S<\/font>o, what does it mean when it&#8217;s repeatedly made clear that you just <em _istranslated=\"1\">can&#8217;t<\/em> make it in New York? That question is one the climate litigation campaign is grappling with today.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In yet another demoralizing defeat for the <a _istranslated=\"1\" href=\"https:\/\/eidclimate.org\/scotus-case-puts-spotlight-on-nationally-coordinated-climate-litigation-campaign\/\">nationally-coordinated climate litigation campaign<\/a> \u2013 and a poignant moment of d\u00e9j\u00e0 vu \u2013 New York City&#8217;s lawsuit against American energy producers yesterday <a _istranslated=\"1\" href=\"https:\/\/www.reuters.com\/sustainability\/climate-energy\/new-york-city-lawsuit-against-exxon-bp-shell-over-climate-change-dismissed-2025-01-15\/\">has been dismissed<\/a> (<a _istranslated=\"1\" href=\"https:\/\/eidclimate.org\/appeals-court-upholds-dismissal-of-nycs-climate-lawsuit-dealing-latest-defeat-to-unsuccessful-campaign\/\">for the second time<\/a>). The Supreme Court of the State of New York&#8217;s <a _istranslated=\"1\" href=\"https:\/\/eidclimate.org\/wp-content\/uploads\/2025\/01\/451071_2021_The_City_of_New_York_v_Exxon_Mobil_Corp_et_al_DECISION___ORDER_ON_232.pdf\">ruling<\/a> firmly rejected the city&#8217;s claims that the companies had misled the public about their products and their sustainability commitments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This defeat marks the third blow to New York \u2013 city and state \u2013 in their attempts to &#8220;take down&#8221; American energy companies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Recall that the national campaign kicked off in the state in 2015 when former New York Attorney General Eric Schneiderman <a _istranslated=\"1\" href=\"https:\/\/eidclimate.org\/new-report-rockefellers-signed-sealed-delivered-failed-nyag-climate-lawsuit\/\">met with Greenpeace and the Rockefeller Family Fund<\/a>, who spoon-fed him a novel climate lawsuit cooked up by academic activists in <a _istranslated=\"1\" href=\"https:\/\/eidclimate.org\/an-orchestrated-campaign\/\">La Jolla, California<\/a> years before. The state&#8217;s case was <a _istranslated=\"1\" href=\"https:\/\/eidclimate.org\/its-official-new-yorks-case-against-exxonmobil-is-over\/\">dismissed<\/a> in 2019 after what was marketed as &#8220;<a _istranslated=\"1\" href=\"https:\/\/grist.org\/beacon\/the-climate-trial-of-the-century\/\">the climate trial of the century<\/a>,&#8221; with the decision labeling the claims &#8220;<a _istranslated=\"1\" href=\"https:\/\/eidclimate.org\/new-yorks-loss-against-exxon-casts-a-shadow-on-related-cases-filed-in-massachusetts-elsewhere\/\">hyperbolic<\/a>&#8220;.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">New York City&nbsp;<a href=\"https:\/\/eidclimate.org\/suv-riding-new-york-mayor-sues-energy-companies-causing-global-warming\/\">filed its own climate case<\/a>&nbsp;against the industry in 2018 \u2013 only for it to be&nbsp;<a href=\"https:\/\/eidclimate.org\/appeals-court-upholds-dismissal-of-nycs-climate-lawsuit-dealing-latest-defeat-to-unsuccessful-campaign\/\">thrown out<\/a>&nbsp;in 2021. Undeterred, the city&nbsp;<a href=\"https:\/\/eidclimate.org\/despite-0-3-record-another-climate-lawsuit-is-filed-in-new-york\/\"><em>refiled<\/em>&nbsp;a new lawsuit<\/a>&nbsp;a month later, giving their means-to-an-ends crusade a facelift by swapping out the claims to focus on alleged consumer protection violations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Today, that case joined the ghosts of failed New York lawsuits past, with the State Supreme Court acknowledging it as an obvious &#8220;re-purposing&#8221; of rejected allegations. Ten years and three lawsuits later, New York has nothing to show for its decade-long effort other than an 0-3 record.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Judge: Plaintiffs Can\u2019t Have It Both Ways As To Whether Everyone Knew<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Anar Rathod Patel, an appointee of Democratic Governor Kathy Hochul, ruled that New York City&#8217;s claims did not sufficiently make the case that the oil companies could have deceived the public about the climate impacts of its oil and gas products.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While the City hoped to hold the companies &#8220;accountable&#8221; for not putting warning labels on gasoline pumps, Judge Patel argued that such disclosures weren&#8217;t necessary because the city itself admitted that New York City consumers are climate-aware consumers:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;<strong _istranslated=\"1\">The City cannot have it both ways<\/strong> by, on one hand, asserting that consumers are aware of and commercially sensitive to the fact that fossil fuels cause climate change, and, on the other hand, that the same consumers are being duped by Defendants&#8217; failure to disclose that their fossil fuel products emit greenhouse gases that contribute to climate change.&#8221; (emphasis added)<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Greenwashing Claims Don\u2019t Pass Muster, Plaintiffs Took Statements Out of Context<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Judge Patel also rejected the plaintiff&#8217;s far-fetched greenwashing claims, stating that the City did not convincingly make the case that companies made false statements in connection with the sale of energy to New York city consumers:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>\u201c<\/strong>Second, the City has not sufficiently pled that Defendants\u2019 alleged greenwashing campaigns, involving statements about clean energy and alternative energy sources, are \u2018made in connection with the sale\u2019 of a consumer good (i.e., fossil fuel products) in NYC, as required under the CPL.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Interestingly, the Judge duly noted that many of the corporate statements that plaintiffs cited were taken out of context, and when she actually went to the companies&#8217; websites to read the claims, they didn&#8217;t appear to be &#8220;deceptive&#8221; in any sense:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;[C]ertain of the alleged statements are distortions of statements that have been taken out of context and <strong _istranslated=\"1\">Plaintiff does not not\u2014and cannot\u2014allege that each statement when viewed &#8216;in light of its context on the product label or advertisement as a whole&#8217; is misleading to the reasonable consumer<\/strong>.&#8221; (emphasis added)<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">So, to summarize: it turns out that the \u201cdeceivers\u201d were never the energy companies to begin with. Rather, New York City attempted to deceive the legal system by taking information out of context in order to name and shame American energy companies. While unfortunate, this activity isn\u2019t surprising considering the City\u2019s law firm, Sher Edling, is currently under&nbsp;<a href=\"https:\/\/eidclimate.org\/as-lawmakers-probe-sher-edling-new-questions-arise-around-the-firms-informal-advisory-committee\/\">Congressional investigation<\/a>&nbsp;for its dark money financing and questionable ties to activist-academics.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong _istranslated=\"1\">Bottom Line: <\/strong>New York has now taken three big swing-and-a-misses. Will they try to step up to the plate again for a fourth attempt at climate litigation?
