Environmental Protection Agency (EPA) does not directly center on the legality of the waiver, the court\u2019s ruling on whether the petitioners have standing in&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-7\/325541\/20240909185910874_24-7%20Diamond%20Alternative%20Energy_v_EPA.pdf\">the case<\/a>&nbsp;could set a \u201cmassive\u201d precedent, creating an opportunity for President Donald Trump\u2019s administration to \u201cbalance\u201d the emissions standards set by \u201cextreme climate policy,\u201d energy experts told the Daily Caller News Foundation. The elimination of California\u2019s Clean Air Act waiver could lead to greater freedom for consumers and cheaper vehicle prices in the state, the District of Columbia and in the 17 other states that follow aspects of California\u2019s emissions standards, the policy experts said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe entire future of the auto industry, and what kinds of automobiles people are allowed to buy, what choices they have \u2026 All of that is at stake in this ruling, in this court case,\u201d Myron Ebell, former senior fellow and director for the Center for Energy and Environment at the Competitive Enterprise Institute told the DCNF. \u201cNow we finally are at the point where we can win this debate.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">States are generally held to the EPA\u2019s standard of emissions, though they can choose to follow the&nbsp;more strict California standard instead under the 1970 Clean Air Act. According to&nbsp;<a href=\"https:\/\/nepis.epa.gov\/Exe\/ZyPDF.cgi?Dockey=P100V26M.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">the law<\/a>, only California is allowed to request a waiver from federal vehicle emission standards, permission which was granted to&nbsp;<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/USCODE-2013-title42\/html\/USCODE-2013-title42-chap85-subchapII-partA-sec7543.htm\">address<\/a>&nbsp;\u201cextraordinary conditions\u201d in the state, such as poor air quality.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe Los Angeles Basin has intractable air pollution problems, and it\u2019s not just caused by people,\u201d he said. The Golden State has received several waivers to enforce different emissions standards for vehicles&nbsp;over the years, he noted, as the Los Angeles Basin&nbsp;<a href=\"https:\/\/www.latimes.com\/california\/story\/2021-11-11\/how-an-inversion-over-la-basin-acts-like-a-lid-on-a-pot?utm_source=chatgpt.com\" target=\"_blank\" rel=\"noreferrer noopener\">traps emissions<\/a>&nbsp;due to its topography.&nbsp;<strong><a href=\"https:\/\/dailycaller.com\/2025\/03\/17\/illinois-drivers-unpopular-mileage-road-tax\/\">(RELATED: Blue State Democrats Take Another Crack At Putting Gov\u2019t In Driver Seat Of Americans\u2019 Cars)<\/a><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case now before the Supreme Court examines whether petitioners, like Diamond Alternative Energy which is a subsidiary of Valero Energy Corporation, have the legal standing to challenge the EPA\u2019s 2022 decision to reinstate California\u2019s waiver for stricter vehicle emissions standards under the Clean Air Act. Under former President Joe Biden, the EPA reinstated the 2013 waiver which the first Trump administration partially withdrew in 2019. The EPA on Feb. 14&nbsp;<a href=\"https:\/\/www.epa.gov\/newsreleases\/trump-epa-transmit-california-waivers-congress-accordance-statutory-reporting\" target=\"_blank\" rel=\"noreferrer noopener\">announced<\/a>&nbsp;that it would be \u201ctransmitting to Congress the Biden administration\u2019s rules granting waivers that allowed California to preempt federal car and truck standards,\u201d and Republican lawmakers have since&nbsp;<a href=\"https:\/\/dailycaller.com\/2025\/04\/05\/senate-republicans-california-ev-mandate-despite-procedural-hurdle\/\">sought<\/a>&nbsp;ways to repeal the state\u2019s ability to create the de facto EV mandate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A court decision in favor of Diamond Alternative Energy could upend California\u2019s ability to foist its emissions standards on the nation, and would allow other companies that represent key oil and gas producers to challenge the EPA\u2019s other regulatory actions. The petitioners further argue that the California standard pins an unfair burden on fuel producers, which would lose business as a result of regulators\u2019 push for EVs, and that they should have the standing to challenge it in court. A lower court previously&nbsp;<a href=\"https:\/\/www.cato.org\/blog\/government-uses-standing-doctrine-evade-judicial-review\">ruled<\/a>&nbsp;that the petitioners lack the standing to challenge the EPA\u2019s waiver grant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lawsuit notes that the EPA has granted at least 75 waivers to California under the Clean Air Act since its inception.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIf California gets away with having the waiver, they are in control of our entire automobile transport policy,\u201d Ebell told the DCNF.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">California\u2019s Advanced Clean Cars I program, which had its waiver reinstated in 2022,&nbsp;<a href=\"https:\/\/ww2.arb.ca.gov\/our-work\/programs\/advanced-clean-cars-program\" target=\"_blank\" rel=\"noreferrer noopener\">combines<\/a>&nbsp;several regulations into one package, including zero-emission vehicle regulation and low emission vehicle criteria. The state\u2019s Advanced Clean Cars II program, implemented in 2022&nbsp; on a separate waiver, builds on this,&nbsp;<a href=\"https:\/\/ww2.arb.ca.gov\/resources\/documents\/cars-and-light-trucks-are-going-zero-frequently-asked-questions\" target=\"_blank\" rel=\"noreferrer noopener\">mandating<\/a>&nbsp;that all new cars, trucks and SUVs sold in the state \u2014 and any other state that adopts the California standard \u2014 be zero-emission by 2035.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To date, 17 states and the District of Columbia have&nbsp;<a href=\"https:\/\/ww2.arb.ca.gov\/our-work\/programs\/advanced-clean-cars-program\/advanced-clean-cars-ii\" target=\"_blank\" rel=\"noreferrer noopener\">adopted<\/a>&nbsp;all or part of California\u2019s emissions standards as allowed under a section in the Clean Air Act, according to the California Air Resources Board.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under the emission standards, manufacturers are required to produce a greater amount of EVs and hybrids, or they must purchase \u201ccredits\u201d from another auto manufacturer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cManufacturers are required to produce a number of [zero-emissions vehicles] ZEVs and plug-in hybrids each year, based on the total number of cars sold in California by the manufacturer,\u201d California Air Resources Board&nbsp;<a href=\"https:\/\/ww2.arb.ca.gov\/sites\/default\/files\/2019-06\/zev_regulation_factsheet_082418_0.pdf#:~:text=Manufacturers%20with%20higher%20overall%20sales%20of%20all,credits%20based%20on%20its%20electric%20driving%20range.\" target=\"_blank\" rel=\"noreferrer noopener\">explains<\/a>. \u201cManufacturers with higher overall sales of all vehicles are required to make more ZEVs. Requirements are in terms of percent credits, ranging from 4.5% in 2018 to 22% by 2025.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe founding fathers would be rolling over in their grave if they ever thought the government would be in the business of dictating the type of transportation that Americans can choose,\u201d Tom Pyle, president of the Institute for Energy Research (IER) told the DCNF. \u201cThe public is behind President Trump and the effort to preserve our ability to choose the types of cars that best suit our needs as consumers,\u201d Pyle said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Trump has been an&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/11\/20\/trump-bidens-ev-mandates-obsolete-revamp-auto-industry\/\">outspoken<\/a>&nbsp;critic of the previous administration\u2019s&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/03\/20\/biden-epa-tailpipe-standards-electric-vehicles\/\">push<\/a>&nbsp;to produce more EVs as nationwide interest in the vehicles waned.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI don\u2019t believe that it was fair for the lower courts to argue that the plaintiffs didn\u2019t have standing because their product is going to be severely impacted by the EV mandate because you don\u2019t put gasoline in an EV, right?\u201d Pyle continued.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He added that if the court does not rule in favor of Diamond Alternative Energy, the waiver can eventually \u201cstill be undone through regulatory review, but both the courts and the Trump administration\u2019s review process will take a bit longer.\u201d Pyle noted that the \u201cshortest path\u201d would be through the Congressional Review Act.&nbsp;<strong><a href=\"https:\/\/dailycaller.com\/2025\/04\/05\/senate-republicans-california-ev-mandate-despite-procedural-hurdle\/\" target=\"_blank\" rel=\"noreferrer noopener\">(RELATED: Senate Republicans Move To Nuke California EV Mandate Despite Procedural Hurdle)<\/a><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThere is a ton at stake,\u201d Amy Gunasekara, author and former EPA Chief of Staff under the first Trump administration, told the DCNF. \u201cThis would be the first time that an administration that has been very scrutinous of this waiver authority in the past that would also be calling the shots from the Department of Justice legal strategy perspective.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This ruling will determine who has the authority to file lawsuits against the Clean Air Act waiver, which is \u201cone of the biggest barriers\u201d when it comes to this issue, Gunasekara said. \u201cIt would be huge if the Supreme Court finds that these parties do, in fact, have standing to challenge the California waiver,\u201d she continued.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe merits have never actually been challenged in the courts, and that\u2019s because the parties bringing the suit haven\u2019t gotten a standing test,\u201d Gunasekara said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Vehicles in states that have adopted the more strict emissions standards are \u201cultimately subsidizing California\u2019s decision\u201d Gunasekara added.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ebell also noted that the higher emission standards lead to limited choice for consumers when it comes to selecting a new vehicle, calling it a \u201cnaive belief\u201d that the government can \u201corder automobile manufacturers to design more efficient engines and cars that get better mileage without increasing the price or lowering the performance of the engine.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Manufacturers have the \u201ccloud of California hanging over them,\u201d Gunasekara also said, adding that most regulatory attorneys would recommend auto companies take the \u201cmost risk averse approach,\u201d which is to comply with the California standard. This means that car manufacturers must build pricier cars \u2014 like electric vehicles or hybrids \u2014 or buy special zero emissions credits to make up for not meeting the strict California emissions rules. \u201cThe ultimate loser here is the consumer,\u201d she said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Valero Energy Corporation, the EPA and the City of Los Angeles did not respond to the DCNF\u2019s request for comment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>All content created by the Daily Caller News Foundation, an independent and nonpartisan newswire service, is available without charge to any legitimate news publisher that can provide a large audience.
