Pope<\/a><br><\/strong>Contributor<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Utah filed a major lawsuit with the Supreme Court on Tuesday that could have major implications for federalism and the administration of public lands across the country if successful.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Utah\u2019s&nbsp;<a href=\"https:\/\/attorneygeneral.utah.gov\/wp-content\/uploads\/2024\/08\/No.-___-Bill-of-Complaint-and-Brief-in-Support.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit<\/a>&nbsp;contends that the&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/06\/13\/biden-agency-chief-suggests-staff-busy-otify-red-state-major-reversal\/\" target=\"_blank\" rel=\"noreferrer noopener\">Bureau of Land Management<\/a>&nbsp;(BLM) does not have the authority to effectively hold \u201cunappropriated\u201d state lands indefinitely under the Federal Land Policy and Management Act (FLPMA), the state&nbsp;<a href=\"https:\/\/attorneygeneral.utah.gov\/wp-content\/uploads\/2024\/08\/Press-Release_-Utah-files-landmark-lawsuit-FINAL.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">announced<\/a>. The federal government controls about 18.5 million acres of \u201cunappropriated\u201d Utah land under the FLPMA, and Utah\u2019s suit argues that the state ought to control this land because nothing in the Constitution expressly permits the federal government to do so instead.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the context of federal lands, \u201cappropriated\u201d land is that which has been designated for specific purposes like military use or to serve as a national park, for example, according to the state of Utah. But, when the federal government controls two-thirds of Utah, we are extremely limited in what we can do to actively manage and protect our natural resources,\u201d Republican Utah Gov. Spencer Cox said in a statement about his state\u2019s lawsuit. \u201cWe are committed to ensuring that Utahns of all ages and abilities have access to public lands. The BLM has increasingly failed to keep these lands accessible and appears to be pursuing a course of active closure and restriction. It is time for all Utahns to stand for our land.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The state contends in its lawsuit that \u201cUtah is deprived of basic and fundamental sovereign powers as to more than a third of its territory\u201d because federal control prevents the state from taxing those land holdings and using eminent domain to build key infrastructure projects, for example. The status quo with respect to federal control over much of Utah is \u201cegregious federal overreach\u201d that \u201cdisrupts the constitutionally prescribed balance of power between the federal government and the States\u201d and \u201ccannot continue,\u201d the lawsuit states.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In total, the federal government&nbsp;<a href=\"https:\/\/standforourland.utah.gov\/\" target=\"_blank\" rel=\"noreferrer noopener\">controls<\/a>&nbsp;about 70% of Utah\u2019s land, and the \u201cunappropriated\u201d land that is the subject of Utah\u2019s legal challenge makes up about 34% of the state\u2019s territory. The federal government also controls massive swaths of the land in many other Western states, including Nevada, Oregon, Idaho and&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/04\/11\/biden-alaska-oil-crackdown-npra-climate-leases\/\" target=\"_blank\" rel=\"noreferrer noopener\">Alaska<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Myron Ebell, chairman of the American Lands Council, explained the possible effects of Utah\u2019s lawsuit in a statement shared with the Daily Caller News Foundation. The litigation could be hugely impactful beyond Utah\u2019s borders if it is successful, according to Ebell.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cUtah\u2019s suit is one of the most important federal lands cases ever brought to the Supreme Court. It raises fundamental questions of federalism and statehood and has wide ramifications,\u201d Ebell said in his statement. \u201cIf the Supreme Court agrees that FLPMA conflicts with the Constitution\u2019s property clause, then it will apply to all unappropriated federal lands in the West and Alaska.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI think Utah\u2019s legal case is strong, but so is the practical impetus for bringing it. The federal government\u2019s incredible mismanagement of federal lands is harming the environment and economy in many ways in Utah and across the West and Alaska,\u201d Ebell continued. \u201cUtah and other states have proven that they are much better stewards of their lands and wildlife than the federal land agencies.
