On June 26th just a little over a week ago, David \u201cclimate homicide\u201d Arkush and co-authors at his Public Citizen group<\/a> put out a press release titled \u201cNew Memo Details Legal Case for Prosecuting Big Oil for Extreme Heat Deaths<\/a>,\u201d containing a link to a 51 page proposal for prosecutors in the state of Arizona (Democrat ones, of course including the state\u2019s Attorney General<\/a>), noting:<\/p>\n\n\n\n

Though this memo asks a particular question \u2014 how officials in Maricopa County could pursue reckless manslaughter or second degree murder prosecutions for deaths caused by the July 2023 heat wave \u2014 its analysis is relevant in most jurisdictions where prosecutors might seek justice for climate victims.<\/em><\/p>\n<\/blockquote>\n\n\n\n

I already had a tag category<\/a> at GelbspanFiles dating back over a year concerning Arkush\u2019s ludicrous ultra-lawfare fixation. He\u2019s now taken that fixation likely beyond its breaking point. It\u2019s one thing to push the bizarre \u201ccharge fossil fuel companies with climate homicide\u201d idea in \u2018scholarly papers,\u2019<\/a> but it\u2019s quite another to propose the idea straight to state prosecutors. That\u2019s what he\u2019s presenting in the above press release. Forgive the rather morbid visual analogy here \u2013 the man virtually points a loaded revolver at his head and the heads of his co-authors and practically asks law firms defending energy companies in \u201cExxonKnew\u201d lawsuits to pull the triggers for him.<\/p>\n\n\n\n

Before we dive into Arkush\u2019s latest blunder, let\u2019s first review for any new readers of GelbspanFiles what the core faults are with the \u201cfossil fuel industry execs ran disinformation campaigns employing skeptic climate scientists<\/em>\u201d accusation. Then I\u2019ll show where Arkush dutifully regurgitates them, followed by a simple question for everyone to ask.<\/p>\n\n\n\n

\u2022 Accusers say\u201dsmoking gun\u201d leaked memos prove the fossil fuel industry ran a disinformation campaign specifically targeting \u201colder, less-educated men<\/em>\u201d and \u201cyoung, low-income women<\/em>\u201d<\/a> in which skeptic scientists who knew global warming science was settled were paid to knowingly \u201creposition global warming as theory (not fact)<\/em><\/a>.\u201d A sinister effort<\/a>, directly comparable to deception efforts of the tobacco industry.<\/p>\n\n\n\n

No, the unsolicited memo set<\/a>, with its alternative campaign names<\/a>, was rejected<\/strong><\/a> \u2013 never implemented in any form<\/a> \u2013 by the group it was sent to. That group pitched their copy of the set into the trash<\/a>. Doesn\u2019t matter who proposes what, a never-implemented plan cannot serve as evidence<\/a> of people acting under the plan.<\/p>\n\n\n\n

\u2022 Accusers say \u201csmoking gun\u201d advertorials<\/a> with imagery of \u201cChicken Little\u201d and a \u201cDoomsday\u201d planet, along with specific others, e.g. the \u201cFlat Earth\u201d advertorial<\/a>, are proof of the industry\u2019s attempts to \u201creposition global warming.\u201d<\/p>\n\n\n\n

No, the \u201cChicken Little\u201d \/ \u201cDoomsday\u201d \/ \u201cFlat Earth\u201d advertorials were never published anywhere<\/a>. One law firm using the Chicken Little ad crops off the bottom of the ad<\/a>, as does their source<\/a>, for a reason: the bottoms of the \u201cChicken Little\u201d \/ \u201cDoomsday\u201dads have the never-used PR campaign name \u2013 both<\/a> of them<\/a> \u2013 along with a non existent toll-free number, despite what the \u201cChicken\u201d says. Ditto for<\/a> the \u201cFlat Earth\u201d ad.<\/p>\n\n\n\n

The degraded photocopy \u201cChicken Little\u201d \/ \u201cDoomsday\u201d images source from<\/a> what I term \u201cGreenpeace USA n\u00e9e Ozone Action<\/a>.\u201d The old Ozone Action cover letter mentions the \u201cFlat Earth\u201d ad<\/a> but no scan image of it appears anywhere in their 50-page collection (no need to trust me; although Greenpeace took their complete scans collection offline in 2022<\/a>, with zero explanation for doing so, I\u2019d downloaded their 50 page \u201cICE\u201d PDF file when it was still online, and saved it here<\/a>). Greenpeace USA = John Passacantando & Kert Davies<\/a>. Ozone Action = Passacantando & Davies<\/a>. Climate Investigations Center \/ ClimateFiles = Davies<\/a> \u2026 apparently dark money-funded<\/a> by Passacantando\u2019s millions<\/strong><\/a>, after both left Greenpeace.<\/p>\n\n\n\n

Those memos and advertorials are the literal best<\/strong> the accusers have in their arsenal, dubiously sourced. Other allegations simply trail behind as a much weaker second-rate efforts, designed to make it look like there is plenty of additional viable accusation material, not just the one solitary \u201csmoking gun\u201d situation above. In my Backgrounder list of keywords \/ names<\/a>, I detail what to look for anytime somebody prominent hurls the accusation about \u2018industry disinformation campaigns.\u2019 With that in mind, let\u2019s now look at David Arkush\u2019s latest attempt at pushing his \u201cclimate homicide\u201d idea.<\/p>\n\n\n\n

In my blog post about enviro accusers\u2019 enslavement to the worthless \u201cChicken Little\u201d advertorial<\/a>, I noted how it finally dawned on johnny-come-lately David Arkush to include that ad and its hand-in-glove association with the \u201creposition global warming\u201d memos. I could only guess that he\u2019d been given a stern lecture about being previously inattentive to that accusation\u2019s value. Whatever the explanation may be, he now fully embraces it. The big PDF file<\/a> primer for AZ prosecutors features the memos \/ advertorials as a particularly big footnote #116 for what was just a quick reference to the PR campaign they are falsely<\/em><\/strong> attributed to.<\/p>\n\n\n\n

Who\u2019s the source there? The Union of Concerned Scientists. They didn\u2019t dig up any of that<\/a>, I covered their inept foray into this situation<\/a> nine years ago. They couldn\u2019t even get the one-and-only<\/em><\/strong>-name-ever-used<\/a> for the official public relations campaign completely correct. Who\u2019s their<\/em> source? Greenpeace USA<\/a>. Who did they thank<\/a> for their material? Kert Davies, who \u2013 don\u2019t forget \u2013 worked for both Greenpeace USA and Ozone Action<\/a>, the latter being the group where the \u201creposition global warming\u201d memos first got their ongoing media traction<\/a>. Watch the pattern arise out of that, this is the way the accusation crumbles apart, around a core clique of promulgators. \u2713 Naomi Oreskes, via her Richard Lawson memo cited in<\/a> \u2013 of all places \u2013 her hugely problematic chapter contribution piece within someone else\u2019s book, which falsely places the \u201creposition global warming\u201d memos in an archive they\u2019ve never been in<\/a>, while mentioning the above-noted advertorials being in the same archive<\/a> handled by an ex-U.S. Senate staffer<\/a> associated with Al Gore who alerted her to them<\/a>.<\/p>\n\n\n\n

\u2713 Oreskes\u2019 subordinate Geoffrey Supran<\/a> \u2013 as a star witness recently in a May 2024 U.S. Senate hearing<\/a>, he demonstrated his own enslavement<\/a> to both the \u201creposition global warming\u201d memos accusation and<\/em> <\/strong>the \u201cvictory will be achieved\u201d memos accusation. He even doubled down on the latter memo set in his spoken testimony<\/a>. This is the same Senate hearing this primer says it heavily relied on in its Acknowledgements section<\/a>.<\/p>\n\n\n\n

\u2713 Benjamin Franta<\/a> \u2013 right above Supran in the footnotes. The citation paper from Franta is simply irrelevant to Arizona prosecutors and actually aids \u201cExxonKnew\u201d lawsuit defendants on how Exxon didn\u2019t know<\/strong><\/em><\/a>. But give Franta credit in that paper for citing Naomi Oreskes 4 times<\/a> to impugn the credibility of skeptic climate scientists. What can be relevant to opposition to the accusations about \u2018fossil fuel industry disinfo\u2019 campaigns is Franta\u2019s own enslavement to key people associated with the accusation<\/a> \u2014 which, David Arkush inadvertently pointed to by recently citing Franta\u2019s Doctor of Philosophy thesis<\/a>.<\/p>\n\n\n\n

That last one is where the big question needs to be asked concerning what exactly David Arkush \/ Public Citizen are up to here. As detailed at both the Climate Litigation Watch website<\/a> and at the Energy in Depth website<\/a>, those groups describe how CCI is apparently one of the main drivers pushing the prosecution idea opportunity to any gullible state \/ city \/ municipality leader in America who\u2019s willing to consider it. There\u2019s every appearance in the world that the \u201cExxonKnew\u201d traveling circus act, with guest star Geoffrey Supran<\/em><\/a>, is CIC\u2019s exclusive turf.<\/em><\/strong> To top that off, who did CCI hire just one year ago as their \u201cDirector of Special Investigations\u201d? Kert Davies<\/a>.<\/p>\n\n\n\n

The whole Arkush \/ Public Citizen proposal here weirdly looks like an effort to muscle in on what the CIC is already doing. Or are they, actually? They wouldn\u2019t want to cross paths with the person<\/a> who feeds them<\/a>, would they? Congressional investigators \/ attorneys defending energy companies in \u201cExxonKnew\u201d lawsuits \/ objective, unbiased reporters might want to ask what\u2019s going on here.<\/p>\n\n\n\n

I can understand how the San Francisco law firm Sher Edling, handler of 18<\/a> of the current \u201cExxonKnew\u201dlawsuits, is in this climate lawfare realm \u2013 they\u2019ll get an enormous cut of the winnings \u2026 if they do succeed in winning one or forcing settlement payments from any of the lesser defendants who thing they can solve their own problem by crying \u201cuncle.\u201d<\/a> I can understand how Roland C<\/a> \u201cKert\u201d Davies is in this \u2013 he\u2019ll likely get rewarded from a cut of Sher Edling\u2019s winnings. I can understand how Naomi Oreskes is in on this \u2013 she also gets a cut by being on retainer with Sher Edling<\/a>. I can even see how alleged \u201cjournalist\u201d Amy Westervelt gets in on this \u2013 I had to update the bottom of my Puerto Rico v Exxon<\/em> <\/strong>Part 2 dissection<\/a> with a new doc I found where Westervelt apparently seems to be directly supplying Puerto Rico<\/strong><\/em> lead lawyer Melissa Sims with Davies-supplied docs info<\/a>. Thus Westervelt can get her reward portion of the winnings out of that non-<\/em><\/strong>Sher Edling lawsuit by directly working with the law firm.<\/p>\n\n\n\n

The mystery here is how David Arkush and his associates at Public Citizen get in on the winnings, if that was their plan all along.<\/p>\n\n\n\n

They all could lose any remote chance they had of becoming filthy rich out of this show<\/a>, with Arkush taking the slightly plausible concept of entire companies forced to pay for global warming damages into the far more laughable notion of putting a range of industry executives in prison (others<\/em>, too??<\/a>), for murder<\/strong>. The only thing they\u2019ve accomplished here is reinforce how \u2013 among any given prominent accusations about \u2018Big Oil\u2019 disinformation campaigns \u2013 the common thread is worthless \u2018industry documents\u2019 promulgated by a tiny handful of enviro-activists.<\/p>\n\n\n\n

Nobody has ever been killed from fossil fuel industry-induced wild climate escalation, while more<\/em><\/strong> CO2 emissions is actually a huge benefit for billions of people<\/a>.<\/p>\n\n\n\n

Who could conceivably be charged with criminal behavior in this issue? I\u2019d suggest it is the core clique of enviro-activists who\u2019ve taken possible civil action defamation into criminal-level libel\/slander<\/a>.<\/p>\n\n\n\n
