Hvalbye, a commodities analyst at the company, said \u201cspeculation surrounding a potential surge in U.S. oil production \u2013 up three million barrels per day \u2013 has gained attention\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hvalbye warned in the report that such a ramp-up could drive crude prices below $50 per barrel but added that it \u201cis considered unrealistic\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cU.S. producers understand the strategic risks involved, particularly with OPEC+ holding an estimated five to six million barrels of spare capacity,\u201d the analyst said in the report.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cA significant production increase by the U.S. would likely provoke a strong response from OPEC+, potentially flooding the market to protect market share,\u201d he added.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cSuch a scenario would lead to sharp price declines, ultimately punishing U.S. production rather than fostering growth. But he may not be able to do so on his own.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/perma.cc\/66T9-WF38\" target=\"_blank\" rel=\"noreferrer noopener\">Hannah Wiseman<\/a>, a Penn State law professor and co-director of the university\u2019s&nbsp;<a href=\"https:\/\/perma.cc\/QS4D-N7KX\" target=\"_blank\" rel=\"noreferrer noopener\">Center for Energy Law and Policy<\/a>, told us in an email that the Outer Continental Shelf Lands Act authorizes presidents to, in the words of the act, \u201cfrom time to time, withdraw from disposition any of the unleased lands of the outer Continental Shelf.\u201d But the law \u201csays nothing about whether a later President may revoke this prior withdrawal,\u201d she said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In fact, in 2017, Trump was unsuccessful in trying to reverse bans on new drilling in parts of the Arctic Ocean that were implemented by President Barack Obama. Trump issued an&nbsp;<a href=\"https:\/\/www.federalregister.gov\/documents\/2017\/05\/03\/2017-09087\/implementing-an-america-first-offshore-energy-strategy\" target=\"_blank\" rel=\"noreferrer noopener\">executive order<\/a>&nbsp;to undo Obama\u2019s bans, but in 2019, a federal district judge in Alaska, Sharon Gleason,&nbsp;<a href=\"https:\/\/www.fjc.gov\/history\/judges\/gleason-sharon-louise\">an Obama appointee<\/a>,&nbsp;<a href=\"https:\/\/casetext.com\/case\/league-of-conservation-voters-v-trump-2\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a>&nbsp;that Trump\u2019s order was \u201cunlawful and invalid\u201d because the Outer Continental Shelf Lands Act does not allow a president to repeal a withdrawal made by another president.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe court in 2019 reasoned that \u2018the statute does not expressly grant to the President the authority to revoke prior withdrawals\u2019 and that the phrase \u2018from time to time\u2019 does&nbsp;<em>not<\/em>&nbsp;suggest that presidential withdrawals of land from leasing must be temporary (subject to revocation),\u201d Wiseman said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Trump administration appealed the decision, but a higher court never weighed in before Biden took office in January 2021 and&nbsp;<a href=\"https:\/\/www.federalregister.gov\/documents\/2021\/01\/25\/2021-01765\/protecting-public-health-and-the-environment-and-restoring-science-to-tackle-the-climate-crisis\" target=\"_blank\" rel=\"noreferrer noopener\">revoked<\/a>&nbsp;Trump\u2019s executive order. After Biden\u2019s revocation, the U.S. Court of Appeals for the 9th Circuit&nbsp;<a href=\"https:\/\/casetext.com\/case\/league-of-conservation-voters-v-biden\" target=\"_blank\" rel=\"noreferrer noopener\">dismissed<\/a>&nbsp;the case as moot.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This time, Trump could issue another executive order and hope that it survives a legal challenge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/perma.cc\/XMD8-YP4A\" target=\"_blank\" rel=\"noreferrer noopener\">Andrew Mergen<\/a>, a professor in environmental law at Harvard Law School,&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/climate-environment\/2025\/01\/06\/biden-offshore-oil-drilling-ban-limits-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a>&nbsp;the Washington Post that he believes the 2019 court ruling could have been overturned if the appeal had proceeded.
