href=\"https:\/\/www.nature.com\/articles\/s41586-025-08751-3.epdf?sharing_token=c--h1FnXC70k3v21ncbcVNRgN0jAjWel9jnR3ZoTv0PNVn5qNJQAINIGB8Dl-ZFRseL9v-xVGqFBTn1TeHE_3ueXbo3snVixx3hvsfWgmcaPCnna09SMvt9h8HRBx8EHJnhK9__dORtj8jDr9f7gV6pbSI3Rpd2nqWosrIBEQf8DyemM0Ha3Gy5Yv-312QcQV6C51-p-QfmcdFVw3H9ZdU0Iyf5h-pQ9WHFPbhuNK7k%3D&amp;tracking_referrer=www.cbsnews.com\">\u201cCarbon majors and the scientific case for climate liability.\u201d<\/a>&nbsp;A more fitting title might be \u201cHow to Blame Corporations for the Weather in Five Easy Steps.\u201d With all the analytical rigor of a late-night infomercial and the objectivity of a Greenpeace fundraising letter, the paper seeks to transform centuries of scientific uncertainty into a lucrative legal weapon against energy producers.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Emissions linked to Chevron, the highest-emitting investor-owned company in our data, for example, very likely caused between US\ue01e$791\u2009billion and $3.6\u2009trillion in heat-related losses over the period 1991\u20132020, disproportionately harming the tropical regions least culpable for warming. More broadly, we outline a transparent, reproducible and flexible framework that formalizes how end-to-end attribution could inform litigation by assessing whose emissions are responsible and for which harms. Drawing quantitative linkages between individual emitters and particularized harms is now feasible, making science no longer an obstacle to the justiciability of climate liability claims.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Let\u2019s begin by unraveling the pseudo-scientific spaghetti they attempt to pass off as empirical analysis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The central claim of this paper is as bold as it is bizarre: emissions from a handful of \u201ccarbon majors\u201d can be directly linked to specific temperature and sea-level changes. How do they arrive at this? Through a series of models so layered in assumptions, estimates, and conjectures, they resemble an academic version of&nbsp;<em>Inception<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From the paper:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cWe find that emissions traced to 88 carbon majors contributed 0.50\u2009\u00b1\u20090.04\u2009\u00b0C (50%\u2009\u00b1\u20094%) of the rise in global mean surface temperature between 1851 and 2021.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Translation: \u201cWe ran a model that assumes what we want it to prove, and\u2014surprise!\u2014it proves it.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The authors use what they call an \u201cemissions attribution approach,\u201d which sounds fancy until you realize it\u2019s essentially climate model Mad Libs. They start with historical emissions from companies like ExxonMobil and Chevron, toss them into a simplified climate model (MAGICC6, a delightful irony), and voil\u00e0\u2014they claim these firms raised the global temperature by 0.50 \u00b0C and sea level by 9 cm. That\u2019s 9 centimeters of litigation-ready accusation, extrapolated from a data set with more holes than a slice of Swiss cheese.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Garbage In, Liability Out<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A key ingredient in this scientific stew is the&nbsp;<em>Carbon Majors Database<\/em>, a record of emissions tied to corporations since 1854. It\u2019s unclear how the authors reconcile historical fossil fuel extraction with the vastly different combustion technologies, energy efficiencies, and population demands over 170 years. Spoiler alert: they don\u2019t.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This database assigns blame for emissions as if industrial development was a solo act orchestrated by a few oil barons, rather than a global march driven by human demand, geopolitical necessity, and technological evolution. It\u2019s a historical rewrite so absurd it could qualify as climate fan fiction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From the paper:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cWe argue that our analysis supports the scientific basis for climate change litigation and legal strategies to hold fossil fuel companies accountable for climate harms.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">This is the ideological Rosetta Stone. The research isn\u2019t intended to explore the causes of climate variability. It\u2019s designed to provide ammunition for lawsuits\u2014plain and simple.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The paper\u2019s activist streak isn\u2019t buried\u2014it\u2019s front and center. The authors explicitly aim to support \u201cliability and litigation efforts,\u201d which they somehow claim does not compromise the neutrality of their work. This is akin to a plaintiff writing a judge\u2019s ruling in advance, with the ink still wet on their lawsuit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From the authors:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cOur results provide scientific evidence that can inform legal arguments about causation and corporate responsibility.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">And there you have it: the transformation of climate science into a courtroom consultant. The authors aren\u2019t merely producing scientific knowledge\u2014they\u2019re drafting talking points for tort lawyers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One might expect&nbsp;<em>Nature<\/em>&nbsp;to demand higher standards than turning scientific publishing into an amicus brief for Greenpeace. But alas, in today\u2019s climate orthodoxy, publication standards appear to hinge more on ideological alignment than analytical robustness.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Assigning legal liability to energy producers for climate outcomes is akin to suing a baker for obesity or a lumberjack for deforestation\u2014ignoring the role of demand, policy, and collective human action. It rewrites economics and responsibility with the logic of a show trial.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No mention is made of the role of consumer behavior, nor the benefits these energy sources provided over centuries. There\u2019s also a disturbing absence of counterfactual analysis\u2014what would the world have looked like without fossil fuels? The authors don\u2019t ask because they already know the answer would obliterate their thesis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The \u201cnet social benefit\u201d of hydrocarbons, historically speaking, dwarfs the theoretical damages derived from speculative modeling. But that nuance has no place in a paper designed to weaponize science in service of litigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A Court Case in Search of a Crisis<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is not science\u2014it\u2019s a legal brief dressed up as climate modeling. It seeks to forge causality out of correlation, cherry-pick data to frame corporate villains, and provide activist lawyers with a glossy PDF of \u201cevidence\u201d that would fall apart under any serious cross-examination.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The true tragedy here isn\u2019t the legal threats levied against corporations. It\u2019s the degradation of scientific integrity, sacrificed on the altar of ideological fervor and political convenience.
