We\u2019ve frequently cited European laws, policies and viewpoints as guidance for how the United States should change or behave on multiple issues.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Even after the USA eclipsed the Euro continent economically, militarily and (some say) culturally this past century, we have generally continued to do this. In recent years, we\u2019ve even done so on energy policy, in response to claims that Earth\u2019s climate is changing dangerously due to man\u2019s activities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We\u2019ve done it despite witnessing how German, British and European electricity prices have skyrocketed, industries have lost millions of jobs, and people cannot afford to heat their homes properly, because of those climate and energy policies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">President Obama unilaterally followed Europe in signing the Paris climate treaty, obligating America to stop using abundant, reliable, affordable fossil fuels; switch to expensive, unreliable, weather-dependent wind and solar power for electricity generation, transportation, manufacturing and defense;&nbsp;<a>pay \u201cdeveloping countries\u201d tens of billions a year in \u201creparations\u201d for climate change<\/a>; and let UN and foreign politicians and bureaucrats exert control over America\u2019s future.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Trump45 withdrew the USA from the pact. President Biden re-subjugated us. Trump47 plans to pull us out again \u2013 but should also send the treaty to the Senate for prompt attention, debate and likely rejection under our Constitution\u2019s \u201ctreaty clause\u201d (Article II, Section 2), as should have been done years ago.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That would be a major step in meeting his pledge for renewed commonsense regulation, energy dominance and resurgent economic vitality.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Meanwhile, a week after Mr. Trump\u2019s reelection as President,&nbsp;<a href=\"https:\/\/www.reuters.com\/business\/energy\/shell-wins-appeal-against-landmark-dutch-climate-ruling-2024-11-12\/\">a legal ruling<\/a>&nbsp;at The Hague shows European views on energy policy may likewise be moving&nbsp;<a href=\"https:\/\/wattsupwiththat.com\/2024\/12\/09\/international-climate-litigation-a-trojan-horse-for-global-climate-policy\/\">back toward common sense<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On November 12, The Hague\u2019s Appeals Court&nbsp;<a href=\"https:\/\/www.reuters.com\/business\/energy\/shell-wins-appeal-against-landmark-dutch-climate-ruling-2024-11-12\/\">judges overturned<\/a>&nbsp;a May 2021 District Court order requiring that Shell Oil Company accelerate its greenhouse gas (GHG) emissions reduction levels to 45% by 2030, using the company\u2019s 2019 GHG emissions as a benchmark.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The 45% ruling reflected Paris Agreement goals and would have applied to Shell\u2019s direct and indirect operational emissions (drilling, production, refining and pipelines), as well as emissions by its oil and natural gas customers worldwide. If the lower court opinion had stood, Shell would have been compelled to more than double its \u201cnet carbon intensity\u201d reductions beyond its existing pledge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The appellate judges&nbsp;<a href=\"https:\/\/climatecasechart.com\/non-us-case\/milieudefensie-et-al-v-royal-dutch-shell-plc\/\">refused to impose<\/a>&nbsp;any specific reduction targets for Shell, citing the company\u2019s substantial emissions reduction efforts, plus insufficient scientific consensus around GHG reduction percentages needed by individual energy companies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unfortunately, they still held that Shell had a general legal duty to curb the effects of climate change. How that might happen \u2013 amid rapidly growing GHG emissions by China, India, Indonesia, Vietnam and other rapidly developing countries \u2013 the judges did not say.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Other than \u201c<a href=\"https:\/\/www.nbcnews.com\/data-graphics\/2024-election-results-map-trump-made-biggest-gains-rcna180793\">red counties<\/a>\u201d and the new Trump Administration, is America moving toward common sense? The jury is still out, as 30-plus U.S.&nbsp;<a href=\"https:\/\/www.realclearpolitics.com\/articles\/2024\/11\/21\/nonprofits_influence_climate_litigation_against_major_energy_companies_151981.html\">state and local climate lawsuits<\/a>&nbsp;are still pending. However, there is at least one bright spot among all that litigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In July, a circuit court in Maryland dismissed the&nbsp;<a href=\"https:\/\/climatecasechart.com\/case\/mayor-city-council-of-baltimore-v-bp-plc\/\">City of Baltimore\u2019s lawsuit<\/a>&nbsp;alleging violations of Maryland\u2019s nuisance, trespass and deceptive marketing laws by multiple energy companies. Judge Videtta Brown ruled that emissions produced outside Maryland were beyond the authority of state law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She also&nbsp;<a href=\"https:\/\/www.reuters.com\/business\/energy\/energy-companies-win-dismissal-baltimores-climate-change-case-2024-07-11\/\">called the city\u2019s efforts<\/a>&nbsp;to hold energy companies accountable for supposed misinformation an attempt \u201cto get in the back door what they cannot get in the front door.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This was the third climate lawsuit against energy companies dismissed (<a href=\"https:\/\/climatecasechart.com\/case\/city-new-york-v-bp-plc\/#:~:text=On%20May%2024%2C%202021%2C%20the,case%20against%20fossil%20fuel%20companies.&amp;text=Dismissal%20affirmed.,Climate%20Claims%20Against%20Oil%20Companies.\">New York City\u2019s in 2021<\/a>) or narrowed in scope (<a href=\"https:\/\/climatecasechart.com\/case\/state-v-bp-america-inc\/#:~:text=State%20Court%20Allowed%20Delaware's%20Common,Act%20Claims%20Dismissed%20as%20Untimely.\">Delaware\u2019s earlier this year<\/a>), with claims deemed largely preempted by federal law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Judge Brown\u2019s analysis reflects pro-industry arguments presented by&nbsp;<a href=\"https:\/\/www.alabamaag.gov\/attorney-general-marshall-leads-19-state-lawsuit-against-california-others-threatening-energy-system\/\">19 state attorneys general<\/a>, alleging before the Supreme Court that lawsuits spearheaded by Connecticut, California, New Jersey, Minnesota and Rhode Island attempt to regulate energy and commerce across all 50 states.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s noteworthy that states with the greatest focus on climate change and wind, solar and battery power already have the&nbsp;<a href=\"https:\/\/www.electricchoice.com\/electricity-prices-by-state\/\">most expensive residential electricity<\/a>&nbsp;in America\u2019s Lower 48. At 13.9\u00a2 per kilowatt-hour, Maryland is well behind California (19.9\u00a2), Massachusetts (21.1\u00a2)&nbsp;<a href=\"https:\/\/wattsupwiththat.com\/2024\/12\/11\/rate-inflation-in-new-england-perils-of-political-electricity\/\">and Connecticut<\/a>&nbsp;(21.6\u00a2), but pricier than Louisiana (9.4\u00a2), Tennessee (10.8\u00a2) and 32 others.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Despite Maryland\u2019s legal bright spot, however, the other 30-plus cases are charging ahead \u2013 because green activists have rigged court systems in their favor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Activists at the Environmental Law Institute\u2019s&nbsp;<a href=\"https:\/\/www.realclearpolitics.com\/articles\/2024\/11\/21\/nonprofits_influence_climate_litigation_against_major_energy_companies_151981.html\">Climate Judiciary Project<\/a>&nbsp;(CJP) have helped \u201ceducate\u201d more than 3,000 judges on how to understand the \u201cfacts\u201d of climate change as related to legal issues. Even more disturbing, CJP\u2019s materials were&nbsp;<a href=\"https:\/\/www.realclearpolitics.com\/articles\/2024\/11\/21\/nonprofits_influence_climate_litigation_against_major_energy_companies_151981.html\">crafted by activists<\/a>&nbsp;who advise state attorneys general and municipalities in these cases and\/or support their claims through legal briefs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s all part of a coordinated \u201cthink global, sue local\u201d strategy \u2013 except no thought is given to&nbsp;<a href=\"https:\/\/www.scientificamerican.com\/article\/chinas-greenhouse-gas-emissions-exceed-those-of-all-other-developed-countries-combined\/\">global GHG emissions from China<\/a>, India or other developing countries. It also hampers efforts to develop reliable, &nbsp;affordable, accessible coal, oil and gas; and easier for state and local governments to mandate and subsidize expensive, intermittent,&nbsp;<a href=\"https:\/\/townhall.com\/columnists\/pauldriessen\/2024\/06\/30\/mining-the-planet-for-renewable-energy-n2641151\">environmentally destructive<\/a>&nbsp;wind, solar and battery electricity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These cases permeate liberal state politics and affect American consumers nationwide.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Liberal state politicians want \u201cgreen, renewable\u201d electricity but know it\u2019s expensive. To make it seem cheaper, they support tax-funded and deficit-increasing subsidies \u2013 and&nbsp;<a href=\"https:\/\/wattsupwiththat.com\/2016\/03\/29\/al-gore-and-state-attorney-generals-start-another-climate-witch-hunt\/\">states<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.desmog.com\/2024\/02\/20\/bonta-california-climate-lawsuits-merging-chevron-exxon-shell-oil\/\">municipalities<\/a>&nbsp;that drag energy companies into&nbsp;<a href=\"https:\/\/www.realclearpolitics.com\/articles\/2024\/11\/21\/nonprofits_influence_climate_litigation_against_major_energy_companies_151981.html\">$5-trillion<\/a>&nbsp;<a href=\"https:\/\/www.publichealthlawcenter.org\/sites\/default\/files\/resources\/master-settlement-agreement.pdf\">tobacco-style<\/a>&nbsp;legal settlements, to help pay for an ultimately&nbsp;<a href=\"https:\/\/www.cfact.org\/wp-content\/uploads\/2023\/10\/NZRC_Letter_to_Congress.pdf\">$100-trillion pseudo-renewable<\/a>&nbsp;energy infrastructure.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Of course, consumers across America will eventually&nbsp;<a href=\"https:\/\/wattsupwiththat.com\/2018\/04\/24\/how-solar-and-wind-are-causing-electricity-prices-to-skyrocket\/\">foot this bill via rate hikes<\/a>&nbsp;and higher taxes \u2013 along with lost jobs, lower living standards and blackouts \u2013 to support alarmist policies and the \u201cprivilege\u201d of having unreliable \u201cgreen\u201d power for an all-electricity society.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Climate fearmongers think voters and consumers are powerless to stop this, since the process is playing out in state courts, where climate realist views and votes don\u2019t count.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, President-elect Trump has numerous&nbsp;<a href=\"https:\/\/www.eurasiareview.com\/08122024-trump-administration-energy-and-climate-policy-imperatives-oped\/\">energy and climate options<\/a>&nbsp;at his disposal. Perhaps more important, the US Supreme Court has signaled an interest in hearing two climate cases:&nbsp;<a href=\"https:\/\/climatecasechart.com\/case\/city-county-of-honolulu-v-sunoco-lp\/\"><em>City &amp; County of Honolulu v. Sunoco<\/em><\/a>&nbsp;and&nbsp;<a href=\"https:\/\/climatecasechart.com\/case\/alabama-v-california\/\"><em>Alabama v. California<\/em><\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court could rule that energy companies are not legitimate lawsuit targets for the \u201cclimate crime\u201d of producing what America and humanity need to survive and thrive.
