class=\"wp-block-paragraph\">The town of Nantucket, Massachusetts looks set to use one of the green left\u2019s go-to legal strategies against a massive offshore wind farm supported by liberal environmentalists.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Environmental groups have used \u201c<a href=\"https:\/\/www.uschamber.com\/regulations\/sue-and-settle-regulating-behind-closed-doors\" target=\"_blank\" rel=\"noreferrer noopener\">sue and settle<\/a>\u201d tactics \u2014 wherein plaintiffs sue an aligned administration to kill a disfavored project, which the aligned administration effectively does via settlement \u2014 for decades to impede infrastructure projects they oppose. Now, Nantucket is&nbsp;<a href=\"https:\/\/www.courtlistener.com\/docket\/69800763\/1\/town-and-county-of-nantucket-massachusetts-v-douglas-burgum\/\" target=\"_blank\" rel=\"noreferrer noopener\">suing<\/a>&nbsp;the Trump administration and alleging that key procedural laws were not followed in Biden-era approvals for the massive SouthCoast wind farm off the island\u2019s coast, teeing up a potential \u201csue and settle\u201d situation that could derail a major project supported by the green left.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nantucket\u2019s lawsuit, filed Thursday in the U.S. District Court for the District of Columbia, names Interior Secretary Doug Burgum, the Department of the Interior (DOI) and the Bureau of Ocean Energy Management (BOEM) as defendants, even though the Trump administration was not in power when the government approved SouthCoast Wind\u2019s paperwork. Contrary to the&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/09\/05\/biden-celebrates-offshore-wind-progress-major-struggles\/\" target=\"_blank\" rel=\"noreferrer noopener\">Biden administration<\/a>, the Trump administration is no friend of the offshore wind industry: President Donald Trump&nbsp;<a href=\"https:\/\/dailycaller.com\/2023\/09\/25\/offshore-wind-turbines-whale-deaths-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">railed<\/a>&nbsp;against offshore wind on the campaign trail, and some of his first acts upon taking office in January&nbsp;<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/temporary-withdrawal-of-all-areas-on-the-outer-continental-shelf-from-offshore-wind-leasing-and-review-of-the-federal-governments-leasing-and-permitting-practices-for-wind-projects\/\" target=\"_blank\" rel=\"noreferrer noopener\">included<\/a>&nbsp;temporarily withdrawing offshore wind lease areas and initiating a review of federal permitting for offshore wind.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIn a perfect world, of course there would be no \u2018sue and settle.\u2019 But we don\u2019t live in a perfect world,\u201d Steve Milloy, a senior policy fellow with the Energy and Environmental Legal Institute, told the Daily Caller News Foundation. \u201cUnfortunately, the left has put us in this war-like situation where extreme, extra-Constitutional means need to be used. What\u2019s good for the goose is good for the gander. I think it\u2019s excellent.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Craig Rucker, president of the Committee for a Constructive Tomorrow (CFACT), told the DCNF that lawsuits like the one in Nantucket will provide the Trump administration easy opportunities t0 implement its anti-offshore wind agenda. CFACT is engaged in its own similar lawsuit against the government to try to stop the massive Dominion Energy offshore wind development off the Virginia coast.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cClearly, it\u2019s a real opportunity for the Trump administration to take advantage of citizen outrage over offshore wind. From our perspective, it would be welcomed if the Trump administration will settle with these people out of court and put an end to that project,\u201d Rucker told the DCNF. \u201cFrom our perspective, the Trump administration settling with these people in Massachusetts would be a good precedent, and we\u2019d like to see the same thing happen in Virginia.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nantucket\u2019s suit alleges specifically that the Biden BOEM \u201cbypassed or shortchanged numerous required steps, shirked its responsibility to the public, and allowed corporate energy developers to dictate the terms of permitting.\u201d Notably, Amanda Lefton \u2014 who ran BOEM for the Biden administration from February 2021 to February 2023 \u2014&nbsp;<a href=\"https:\/\/dailycaller.com\/2025\/01\/30\/revolving-door-biden-admin-offshore-wind-company\/\" target=\"_blank\" rel=\"noreferrer noopener\">went to work<\/a>&nbsp;for a major offshore wind company several months after leaving the federal government.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nantucket became a hotbed of anti-offshore wind activism after a turbine created by a different project in the region, Vineyard Wind,&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/08\/27\/fishermen-protest-offshore-wind-turbine-failure-atlantic\/\" target=\"_blank\" rel=\"noreferrer noopener\">malfunctioned<\/a>&nbsp;and shed debris into the surrounding waters. Some of that pollution later washed up on Nantucket\u2019s beaches, forcing closures and&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/07\/18\/nantucket-locals-slam-offshore-wind-developer\/\" target=\"_blank\" rel=\"noreferrer noopener\">enraging<\/a>&nbsp;many locals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Despite the environmental damage caused by supposedly green technology, many environmental groups&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/08\/14\/nantucket-wind-turbine-debris-environmentalists\/\" target=\"_blank\" rel=\"noreferrer noopener\">subsequently<\/a>&nbsp;defended the industry. More generally, many green groups&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/07\/17\/major-enviro-groups-foreign-oil-offshore-wind\/\" target=\"_blank\" rel=\"noreferrer noopener\">support<\/a>&nbsp;offshore wind as a means to fight climate change, even though many critics are concerned that offshore wind development may be responsible for the surge in&nbsp;<a href=\"https:\/\/www.fisheries.noaa.gov\/national\/marine-life-distress\/2017-2025-north-atlantic-right-whale-unusual-mortality-event\" target=\"_blank\" rel=\"noreferrer noopener\">whale<\/a>&nbsp;<a href=\"https:\/\/www.fisheries.noaa.gov\/national\/marine-life-distress\/2017-2025-minke-whale-unusual-mortality-event-along-atlantic-coast\" target=\"_blank\" rel=\"noreferrer noopener\">deaths<\/a>&nbsp;observed along the East Coast in recent years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">SouthCoast Wind did not respond to a request for comment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>All content created by the Daily Caller News Foundation, an independent and nonpartisan newswire service, is available without charge to any legitimate news publisher that can provide a large audience.
