden administration took the same position when rejoining Paris.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Whether or not that was their sincere belief, the Obama and Biden administrations must have known there was no chance \u201ctwo thirds of the Senators present\u201d would vote in favor of ratifying a new global climate treaty. Hence, evading the Article II, Section 2 procedure was the only way for a US president to join or rejoin the Agreement.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The Senate\u2019s shared role in treaty making is a well-known example of the Constitution\u2019s checks and balances but its special character is often overlooked. Under Article II, Section 2, the president may appoint ambassadors, other officers of the United States, and even Supreme Court justices with the concurrence of a simple majority in the Senate. Adopting a treaty requires a much higher level of consent, one reflecting a broad national consensus. That is fitting, given the \u201c<a href=\"https:\/\/founders.archives.gov\/documents\/Hamilton\/01-04-02-0227\">delicate and momentous<\/a>\u201d nature of the \u201cinterests\u201d at risk.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">President Obama&nbsp;<a href=\"https:\/\/obamawhitehouse.archives.gov\/the-press-office\/2015\/12\/12\/us-leadership-and-historic-paris-agreement-combat-climate-change\">called Paris<\/a>&nbsp;\u201cthe most ambitious climate change agreement in history.\u201d In fact, Paris is the most ambitious&nbsp;<em>environmental treaty<\/em>&nbsp;in history. It aims at nothing less than a global transformation of national energy policies, markets, and infrastructure, ostensibly to save the planet. As noted, Paris midwifed the net-zero agenda, which a&nbsp;<a href=\"https:\/\/oilprice.com\/Energy\/Energy-General\/The-Staggering-76-Trillion-Price-Tag-of-Britains-Net-Zero-Ambition.html\">recent study<\/a>&nbsp;estimates could impose costs of up to&nbsp;<a href=\"https:\/\/iea.org.uk\/wp-content\/uploads\/2026\/01\/Turver-Cost-of-Net-Zero-Set-final-03.pdf\">\u00a37.6 trillion<\/a>&nbsp;($10.2 trillion) in Great Britain alone.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The bottom line is that Paris should have been reviewed under the Article II, Section 2 procedure due to its potential costs and risks to the nation,&nbsp;<a href=\"https:\/\/science.house.gov\/_cache\/files\/3\/a\/3a26cbe9-d1f0-4233-a4d7-3e75b430f912\/13BCEE5D0E9CD598B630674543B36F9BE6DF9FCB5664B056E68160658CF0B4E5.hhrg-114-sy-wstate-seule-20160202.pdf\">dependence on subsequent legislation<\/a>&nbsp;by Congress, potential to affect state laws, past US practice regarding similar agreements, duration, and other&nbsp;<a href=\"https:\/\/2009-2017.state.gov\/e\/oes\/rls\/rpts\/175\/1319.htm\">common-sense criteria<\/a>. &nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Responding to such criticism, Obama climate adviser Brian Deese&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/news\/2016\/sep\/3\/obama-xi-ratify-climate-change-agreement\/\">reportedly told&nbsp;<em>The<\/em>&nbsp;<em>Washington Times<\/em><\/a>&nbsp;that Presidents Ronald Reagan and George W. Bush \u201cjoined important international environmental agreements by using executive agreements.\u201d Deese did not cite any examples. I checked the State Department\u2019s Treaties and Other International Acts Series&nbsp;<a href=\"https:\/\/www.state.gov\/tias\/\">database<\/a>. It does not support Deese\u2019s claim.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">With the advice and consent of the Senate, President Reagan&nbsp;<a href=\"https:\/\/www.state.gov\/89-101\/?utm_source=chatgpt.com\">ratified the Montreal Protocol<\/a>&nbsp;on Substances that Deplete the Ozone Layer, on April 5, 1988. He did not join any environmental pacts as executive agreements.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The George W. Bush administration negotiated&nbsp;<a href=\"https:\/\/cei.org\/blog\/precedent-on-environmental-pacts-treaty-or-executive-agreement\/\">15 environmental executive agreements<\/a>, but none entailed commitments or risks to the nation. Unlike Paris, all were clearly authorized either by Congress, other treaties, or the president\u2019s inherent powers as chief executive or Commander in Chief.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">CEI has&nbsp;<a href=\"https:\/\/cei.org\/blog\/the-constitutional-cure-for-the-paris-agreement\/\">long advocated<\/a>&nbsp;that President Trump ask the Senate to debate and vote on ratification of the Paris Agreement and then, when the ratification vote fails, declare the US is not now and has never been a party to the Agreement.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">However, we also&nbsp;<a href=\"https:\/\/cei.org\/sites\/default\/files\/Chris%20Horner%20and%20Marlo%20Lewis%20-%20The%20Legal%20and%20Economic%20Case%20Against%20the%20Paris%20Climate%20Treaty.pdf\">acknowledged<\/a>&nbsp;that presidential withdrawal from the UNFCCC is a quicker and more comprehensive remedy, as the Paris Agreement itself implicitly confirms. Paris&nbsp;<a href=\"https:\/\/unfccc.int\/files\/meetings\/paris_nov_2015\/application\/pdf\/paris_agreement_english_.pdf?v=010406\">Article 28<\/a>&nbsp;states: \u201cAny Party that withdraws from the Convention [UNFCCC] shall be considered as also having withdrawn from this Agreement.\u201d<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">In short, by withdrawing from the UNFCCC, Trump has blocked future presidents from attempting to rejoin Paris via executive agreement. That would be hard.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">After all, we are a long way from 1992, when the Senate, having little awareness of the&nbsp;<a href=\"https:\/\/archive.ph\/4K48e\">economic<\/a>,&nbsp;<a href=\"https:\/\/cei.org\/blog\/are-the-rico-20-guilty-of-racketeering\/\">humanitarian<\/a>, and<a href=\"https:\/\/cei.org\/blog\/climate-risk-climate-policy-and-the-ukraine-crisis\/\"><\/a>&nbsp;<a href=\"https:\/\/cei.org\/blog\/climate-risk-climate-policy-and-the-ukraine-crisis\/\">security<\/a>&nbsp;risks of regulatory climate policy, voted&nbsp;<a href=\"https:\/\/www.congress.gov\/treaty-document\/102nd-congress\/38\">overwhelmingly<\/a>&nbsp;in favor of ratifying the UNFCCC. Senators supporting US energy dominance today should have no difficulty understanding they must keep America out of the UNFCCC and the Paris Agreement.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Music man Paul Simon sang of \u201c50 ways to leave your lover.\u201d Trump has not found 50 ways to leave Paris, but he seems to have found three.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">As indicated above, on January 20, 2025, President Trump&nbsp;<a href=\"https:\/\/cei.org\/blog\/were-out-of-the-paris-agreement-again-how-trump-can-make-it-stick\/\">directed<\/a>&nbsp;the ambassador to the UN to \u201cimmediately submit formal written notification of the United States\u2019 withdrawal from the Paris Agreement.\u201d That\u2019s the first way. That finding ostensibly required the EPA to establish first-ever greenhouse gas (GHG) emission standards for new motor vehicles. It soon morphed into a generic scientific justification for other GHG regulatory initiatives, including the Obama administration\u2019s 2015&nbsp;<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2014-06-18\/pdf\/2014-13726.pdf\">Clean<\/a>&nbsp;<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2015-10-23\/pdf\/2015-22842.pdf\">Power Plan<\/a>, which was a&nbsp;<a href=\"https:\/\/insideclimatenews.org\/news\/20032017\/paris-climate-agreement-donald-trump-global-warming-clean-power-plan\/?utm_source=chatgpt.com\">central pillar<\/a>&nbsp;of President Obama\u2019s emission-reduction&nbsp;<a href=\"https:\/\/www4.unfccc.int\/sites\/submissions\/INDC\/Published%20Documents\/United%20States%20of%20America\/1\/U.S.%20Cover%20Note%20INDC%20and%20Accompanying%20Information.pdf\">pledge<\/a>&nbsp;under the Paris Agreement.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">If courts uphold the EPA\u2019s repeal of the 2009 Endangerment Finding, a future administration could not make credible emission-reduction commitments under the Paris Agreement.
