regulators and some truck manufacturers have faced mounting pushback from truck drivers and red states related to its massive push toward statewide electric vehicle (EV) adoption.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After Democratic California Gov.&nbsp;<a href=\"https:\/\/dailycaller.com\/2020\/05\/14\/california-newsom-struggles-huge-budget-hole\/\" target=\"_blank\" rel=\"noreferrer noopener\">Gavin Newsom<\/a>&nbsp;signed an&nbsp;<a href=\"https:\/\/www.gov.ca.gov\/wp-content\/uploads\/2020\/09\/9.23.20-EO-N-79-20-Climate.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">executive order<\/a>&nbsp;in September 2020 to phase out the sale of all new gas-powered vehicles in his state by 2035, the state and several vehicle manufacturers have faced an onslaught of lawsuits related to the new regulations. Now, some truck drivers and red states are attempting to thwart the rules that they allege would slow the supply chain and force the \u201ctransition to more expensive and less efficient electric trucks,\u201d&nbsp;<a href=\"https:\/\/nebtrucking.com\/nta-joins-lawsuit-to-stop-california-electric-truck-mandates\/\">according<\/a>&nbsp;to one trucking group.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Western Propane Gas Association&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/08\/27\/trade-group-california-lawsuit-ban-gas-powered-forklifts\/\" target=\"_blank\" rel=\"noreferrer noopener\">sued<\/a>&nbsp;the California Air Resources Board (CARB) in August over its&nbsp;<a href=\"https:\/\/ww2.arb.ca.gov\/our-work\/programs\/zero-emission-forklifts\" target=\"_blank\" rel=\"noreferrer noopener\">Zero-Emission Forklift<\/a>&nbsp;rule due to the alleged costs it would impose on California forklift owners and operators.&nbsp;Other trade and trucking organizations criticized CARB\u2019s recently&nbsp;<a href=\"https:\/\/ww2.arb.ca.gov\/about#:~:text=CARB%20establishes%20state%20air%20quality,other%20forms%20of%20air%20pollution.\" target=\"_blank\" rel=\"noreferrer noopener\">introduced<\/a>&nbsp;regulations aimed at reducing air pollution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The American Free Enterprise Chamber of Commerce (AmFree), a business lobbying group, also filed a lawsuit against CARB and several truck manufacturers&nbsp;on Dec. 16, alleging that California has created a \u201ccollusive\u201d partnership with heavy-duty truck manufacturers to gradually eliminate internal combustion engines in the state by 2036. The lawsuit critiques some of California\u2019s vehicle regulations as \u201ccoercive,\u201d and alleges that some truck manufacturers have \u201cobtained a cozy cartel arrangement\u201d with CARB, that will ultimately pass the alleged costs of complying with new regulations onto consumers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cCARB\u2019s typhoon of coercive and disruptive regulations had its intended effect: manufacturers bent the knee,\u201d the lawsuit alleges. \u201cIn return for recognizing CARB\u2019s suzerainty, however, manufacturers have obtained a cozy cartel arrangement that ensures them a steady stream of supra-competitive profits, subsidies, and tax credits. By acting in lockstep as an industry, this arrangement ensures that the costs will not be borne by the manufacturers but will be passed downstream to their customers and then to the rest of the country.\u201d\u00a0<strong><a href=\"https:\/\/dailycaller.com\/2024\/12\/18\/energy-experts-wrong-coal-china-india\/\" target=\"_blank\" rel=\"noreferrer noopener\">(RELATED: \u2018King Coal Ain\u2019t Dead Yet\u2019: Energy \u2018Experts\u2019 Proven Wrong Again As Chinese, Indian Coal Use Continues To Skyrocket)<\/a><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">CARB, in July 2023,&nbsp;<a href=\"https:\/\/ww2.arb.ca.gov\/news\/carb-and-truck-and-engine-manufacturers-announce-unprecedented-partnership-meet-clean-air\" target=\"_blank\" rel=\"noreferrer noopener\">announced<\/a>&nbsp;the Clean Truck Partnership \u2014 an agreement with several major truck and engine manufacturers aimed at advancing \u201cthe development of zero-emission vehicles (ZEVs) for the commercial trucking industry, which includes flexibility for manufacturers to meet emissions requirements while still reaching the state\u2019s climate and emission reduction goals.\u201d The agreement stipulates that California will provide the truck and engine makers who entered into this agreement more time to come into compliance with the state\u2019s&nbsp;<a href=\"https:\/\/dailycaller.com\/2023\/07\/06\/trucking-industry-deal-with-california-phase-out-diesel-powered-trucks-carb\/\" target=\"_blank\" rel=\"noreferrer noopener\">emissions requirements<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe Agreement purportedly allows truck manufacturers limited relief from California\u2019s intrusive and unlawful regulations for heavy-duty vehicles,\u201d according to the lawsuit. \u201cIn return, however, the truck manufacturers have sold out their customers and those that depend on them: They have agreed to phase out sales of internal-combustion vehicles in lockstep with California\u2019s dictates, regardless of what the law says or what their customers want.\u201d<\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" width=\"720\" height=\"360\" data-attachment-id=\"359665\" data-permalink=\"https:\/\/climatescience.press\/?attachment_id=359665\" data-orig-file=\"https:\/\/i0.wp.com\/climatescience.press\/wp-content\/uploads\/2024\/12\/image-514.png?fit=720%2C360&amp;ssl=1\" data-orig-size=\"720,360\" data-comments-opened=\"1\" data-image-meta=\"{&quot;aperture&quot;:&quot;0&quot;,&quot;credit&quot;:&quot;&quot;,&quot;camera&quot;:&quot;&quot;,&quot;caption&quot;:&quot;&quot;,&quot;created_timestamp&quot;:&quot;0&quot;,&quot;copyright&quot;:&quot;&quot;,&quot;focal_length&quot;:&quot;0&quot;,&quot;iso&quot;:&quot;0&quot;,&quot;shutter_speed&quot;:&quot;0&quot;,&quot;title&quot;:&quot;&quot;,&quot;orientation&quot;:&quot;0&quot;}\" data-image-title=\"image\" data-image-description=\"\" data-image-caption=\"\" data-large-file=\"https:\/\/i0.wp.com\/climatescience.press\/wp-content\/uploads\/2024\/12\/image-514.png?fit=720%2C360&amp;ssl=1\" src=\"https:\/\/i0.wp.com\/climatescience.press\/wp-content\/uploads\/2024\/12\/image-514.png?resize=720%2C360&#038;ssl=1\" alt=\"\" class=\"wp-image-359665\" style=\"width:760px;height:auto\" srcset=\"https:\/\/i0.wp.com\/climatescience.press\/wp-content\/uploads\/2024\/12\/image-514.png?w=720&amp;ssl=1 720w, https:\/\/i0.wp.com\/climatescience.press\/wp-content\/uploads\/2024\/12\/image-514.png?resize=300%2C150&amp;ssl=1 300w\" sizes=\"auto, (max-width: 720px) 100vw, 720px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Ahead of AmFree taking legal action this month, Republican Nebraska Attorney General Mike Hilgers&nbsp;<a href=\"https:\/\/ago.nebraska.gov\/sites\/default\/files\/doc\/CTP%20Complaint_File-Stamped%5B33%5D.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">filed<\/a>&nbsp;an antitrust lawsuit in November against several heavy-duty truck manufacturers, alleging that California had \u201cembarked on a mission to eliminate the ICE [internal combustion engine] vehicle and mandate the electrification of our nation\u2019s vehicle fleet.\u201d In his suit, Hilgers argues that the automakers will pass compliance costs onto consumers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe U.S. automotive industry is at odds with itself,\u201d according to the lawsuit. \u201cOn the one hand, it seeks to pacify the growing all-electric movement; on the other hand, it seeks to prioritize its own economic health. In a world where so-called \u2018zero-emission vehicles\u2019 (\u2018ZEV\u2019) repeatedly cause automakers to sustain billions of dollars in losses and conventional internal combustion engine (\u2018ICE\u2019) vehicles remain both profitable and in high demand, it seems nearly impossible to achieve both ends. The apparent solution to this problem is to eliminate consumer choice and pass on the costs to consumers.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">CARB\u2019s&nbsp;<a href=\"https:\/\/ww2.arb.ca.gov\/resources\/fact-sheets\/advanced-clean-fleets-regulation-overview\" target=\"_blank\" rel=\"noreferrer noopener\">Advanced Clean Fleets<\/a>&nbsp;(ACF) regulation requires that manufactures sell only zero-emissions, medium and heavy-duty vehicles in California beginning in 2036. \u201cHigh priority\u201d and federally owned fleets may purchase either ZEVs, near-ZEVs or a combination of the two until 2035 when only ZEVs will meet the requirements,&nbsp;<a href=\"https:\/\/ww2.arb.ca.gov\/resources\/fact-sheets\/advanced-clean-fleets-regulation-high-priority-and-federal-fleets-overview\">according<\/a>&nbsp;to CARB. The California board considers entities that \u201cown, operate, or direct the operation of at least one vehicle in California,\u201d and have at least $50 million in annual gross revenue or have a total of 50 or more vehicles under their operation a \u201chigh priority\u201d and subject to the regulations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hilgers previously&nbsp;<a href=\"https:\/\/ago.nebraska.gov\/sites\/default\/files\/doc\/ACF%20Complaint.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">filed<\/a>&nbsp;a lawsuit against California regulators in May,&nbsp;<a href=\"https:\/\/ago.nebraska.gov\/news\/attorney-general-hilgers-leads-multi-state-coalitions-two-lawsuits-stop-electric-truck-mandates\">alleging<\/a>&nbsp;that the ACF rule would \u201cinevitably disrupt the supply chain for all manner of goods\u201d and \u201cimpose costs on taxpayers and governments around the country.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cCalifornia\u2019s regulation, which is called Advanced Clean Fleets, masquerades as a rule for in-state conduct,\u201d the lawsuit alleges. \u201cBut by leveraging California\u2019s large population and access to international ports on the West Coast, Advanced Clean Fleets exports its \u2018in-state\u2019 ban nationwide, creating harms which are certain to reach Plaintiffs\u2019 States.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lawsuit was joined by the Nebraska Trucking Association, the Arizona State Legislature and attorneys general from multiple states, including Alabama, Iowa, Kansas, Montana, Oklahoma, South Carolina, Utah, West Virginia and Wyoming,&nbsp;<a href=\"https:\/\/ago.nebraska.gov\/news\/attorney-general-hilgers-leads-multi-state-coalitions-two-lawsuits-stop-electric-truck-mandates\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a>&nbsp;to a press release.&nbsp;<strong><a href=\"https:\/\/dailycaller.com\/2024\/12\/19\/biden-new-climate-targets-trump-return\/\" target=\"_blank\" rel=\"noreferrer noopener\">(RELATED: Biden Rolls Out New \u2018Ambitious\u2019 Climate Goals Weeks Before Trump Returns To White House)<\/a><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Advanced Clean Fleets \u201crequires certain trucking fleet owners and operators to retire internal-combustion trucks and transition to more expensive and less efficient electric trucks. The rule applies to fleets that are headquartered outside of California if they operate within California,\u201d the Nebraska Trucking Association&nbsp;<a href=\"https:\/\/nebtrucking.com\/nta-joins-lawsuit-to-stop-california-electric-truck-mandates\/\">wrote<\/a>&nbsp;in a press release. \u201cGiven California\u2019s large population and access to ports for international trade, this regulation will have significant nationwide effects on the supply chain.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Environmental Protection Agency issued a waiver on Dec. 18 to&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/12\/18\/biden-admin-paves-way-for-california-to-stuff-the-rest-of-america-into-evs\/\" target=\"_blank\" rel=\"noreferrer noopener\">allow<\/a>&nbsp;CARB to implement its \u201c<a href=\"https:\/\/ww2.arb.ca.gov\/our-work\/programs\/advanced-clean-cars-program\/advanced-clean-cars-ii\" target=\"_blank\" rel=\"noreferrer noopener\">Advanced Clean Cars II<\/a>\u201d regulations, which would gradually eliminate the sale of all new passenger cars, trucks and SUVs sold in California by 2035. California had approximately 1,256,646 light-duty EV registrations in 2023, the most out of any state,&nbsp;<a href=\"https:\/\/afdc.energy.gov\/data\/10962#:~:text=Notes%3A%20California%20had%20approximately%201%2C256%2C646,to%20see%20the%20other%20states.\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a>&nbsp;to the Department of Energy (DOE).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Biden-Harris administration introduced various clean energy policies as part of President Joe Biden\u2019s&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/04\/08\/biden-decarbonized-buildings-appliances-grid-road-map\/\" target=\"_blank\" rel=\"noreferrer noopener\">climate agenda,<\/a>&nbsp;including introducing stringent&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/03\/20\/biden-epa-tailpipe-standards-electric-vehicles\/\" target=\"_blank\" rel=\"noreferrer noopener\">tailpipe emissions standards<\/a>&nbsp;in March. The president also vowed to build 500,000&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/06\/10\/biden-electric-vehicle-chargers-logistics\/\" target=\"_blank\" rel=\"noreferrer noopener\">EV charging stations<\/a>&nbsp;nationwide by 2030, an initiative which has thus far been significantly&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/06\/12\/its-all-a-mess-internal-documents-reveal-how-dei-requirements-are-hamstringing-bidens-ev-agenda\/\" target=\"_blank\" rel=\"noreferrer noopener\">delayed<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Despite the administration leading a massive&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/09\/25\/biden-harris-ev-push-massive-thousands-blue-collar-jobs\/\" target=\"_blank\" rel=\"noreferrer noopener\">push<\/a>&nbsp;for the adoption of EVs nationwide,&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/11\/25\/auto-giants-scrambling-to-slash-costs-as-massive-bet-on-evs-self-driving-fizzles\/\" target=\"_blank\" rel=\"noreferrer noopener\">several<\/a>&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/09\/22\/automakers-reverse-electric-vehicle-targets-despite-billions-biden-harris-subsidies\/\" target=\"_blank\" rel=\"noreferrer noopener\">automakers<\/a>&nbsp;have recently&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/09\/22\/automakers-reverse-electric-vehicle-targets-despite-billions-biden-harris-subsidies\/\" target=\"_blank\" rel=\"noreferrer noopener\">backpedaled<\/a>&nbsp;their EV goals amid&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/04\/03\/electric-vehicle-market-share-plummets-first-quarter-consumers-sour\/\" target=\"_blank\" rel=\"noreferrer noopener\">lackluster<\/a>&nbsp;consumer demand. The&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/09\/22\/automakers-reverse-electric-vehicle-targets-despite-billions-biden-harris-subsidies\/\" target=\"_blank\" rel=\"noreferrer noopener\">steep<\/a>&nbsp;price tag often associated with&nbsp;<a href=\"https:\/\/dailycaller.com\/2023\/08\/08\/people-want-to-drive-gasoline-powered-cars-former-trump-admin-official-rips-bidens-ev-push\/\" target=\"_blank\" rel=\"noreferrer noopener\">EVs<\/a>&nbsp;has been a deterrent for some consumers, with the&nbsp;<a href=\"https:\/\/www.kbb.com\/car-advice\/how-much-electric-car-cost\/\" target=\"_blank\" rel=\"noreferrer noopener\">average<\/a>&nbsp;price of electric cars being $55,105 in November, compared to $48,724 for gas-powered vehicles.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">President-elect Donald Trump criticized Biden\u2019s EV policies and&nbsp;<a href=\"https:\/\/dailycaller.com\/2023\/10\/13\/exclusive-trump-repeal-biden-electric-vehicle-mandate\/\" target=\"_blank\" rel=\"noreferrer noopener\">vowed<\/a>&nbsp;to repeal them while on the campaign trail, referring to the measures as \u201cinsane.\u201d Trump\u2019s transition team is reportedly planning to enact sweeping changes to Biden\u2019s EV policies, including imposing tariffs on battery materials, Reuters&nbsp;<a href=\"https:\/\/www.reuters.com\/business\/autos-transportation\/trump-transition-team-plans-sweeping-rollback-biden-ev-emissions-policies-2024-12-16\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported.<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Many American truckers rely on vehicles with internal combustion engines, with diesel, natural gas and gasoline powering 99.9% of all commercial trucks in the U.S. trucking sector,&nbsp;<a href=\"https:\/\/enginetechforum.org\/trucking\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a>&nbsp;to the Engine Technology Forum. The average annual vehicle miles traveled for semi-trucks in the U.S. is 62,169,&nbsp;<a href=\"https:\/\/afdc.energy.gov\/data\/10309\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a>&nbsp;to the DOE.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Fully electrifying the U.S. commercial truck fleet could cost nearly $1 trillion in infrastructure investment alone,&nbsp;<a href=\"https:\/\/www.cleanfreightcoalition.org\/new-report-pegs-cost-electrifying-us-commercial-truck-fleet-1-trillion\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a>&nbsp;to a report from Roland Berger released in March by the Clean Freight Coalition. Conventional trucks can travel up to 2,000 miles without refueling, compared to up to 500 miles for current electric semi-trucks,&nbsp;<a href=\"https:\/\/www.eesi.org\/papers\/view\/fact-sheet-the-future-of-the-trucking-industry-electric-semi-trucks-2023\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a>&nbsp;to a May 2023 report from the Environmental and Energy Study Institute.
