For years, there has been a\u00a0<a href=\"https:\/\/insideuni.uni.edu\/business\/corporate-social-responsibility-takes-center-stage-businesses-employees-and-purchasers\" target=\"_blank\" rel=\"noreferrer noopener\">push<\/a>\u00a0for companies to act in a more socially responsible manner, specifically as it relates to\u00a0<a href=\"https:\/\/www.noaa.gov\/office-education\/noaa-education-council\/monitoring-resources\/common-measure-definitions\/stewardship-definitions\" target=\"_blank\" rel=\"noreferrer noopener\">environmental stewardship<\/a>. While environmental stewardship is important, concerns about sustainability must be balanced carefully with consumer interests. The nation\u2019s most populous state increasingly appears to have forgotten this important fact.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">California is&nbsp;<a href=\"https:\/\/oag.ca.gov\/system\/files\/attachments\/press-docs\/Complaint_People%20v.%20Exxon%20Mobil%20et%20al.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">suing<\/a>&nbsp;oil and gas giant ExxonMobil for alleged \u201cdeceptive public messaging surrounding plastics recycling\u201d and its culpability in&nbsp;\u201cthe plastic waste and pollution crisis.\u201d Unfortunately, the lawsuit is extremely misguided and ignores the complicated role plastics continue to play in society. It seeks to pin blame on a single company for a global problem while absolving itself from any responsibility.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While many states have instituted&nbsp;<a href=\"https:\/\/productstewardship.us\/epr-laws-map\/\" target=\"_blank\" rel=\"noreferrer noopener\">laws<\/a>&nbsp;requiring manufacturers to recycle, or otherwise safely dispose of waste products, California\u2019s lawsuit goes a step further. It seeks to hold a company liable for something that, as a large oil and gas producer, it is only indirectly responsible for. That makes it uniquely dangerous and potentially damaging to consumer interests since plastics have&nbsp;<a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC2873019\/\" target=\"_blank\" rel=\"noreferrer noopener\">diverse applications<\/a>&nbsp;and continue to be widely used.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It goes without saying that plastic waste is a serious problem that, in many ways, embodies the economic concept known as the&nbsp;<a href=\"https:\/\/online.hbs.edu\/blog\/post\/tragedy-of-the-commons-impact-on-sustainability-issues\" target=\"_blank\" rel=\"noreferrer noopener\">tragedy of the commons<\/a>&nbsp;where individual actions can collectively lead to negative consequences. Every year, the U.S. produces&nbsp;<a href=\"https:\/\/www.epa.gov\/facts-and-figures-about-materials-waste-and-recycling\/plastics-material-specific-data\" target=\"_blank\" rel=\"noreferrer noopener\">millions of tons<\/a>&nbsp;of plastic, much of which ultimately&nbsp;<a href=\"https:\/\/www.science.org\/doi\/10.1126\/sciadv.abd0288\" target=\"_blank\" rel=\"noreferrer noopener\">ends up<\/a>&nbsp;in landfills, or in the worst cases, is discarded into the environment. California notes that only a small percentage of this plastic is&nbsp;<a href=\"https:\/\/static1.squarespace.com\/static\/5eda91260bbb7e7a4bf528d8\/t\/62b2238152acae761414d698\/1655841666913\/The-Real-Truth-about-the-US-Plastic-Recycling-Rate-2021-Facts-and-Figures-_5-4-22.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">recycled<\/a>, with the Environmental Protection Agency putting the number at about&nbsp;<a href=\"https:\/\/www.epa.gov\/facts-and-figures-about-materials-waste-and-recycling\/plastics-material-specific-data\" target=\"_blank\" rel=\"noreferrer noopener\">9%<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, California has chosen to&nbsp;<a href=\"https:\/\/www.hartenergy.com\/exclusives\/california-sues-exxon-over-global-plastic-pollution-210504?utm_source=daily-wrap&amp;utm_medium=email&amp;utm_content=read-more&amp;mkt_tok=NDMzLU9ESy04ODkAAAGVv3KCFkO6DI9gBQTMtCmDIKiZKoO4hGGmivyAXPIjjLdTkmR8yq5yoilr1foWz0AVNZfXqh1PUbOWmwXcdJA9aTAGdysIIKoZVd5UY9yZg0LF1g\" target=\"_blank\" rel=\"noreferrer noopener\">ding<\/a>&nbsp;Exxon for promoting&nbsp;<a href=\"https:\/\/www.americanchemistry.com\/better-policy-regulation\/plastics\/advanced-recycling\" target=\"_blank\" rel=\"noreferrer noopener\">advanced recycling technology<\/a>&nbsp;and endorsing the widely recognized&nbsp;<a href=\"https:\/\/w1.mtsu.edu\/cee\/3Rs.php\" target=\"_blank\" rel=\"noreferrer noopener\">recycling symbol<\/a>&nbsp;on its products. The state argues these actions have misled consumers into believing that if they properly dispose of products, they will be recycled, even though most current&nbsp;<a href=\"https:\/\/www.wbur.org\/hereandnow\/2023\/09\/05\/unrecyclable-plastic-pollution\" target=\"_blank\" rel=\"noreferrer noopener\">research<\/a>&nbsp;suggests this is not the case. But touting technological advances in recycling\u2014even when modest\u2014and&nbsp;encouraging people to recycle are good things, not bad.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The federal government has&nbsp;<a href=\"https:\/\/www.ncsl.org\/environment-and-natural-resources\/recycling-101-a-history-of-recycling-benefits-and-challenges-and-the-role-of-government\" target=\"_blank\" rel=\"noreferrer noopener\">encouraged<\/a>&nbsp;recycling for decades and&nbsp;<a href=\"https:\/\/www.epa.gov\/newsreleases\/biden-harris-administration-announces-more-49-million-recycling-education-and-outreach\" target=\"_blank\" rel=\"noreferrer noopener\">spends<\/a>&nbsp;millions annually on education campaigns&nbsp;<a href=\"https:\/\/www.epa.gov\/circulareconomy\/america-recycles-day\" target=\"_blank\" rel=\"noreferrer noopener\">such as<\/a>&nbsp;\u201cAmerica Recycles Day.\u201d For its part, California also continues to promote recycling and regularly&nbsp;<a href=\"https:\/\/www.wastedive.com\/news\/california-governor-newsom-sign-waste-recycling-bills-2022\/631600\/\" target=\"_blank\" rel=\"noreferrer noopener\">passes<\/a>&nbsp;new rules and regulations to make the process easier for consumers. Whether these efforts are effective is a separate question, but Exxon is far from alone in embracing recycling as a solution to plastic waste.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That makes California\u2019s lawsuit against Exxon disingenuous. The state seems far more interested in going after the company simply because it is the world\u2019s&nbsp;<a href=\"https:\/\/corporate.exxonmobil.com\/who-we-are\/our-global-organization\/global-operations\" target=\"_blank\" rel=\"noreferrer noopener\">largest<\/a>&nbsp;\u201crefiner and marketer\u201d of petrochemical products than it is concerned about solving the world\u2019s plastic pollution problem. Perhaps that\u2019s why the Golden State is&nbsp;<a href=\"https:\/\/www.bbc.com\/news\/articles\/cp8elg6ezlko\" target=\"_blank\" rel=\"noreferrer noopener\">seeking<\/a>&nbsp;\u201cmultiple billions of dollars\u201d in civil penalties.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lawsuit also seems to neglect the enormous benefits that plastics have brought to ordinary people, including Californians. Despite ongoing challenges with recycling, plastics are&nbsp;<a href=\"https:\/\/www.plasticreimagined.org\/articles\/the-history-of-plastic-the-invention-and-its-future\" target=\"_blank\" rel=\"noreferrer noopener\">attractive<\/a>&nbsp;because they are extremely versatile, cheap to manufacture, and possess many unique properties that make them preferable to alternative materials that are not always as practical to use or even&nbsp;<a href=\"https:\/\/news.umich.edu\/mythbusting-5-common-misperceptions-surrounding-the-environmental-impacts-of-single-use-plastics\/\" target=\"_blank\" rel=\"noreferrer noopener\">better<\/a>&nbsp;for the environment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Indeed, there is a reason that plastics are&nbsp;<a href=\"https:\/\/www.sciencedirect.com\/science\/article\/pii\/S2772397624000042#s0250\" target=\"_blank\" rel=\"noreferrer noopener\">known<\/a>&nbsp;as the \u201cmaterial with 1,000 uses.\u201d Today, over&nbsp;<a href=\"https:\/\/www.energy.gov\/sites\/prod\/files\/2019\/11\/f68\/Products%20Made%20From%20Oil%20and%20Natural%20Gas%20Infographic.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">6,000<\/a>&nbsp;consumer products rely on petrochemicals as a primary compound. They are found in items as mundane as milk cartons and shampoo bottles to lifesaving&nbsp;<a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC7151894\/\" target=\"_blank\" rel=\"noreferrer noopener\">medical devices<\/a>&nbsp;and automobile&nbsp;<a href=\"https:\/\/www.americanchemistry.com\/chemistry-in-america\/news-trends\/press-release\/2024\/report-plastics-and-chemistry-products-improving-vehicle-safety-and-efficiency\" target=\"_blank\" rel=\"noreferrer noopener\">seatbelts<\/a>. One would think that a state that claims to be&nbsp;<a href=\"https:\/\/oag.ca.gov\/news\/press-releases\/attorney-general-bonta-sues-exxonmobil-deceiving-public-recyclability-plastic\" target=\"_blank\" rel=\"noreferrer noopener\">concerned<\/a>&nbsp;that \u201cplastics are everywhere\u201d would at least attempt to understand why that is the case, and what makes the material so popular.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unfortunately, that would require California to carefully weigh the pros and cons of plastics, something it has shown no interest in doing as it attempts to wean off oil and gas. California would do well to remember that solving global problems like plastic waste will require global efforts, efforts that are undermined each time it chooses to single out a company already&nbsp;<a href=\"https:\/\/corporate.exxonmobil.com\/what-we-do\/materials-for-modern-living\/end-plastic-waste\" target=\"_blank\" rel=\"noreferrer noopener\">committed<\/a>&nbsp;to playing its part.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Nate Scherer is a policy analyst with the American Consumer Institute, a nonprofit education and research organization.
