href=\"https:\/\/www.cfact.org\/author\/paul3\/\">Paul Driessen<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Climate lawfare is a Big Business. State, county and city lawyers have filed&nbsp;<a href=\"https:\/\/www.realclearpolitics.com\/articles\/2024\/11\/21\/nonprofits_influence_climate_litigation_against_major_energy_companies_151981.html\">some 30 lawsuits<\/a>, alleging that oil companies misrepresented the impacts of their products and caused billions of dollars in climate and weather damages.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After being approached by EarthRights International, Boulder and Boulder County, Colorado joined San Miguel County in April 2018 to sue Suncor Energy and ExxonMobil.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Leaving out the hurricanes and rising seas emphasized by coastal litigants, plaintiffs\u2019 105-page complaint alleges that the oil companies have severely harmed their property, health and safety, by causing higher temperatures, more droughts and wildfires, and dwindling snowpack that adversely affects water supplies and the farming and skiing industries.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They want a trial by local jurors and seek billions of dollars to compensate their jurisdictions for past and future damages and costs, evaluate and mitigate climate change impacts, abate and remediate its hazards, and compensate them for decreased agricultural and urban property values.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Defendants argue that the case raises major, complicated national and even international issues and therefore belongs in federal, not state courts. But after&nbsp;<a href=\"https:\/\/www.climatecasechart.com\/collections\/board-of-county-commissioners-of-boulder-county-v-suncor-energy-u-s-a-inc-_be5980\">years of legal wrangling<\/a>, the&nbsp;<a href=\"https:\/\/www.spencerfane.com\/insight\/colorado-supreme-court-rules-that-boulders-tort-based-climate-change-damages-lawsuit-will-proceed-in-state-court\/\">Colorado Supreme Court ruled<\/a>&nbsp;in May 2025 that the lawsuit could indeed proceed in state court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So now Suncor and ExxonMobil have petitioned the US Supreme Court to review the case.&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25-170\/384126\/20251110174050279_25-170%20Brief%20in%20Opposition.pdf\">Plaintiffs strongly oppose this<\/a>. But there are compelling reasons why the Supremes should move it to federal venues, after declining earlier lawsuits that they said did not present a ripe or perfect case for review.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Fifty-plus years ago, I lived in Boulder and Denver and often went downhill and cross-country skiing. We had variable snow seasons: early and long, late and short, great snowpack or rocks. Back then the mantra was global cooling and a new ice age, but it later shifted to \u201cglobal warming\u201d when average global temperatures rose slightly, and finally to the all-encompassing \u201cclimate change\u201d narrative.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I saw the aftermath of Colorado\u2019s worst natural disaster ever, the 1976&nbsp;<a href=\"https:\/\/www.coloradoan.com\/story\/news\/2016\/07\/29\/big-thompson-flood-killed-scores\/87524858\/\">Big Thompson flood<\/a>. I witnessed other monster rainfalls, droughts and dust storms, and multiple wildfires.&nbsp;<a href=\"https:\/\/www.smithsonianmag.com\/history\/riddles-of-the-anasazi-85274508\/\">Decades-long Anasazi droughts<\/a>&nbsp;underscore Nature\u2019s destructive forces centuries ago.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Plaintiffs cannot possibly make a convincing historical or scientific case that today\u2019s climate and weather are unusual or unprecedented. Nor can they separate&nbsp;<em>natural<\/em>&nbsp;forces and effects from fossil fuel or other manmade influences.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Team Boulder claims its case involves only&nbsp;<em>local<\/em>&nbsp;damages, issues, legal claims and remedies. However, ExxonMobil and Suncor production and refining activities, sales, emissions and alleged climate impacts are hardly confined to two counties or even the State of Colorado. The lawsuit\u2019s effects would ripple like tsunamis across the USA and world.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Indeed, current and former county attorneys and officials have said the&nbsp;<a href=\"https:\/\/eidclimate.org\/boulders-response-underscores-why-scotus-should-take-up-climate-case\/\">primary goals of this litigation<\/a>&nbsp;include imposing \u201can indirect carbon tax\u201d on defendants\u2019 products; \u201craising the price\u201d of those products so that they become too expensive for most families; curtailing fossil fuel use; and effecting \u201csystems-level change\u201d to America\u2019s energy, economic and social systems.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The products include transportation fuels for Colorado and US cars, trucks, tractors and aircraft; natural gas to generate electricity for lights, computers, medical equipment, and lifesaving heating and air conditioning; and petrochemical feedstocks for over 6,000 essential products, including paints, plastics, pharmaceuticals, cosmetics, fertilizers, and skis, ski boots and clothing of all descriptions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Climate activists have been unable to enact national legislation to curb or eliminate the use of coal, oil or natural gas \u2013 or persuade Congress to ratify international treaties that compel&nbsp;<em>all countries<\/em>&nbsp;to slash their fossil fuel use and greenhouse gas emissions. Climate lawfare, via local and state courts, has thus become a central tactic for imposing their radical agenda, controlling our lives and reducing our living standards.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They know&nbsp;<a href=\"https:\/\/www.cfact.org\/2025\/11\/23\/un-climate-summit-ends-in-failure-at-every-level\/\">COP30 was an abject failure<\/a>&nbsp;and overtures to \u201cclimate cataclysms\u201d are&nbsp;<a href=\"https:\/\/www.cfact.org\/2025\/11\/15\/cop-30-ten-years-after-paris-climatism-is-crumbling\/\">falling on deaf ears<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They want to avoid federal courts and lawyers that might closely examine their far-fetched claims from national, international, scientific and economic perspectives. They know a US Supreme Court ruling in defendants\u2019 favor would likely end any option for them to circumvent federal legislative and judicial processes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Climateers also know that US states that enforce wind and solar power mandates have electricity prices at least&nbsp;<a href=\"https:\/\/www.energybot.com\/electricity-rates\/virginia\/\">two times higher<\/a>&nbsp;than those that have not. Worse, residential prices in climate-obsessed Britain, Germany and other European countries are&nbsp;<a href=\"https:\/\/www.statista.com\/statistics\/263492\/electricity-prices-in-selected-countries\/?srsltid=AfmBOooQ0hlC9OlZoc95caawsdkIKAr58oKK-STcIm4agEBiQ8IziDWJ\">2-3 times higher<\/a>&nbsp;than the US average: 30 to 40+ cents per kilowatt-hour in Europe versus 15 cents in the USA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They know (but vigorously deny) that German, British and other European electricity prices have caused their industries to lose millions of jobs and left families unable to heat their homes properly, leading to thousands of needless deaths every winter. Iberia\u2019s peninsula-wide blackout in April 2025 proved reliance on wind and solar power can be disastrous, even deadly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s hardly surprising that no other city or county has joined the lawsuit. That Colorado\u2019s governor and former governor have refused to support it. Or that Colorado\u2019s own attorney general joined 14 other state AGs in signing an amicus curiae brief opposing a very similar suit by California cities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The AGs argued that cities should not be able to use the common nuisance law to \u201charness the power and prestige of federal courts to remedy global climate change.\u201d They also noted that: \u201cquestions of global climate change and its effects \u2026 are political questions not suited for resolution by any court.\u201d Indeed, such judicial interference would trample on \u201cCongress\u2019s carefully calibrated process of cooperative federalism where states work in tandem with EPA to administer the federal Clean Air Act.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These issues are for&nbsp;<a href=\"https:\/\/heartland.org\/opinion\/federal-court-dismisses-new-york-citys-climate-lawsuit\/\">Congress and the Executive Branch<\/a>&nbsp;to debate, balance competing needs and interests, and decide at the national level. In dismissing&nbsp;<a href=\"https:\/\/heartland.org\/opinion\/federal-court-dismisses-new-york-citys-climate-lawsuit\/\">New York City\u2019s similar climate lawsuit<\/a>, Federal Judge John Keenan made the same points.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Perhaps most importantly, over the past few years, the US Supreme Court has significantly curtailed the powers of federal agencies. In&nbsp;<em>West Virginia v. EPA<\/em>&nbsp;(2022), it held that, in the absence of clear legislative authority, government agencies cannot unilaterally issue regulations that have \u201cmajor\u201d economic or political significance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Loper Bright Enterprises v. Raimondo<\/em>&nbsp;(2023) reversed the \u201cChevron deference\u201d rule. Silent or ambiguous statutory texts no longer give administrative agencies unfettered power to interpret laws in ways that let them increase control over people\u2019s lives and livelihoods.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cities, counties and states certainly should not have greater power than federal agencies \u2013 or be able to employ common law rulings \u2013 to control America\u2019s fossil fuel production, use and products, in a futile attempt to control Earth\u2019s perpetually changing climate. Especially when the vast majority of global greenhouse gas emissions now come from&nbsp;<a href=\"https:\/\/worldpopulationreview.com\/country-rankings\/co2-emissions-by-country\">China, India, Russia and other countries<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The climate litigation charade must end.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Let\u2019s hope the Supreme Court agrees that Boulder\u2019s lawsuit is an excellent opportunity to terminate frivolous climate lawfare, expand on the guidance it provided in these two previous cases \u2013 and end attempts by climate activists to impose destructive national policies through local and state courts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Climate lawfare is a Big Business.
