Excerpts in italics with my bolds and added images,<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em><strong>Analysts say that if the rule is implemented, more than 5 million<br>people could experience blackouts, some lasting for 41 hours.<\/strong><\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em><strong>The Supreme Court&nbsp;<a href=\"https:\/\/justthenews.com\/politics-policy\/energy\/supreme-court-will-allow-epa-power-plant-rule-move-forward-now\">ruled against a bid<\/a>&nbsp;to block the EPA\u2019s power plant rule<\/strong>&nbsp;while legal challenges make their way through the courts, but West Virginia, which is leading the coalition of states challenging the rule, vows&nbsp;<strong>the fight isn\u2019t over.&nbsp;<\/strong><\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em><a href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/24a95_n7ip.pdf\">In a brief order<\/a>, Justices Brett Kavanaugh and Neil Gorsuch said that the&nbsp;<strong>applicants \u201chave shown a strong likelihood of success on the merits<\/strong>&nbsp;as to at least some of the challenges to the\u201d EPA\u2019s rule.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>However, the&nbsp;<strong>justices explained, the stay wasn\u2019t needed<\/strong>&nbsp;because compliance requirements wouldn\u2019t begin&nbsp;<strong>until June 2025,<\/strong>&nbsp;which means the applicants wouldn\u2019t \u201csuffer irreparable harm\u201d before&nbsp;<strong>the Court of Appeals for the D.C. Circuit decides the merits of the case.&nbsp;<\/strong><a href=\"https:\/\/www.law.cornell.edu\/wex\/injunctive_relief#:~:text=The%20party%20seeking%20a%20preliminary,%3B%20and%20(4)%20that%20the\">Injunctive relief<\/a>, such as sought here, requires clear and convincing proof that the harm be immediate and irreparable.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>The lower court is expediting the case, the justices noted, meaning it would be resolved in the court\u2019s current term. While the&nbsp;<strong>EPA<\/strong>&nbsp;has defended the rule and&nbsp;<strong>argues that carbon capture is \u201cwell proven,\u201d its own modeling showed it&nbsp;<a href=\"https:\/\/justthenews.com\/politics-policy\/energy\/epa-power-plant-rules-rely-carbon-capture-agencys-modeling-projects-no-use\">expected only one coal plant<\/a>&nbsp;and no gas plants to be fitted<\/strong>&nbsp;with the technology as far out as 2055.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em><strong>Two dozen states led by West Virginia&nbsp;<a href=\"https:\/\/justthenews.com\/politics-policy\/energy\/two-dozen-republican-states-ask-scotus-weigh-blocking-epa-power-plant-rule\">filed a lawsuit against the EPA in May<\/a>,<\/strong>&nbsp;arguing that the agency exceeded its authority with the rule.&nbsp;<strong><a href=\"https:\/\/www.eenews.net\/articles\/lawsuits-mount-against-biden-power-plant-rule\/\">Utilities and industry groups<\/a>&nbsp;also filed legal challenges<\/strong>&nbsp;to the rule. In July, the U.S. Court of Appeals for the&nbsp;<strong>D.C. Circuit&nbsp;<a href=\"https:\/\/justthenews.com\/politics-policy\/energy\/federal-appeals-court-denies-request-stay-epa-power-plant-rule-while-legal\">denied the parties\u2019 requests<\/a>&nbsp;to block the rules<\/strong>&nbsp;while the courts considered the challenges, and the court ruled the applicants wouldn\u2019t succeed on the merits of their case.<\/em><\/p>\n\n\n\n<figure rule and its carbon capture requirements, arguing that the technology has been \u201c<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24A95\/322789\/20240819142117189_24A95%20EPA%20Response.pdf\">adequately demonstrated<\/a>.\u201d<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em><strong>West Virginia Attorney General Patrick Morrisey said in a<br>statement on the high court\u2019s ruling that the fight isn\u2019t over.<\/strong><\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>\u201cThis is not the end of this case: we will continue&nbsp;<strong>to fight through the merits phase and prove this rule strips
