Republican South Dakota Gov. Larry Rhoden signed a bill Thursday banning the use of eminent domain for carbon dioxide pipelines, ensuring land protections for farmers across the state.<\/p>\n\n\n\n

The\u00a0bill<\/a>, HB 1052, prohibits the government seizure of land for CO2 pipelines. This leaves the fate of Summit Carbon Solutions\u2019\u00a0$9 billion<\/a>, 2,500-mile pipeline project potentially hanging in the air, as South Dakota was a key player in the plan. Summit\u2019s pipeline was to transport captured CO2 from five Midwest states to an underground storage spot in South Dakota, which has been\u00a0referred<\/a>\u00a0to as the world\u2019s largest\u00a0carbon capture<\/a>\u00a0project.\u00a0(RELATED: \u2018No, Thank You\u2019: Red State Regulators Reject Green Pipeline Opposed By Many Rural Landowners)<\/a><\/strong><\/p>\n\n\n\n

\u201cSouth Dakota landowners feel strongly that the threat of involuntary easements for the proposed carbon dioxide pipeline infringes on their freedoms and their property rights,\u201d Rhoden wrote in a letter<\/a> to the legislature and to the people of South Dakota. \u201cI have said many times that Summit needs to earn back trust from South Dakota landowners. Unfortunately, once trust is lost, it is a difficult thing to regain.\u201d<\/p>\n\n\n\n

\u201cHere is my open message to Summit Carbon or anyone else who wants to try to come abuse our fellow South Dakotans,\u201d Republican South Dakota House Speaker Jon Hansen wrote<\/a> on X. \u201cYour green new deal boondoggle; your lawsuits; your threats; and your intimidation against our people, our counties, and our grassroots commissioners ARE NOT WELCOME HERE.\u201d<\/p>\n\n\n\n

Summit spokesperson Sabrina Zenor said<\/a> in a statement that \u201cit\u2019s very unfortunate that, despite our approvals in Iowa, North Dakota, and Minnesota, South Dakota changed the rules in the middle of the game.\u201d<\/p>\n\n\n\n

\u201cThe governor has made it clear that HB 1052 targets one company \u2013 Summit Carbon Solutions,\u201d Zenor continued. \u201cIt\u2019s unfortunate that a piece of legislation has been framed around a single company rather than addressing broader infrastructure and economic policy.\u201d<\/p>\n\n\n\n

\u201cThis is definitely a win for the little guy,\u201d Steve Milloy, a Senior Legal Fellow at the Energy & Environment Legal Institute, told the DCNF.<\/p>\n\n\n\n

\u201cCarbon capture is economically, politically and physically impossible.\u201d He said, referring to carbon capture as \u201ctotally bogus\u201d and that \u201cthe only reason it\u2019s happening is because oil companies can get taxpayer subsidies for it.\u201d (RELATED: Dem Gov Signs Bill Putting Brakes On Green Energy Tech Being Pushed By Biden Admin)<\/a><\/strong><\/p>\n\n\n\n

Milloy pointed to how carbon capture\u2019s expensive price tag, the unpopularity of eminent domain and underground storage issues make it an extraordinarily difficult practice. He also noted that the government can only seize land for public use, and that there is \u201cno legitimate public use\u201d for CO2 pipelines.<\/p>\n\n\n\n

The author also referenced both the Mississippi CO2 pipeline rupture, as well as the Lake Nyos disaster in Cameroon in 1986 that both destroyed land and livestock. The Cameroon pipeline\u00a0explosion<\/a>\u00a0even left 1,700 people dead.<\/p>\n\n\n\n

\u201cSo, good for South Dakota<\/a>,\u201d Milloy stated.<\/p>\n\n\n\n

Summit Carbon Solutions did not respond to the DCNF\u2019s request for comment in time for publication.<\/p>\n\n\n\n
