However, these \u201cfeel-good\u201d regulations have a familiar habit of harming consumers by eliminating popular goods and services or making them more expensive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The latest example of such a regulation comes courtesy of California, where lawmakers recently&nbsp;<a href=\"https:\/\/ktla.com\/news\/california\/california-moves-to-ban-all-plastic-grocery-bags\/\" target=\"_blank\" rel=\"noreferrer noopener\">passed<\/a>&nbsp;a second ban on plastic grocery bags after the first attempt ended in failure. The first ban,&nbsp;<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displayText.xhtml?lawCode=PRC&amp;division=30.&amp;title=&amp;part=3.&amp;chapter=5.3.&amp;article=2\" target=\"_blank\" rel=\"noreferrer noopener\">SB 270<\/a>\u2014which took effect in 2014\u2014prohibited grocery stores from distributing single-use plastic bags at checkout. It was&nbsp;<a href=\"https:\/\/calrecycle.ca.gov\/plastics\/carryoutbags\/\" target=\"_blank\" rel=\"noreferrer noopener\">designed<\/a>&nbsp;to reduce plastic waste and encourage consumers to use reusable bags.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, a&nbsp;<a href=\"https:\/\/publicinterestnetwork.org\/wp-content\/uploads\/2024\/04\/Plastic-Bag-Bans-Work-revd.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">study<\/a>&nbsp;published by the California consumer advocacy organization CALPIRG recently found that the ban may have inadvertently led to a&nbsp;<a href=\"https:\/\/www.latimes.com\/environment\/story\/2024-02-12\/californias-war-on-plastic-bag-use-seems-to-have-backfired\" target=\"_blank\" rel=\"noreferrer noopener\">47%<\/a>&nbsp;jump in plastic bag waste between 2014 and 2022 due to consumers\u2019 tendency to throw away thicker reusable plastic bags after a single use. That means that rather than reduce plastic waste, SB 270 created more of it, all the while charging consumers 10 cents per reusable bag. Plastic bag bans in other states have produced similar results, such as in New Jersey where plastic consumption was found to have&nbsp;<a href=\"https:\/\/www.freedoniagroup.com\/press-releases\/freedonia-report-finds-new-jersey-single-use-bag-ban-boosts-alternative-bag-production,-increases-pl#:~:text=NEW%20JERSEY%20(January%209,%202024)%20%E2%80%93%20On%20Tuesday,\" target=\"_blank\" rel=\"noreferrer noopener\">tripled<\/a>&nbsp;after the ban took effect.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While California policymakers now hope to close this apparent loophole by prohibiting grocery stores from selling thicker plastic bags and requiring them to offer only recycled paper bags at checkout, it is not difficult to envision there being additional unintended consequences. Policymakers are trying to control consumers\u2019 subjective behavior and preferences\u2014a&nbsp;<a href=\"https:\/\/www.theamericanconsumer.org\/2022\/03\/study-on-seattle-soda-tax-offers-lessons-on-legislating-behavior\/\" target=\"_blank\" rel=\"noreferrer noopener\">strategy<\/a>&nbsp;that rarely, if ever, works.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Other noteworthy examples of environmental regulatory failures include&nbsp;<a href=\"https:\/\/reason.com\/2018\/12\/21\/at-the-start-of-2018-straws-were-legal-a\/\" target=\"_blank\" rel=\"noreferrer noopener\">plastic straw bans<\/a>. Motivated by clich\u00e9 slogans&nbsp;<a href=\"https:\/\/www.bbc.com\/future\/article\/20240402-the-turtle-video-that-sparked-a-plastic-straw-revolution\" target=\"_blank\" rel=\"noreferrer noopener\">like<\/a>&nbsp;\u201cThe Last Plastic Straw Campaign,\u201d which rely on viral&nbsp;<a href=\"https:\/\/www.youtube.com\/watch?v=4wH878t78bw\" target=\"_blank\" rel=\"noreferrer noopener\">turtle videos<\/a>&nbsp;to drum up public support, policymakers have passed bans on plastic straws in&nbsp;<a href=\"https:\/\/www.nytimes.com\/2018\/03\/03\/climate\/plastic-straw-bans.html\" target=\"_blank\" rel=\"noreferrer noopener\">states and cities<\/a>&nbsp;across the country. Supporters argue such bans reduce plastic waste\u2014some of which makes its way into rivers and landfills\u2014while encouraging consumers to use reusable or paper straws. However, the success of such bans has been questionable at best, as plastic straws make up a&nbsp;<a href=\"https:\/\/sustainability.stanford.edu\/news\/do-plastic-straws-really-make-difference\" target=\"_blank\" rel=\"noreferrer noopener\">negligible amount<\/a>&nbsp;of plastic waste. Moreover, supposed green alternatives like paper straws have been found to pose their own environmental challenges, such as being comprised of greater amounts of water-resistant&nbsp;<a href=\"https:\/\/reason.com\/2023\/08\/25\/presence-of-forever-chemicals-in-paper-straws-highlights-the-inanity-of-plastic-straw-bans\/\" target=\"_blank\" rel=\"noreferrer noopener\">forever chemicals<\/a>&nbsp;that are slow to biodegrade.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bans on gas appliances also seem to be a fan favorite of policymakers who see natural gas and fossil fuel hook-ups as antithetical to a carbon-free future. Cities like&nbsp;<a href=\"https:\/\/archinect.com\/news\/article\/150311747\/la-is-banning-the-gas-burner-in-favor-of-electric-appliances\" target=\"_blank\" rel=\"noreferrer noopener\">Los Angeles<\/a>,&nbsp;<a href=\"https:\/\/www.cascadepbs.org\/environment\/2024\/01\/seattle-electrifying-new-buildings-despite-ruling-against-gas-bans\" target=\"_blank\" rel=\"noreferrer noopener\">Seattle<\/a>, and&nbsp;<a href=\"https:\/\/www.kqed.org\/science\/1992085\/san-francisco-will-continue-enforcing-gas-ban-in-new-buildings-despite-berkeleys-repeal-of-similar-rules\" target=\"_blank\" rel=\"noreferrer noopener\">San Francisco<\/a>&nbsp;have each recently implemented such bans in new buildings, as has the state of&nbsp;<a href=\"https:\/\/www.wsj.com\/articles\/new-york-passes-first-in-nation-ban-on-gas-stoves-in-new-homes-apartments-cf12f642\" target=\"_blank\" rel=\"noreferrer noopener\">New York<\/a>. While policymakers say such bans are needed to help curb greenhouse gas emissions, they require residents to make unnecessary sacrifices, such as using&nbsp;<a href=\"https:\/\/www.nahb.org\/-\/media\/D02B3E48ABB5401D891ACDC185723E1B.ashx\" target=\"_blank\" rel=\"noreferrer noopener\">less popular<\/a>&nbsp;appliances like gas stoves that are&nbsp;<a href=\"https:\/\/robamliving.com\/blogs\/news\/5-reasons-people-love-gas-cooking-stoves#:~:text=Quick%20Temperature%20Changes,on%20the%20table%20quicker%20too.\" target=\"_blank\" rel=\"noreferrer noopener\">slower<\/a>&nbsp;to heat up, provide&nbsp;<a href=\"https:\/\/www.kellyshomecenter.com\/blog\/why-do-consumers-prefer-gas-stoves\" target=\"_blank\" rel=\"noreferrer noopener\">less<\/a>&nbsp;precise temperature control, and often mean&nbsp;<a href=\"https:\/\/bkvenergy.com\/blog\/gas-vs-electric-stoves\/#:~:text=to%20your%20health.-,Which%20is%20the%20most%20cost%2Defficient%20stove?,cooking%20plans%20with%20electric%20appliances.\" target=\"_blank\" rel=\"noreferrer noopener\">higher<\/a>&nbsp;monthly bills.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is also worth noting that eliminating gas appliances has little impact on reducing carbon emissions if the city or state derives its power from oil or natural gas. According to the U.S. Energy Information Administration,&nbsp;<a href=\"https:\/\/www.eia.gov\/tools\/faqs\/faq.php?id=427&amp;t=3\" target=\"_blank\" rel=\"noreferrer noopener\">60%<\/a>&nbsp;of U.S. electricity generation still comes from fossil fuels, and no state relies entirely on renewable energy. Likewise, most large population centers rely on many different forms of energy to meet their needs. Bans on gas appliances, straws, and plastic bags will not change consumer preferences, but they will deprive them of choice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Countless other feel-good attempts at environmental regulation by policymakers intent on fighting climate change exist and many exact a similar toll on consumers, whether they be water-saving&nbsp;<a href=\"https:\/\/appliance-standards.org\/blog\/new-york-save-billions-gallons-water-water-saving-standards\" target=\"_blank\" rel=\"noreferrer noopener\">faucet requirements<\/a>&nbsp;that reduce flow rates,&nbsp;<a href=\"https:\/\/insights.regencysupply.com\/california-light-bulb-ban\" target=\"_blank\" rel=\"noreferrer noopener\">bans<\/a>&nbsp;on incandescent light bulbs, or&nbsp;<a href=\"https:\/\/www.nytimes.com\/2022\/05\/03\/climate\/las-vegas-lawn-grass-ban.html\" target=\"_blank\" rel=\"noreferrer noopener\">restrictions<\/a>&nbsp;on the type of yard a homeowner can have. While not all such regulations are bad or overly burdensome, they do quickly add up and have the overall accumulative effect of limiting people\u2019s freedom to decide what good or service works best for them.
