From the Department of Justice labeling certain mothers \u201c<a href=\"https:\/\/judiciary.house.gov\/media\/press-releases\/us-house-judiciary-republicans-doj-labeled-dozens-of-parents-as-terrorist\">domestic terrorists<\/a>\u201d to the Transportation Safety Agency (TSA) adding individuals unwilling to wear masks to the \u201c<a href=\"https:\/\/nypost.com\/2025\/09\/30\/us-news\/biden-admin-put-americans-who-flouted-covid-mask-mandate-on-no-fly-list-which-is-usually-reserved-for-terrorists\/\">no-fly<\/a>\u201d list, the Biden administration left no stone unturned.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Even energy departments were not off limits. Take the Federal Energy Regulatory Commission (FERC). The FERC is supposed to be accountable to, but independent of, the White House, similar to the Federal Reserve, where President Trump can urge Chair Jerome Powell to lower interest rates but has no direct authority to make it happen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The independence of FERC ensures that energy and infrastructure decisions are immune from presidential politics, and that is a good thing. Imagine a President Gavin Newsom ordering FERC actions to appease the green fringe of his base.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">FERC\u2019s mandate is to ensure the i\u2019s are dotted and the t\u2019s are crossed; that all parties are compliant and all laws and regulations obeyed. That is not what happened during the Biden years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On Biden\u2019s first day in office, he&nbsp;<a href=\"https:\/\/www.ans.org\/news\/article-2563\/glick-chosen-to-head-ferc\/#:~:text=Thu%2C%20Jan%2021%2C%202021%2C,tackle%20the%20many%20challenges%20ahead!\">nominated<\/a>&nbsp;Richard Glick as FERC Chairman. Shortly thereafter, FERC became a bottleneck for seemingly perfunctory, non-controversial, energy projects. Glick&nbsp;<a href=\"https:\/\/www.energy.senate.gov\/services\/files\/270F8F6E-C554-43CF-B683-EB60583873D8\">told Congress<\/a>&nbsp;in 2022 his decision making was based on \u201cwhether the benefits of the project \u2013 especially increasing access to natural gas \u2013 outweigh its adverse impacts.\u201d No longer was Glick a compliance officer. He was making value judgments outside of the regulatory guardrails and even above and beyond Congress, which is accountable to the voters who elect them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is pure insanity that an energy regulator, presumably an expert in the energy space, would describe increasing access to natural gas as an \u201cadverse impact\u201d. That is not regulatory oversight but a political vision, and it was no coincidence FERC started playing politics.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In June 2022,&nbsp;<em>The<\/em>&nbsp;<em>Wall Street Journal<\/em>&nbsp;<a href=\"https:\/\/www.wsj.com\/opinion\/richard-glicks-white-house-chats-federal-energy-regulatory-commission-climate-natural-gas-pipelines-11654875825?gaa_at=eafs&amp;gaa_n=ASWzDAjV-bYoK23sEOJg0wuTy9YDVil7FyW-ogKGwCwSX2gxrtC2oMfxTnM4wWxCWqg%3D&amp;gaa_ts=68ee965a&amp;gaa_sig=L4dplO1PyBQvwVw6f6ZvBq7xBFMqVm9oDuV4Cun_3WT7_LEi08QSm0AkQn2d6jPovIbdNTZBmLljpD7_n6hCBA%3D%3D\">broke<\/a>&nbsp;the story of Glick\u2019s biweekly meetings with the White House climate office. Suddenly, it all clicked. Team Biden wanted to advance the climate agenda and punish the fossil fuel industry, and FERC became the vehicle to do both. The weaponization of government struck again.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For those who followed the corruption of FERC, and their extraordinary authority to measure the worthiness of energy projects against the nebulous criteria of \u201cclimate change,\u201d it was not shocking that the Senate Natural Resource Chairman Joe Manchin, a Democrat,&nbsp;<a href=\"https:\/\/rollcall.com\/2022\/11\/14\/ferc-chairmans-term-could-end-as-manchin-balks-at-renomination\/\">blocked<\/a>&nbsp;his re-nomination. The climate fringe of the Democratic Party was stopped by a moderate who had seen enough. Glick\u2019s interjecting politics into FERC had not only surpassed his bureaucratic authority but had usurped Manchin\u2019s congressional and constitutional authority.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is reason to be optimistic about FERC\u2019s future. Recently, President Trump\u2019s nominees&nbsp;<a href=\"https:\/\/www.ferc.gov\/news-events\/news\/senate-confirms-swett-lacerte-ferc\">cleared Senate confirmation<\/a>, and the FERC will now be in the hands of the sane. The ALFA Institute, former Speaker of the House Kevin McCarthy\u2019s think tank,&nbsp;<a href=\"https:\/\/buildalfa.org\/alfa-report-on-ferc-reforms-to-get-more-energy-moving\/\">authored a report<\/a>&nbsp;on FERC reforms which should simplify and streamline the process and prevent politics from intervening once again. Former Chair Glick treated upgrades and basic maintenance as new projects, beginning the review process at square one. ALFA proposes allowing these infrastructure projects to be approved without years of unnecessary red tape. This would not just drastically expand the supply of energy, but also help ensure basic projects are not hamstrung by the next White House influenced FERC chair pushing an agenda.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The new FERC commissioners, Laura V. Swett and David A. LaCerte, should have no agenda \u2014 not the agenda of the climate industry nor even the fossil fuel industry. FERC should do its jobs, as outlined in their statutes, no more, no less.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Anarchy is not a viable option for America to survive. Government can navigate the complicated waters of our pursuit of happiness. As bad as anarchy, however, is weaponization: when \u201cwe the people,\u201d through our elected representatives, chart a course only to have a faceless bureaucrat change it based on personal whims or political pressure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On his first day in office, President Trump&nbsp;<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/declaring-a-national-energy-emergency\/\">rightfully declared<\/a>&nbsp;an energy emergency. Four years of a weaponized FERC, coupled with untold regulations at the Departments of Interior, Energy, and the Environmental Protection Agency, a trillion dollars in Inflation Reduction Act green spending, not to mention Climate Czar John Kerry flying around the world playing Chicken Little, put our energy industry into a deep hole. We are behind the ball on permitting, production, strategic reserves, all reflected in stubbornly high prices of goods and services.
