Kavanaugh, and Ketanji Brown Jackson.\r\rCredit: Fred Schilling, Collection of the Supreme Court of the United States<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From <a href=\"https:\/\/www.cfact.org\/2024\/07\/01\/a-supreme-court-victory-over-bureaucratic-overreach\/#\">CFACT<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By <a href=\"https:\/\/www.cfact.org\/author\/crucker\/\">Craig Rucker<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Today, the Supreme Court ruled, on a crucial matter of first impression, that presidents are immune from prosecution for engaging in their official duties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This was a welcomed decision that will put up broad guideposts to keep the three branches of government from encroaching on each other.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court similarly took action last Friday to ensure executive agencies stay within their constitutional lane when it overturned what has become known as the&nbsp;<em>Chevron<\/em>&nbsp;deference. &nbsp;This will have broad implications for issues of climate, energy, the environment, and just about everything else.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">CFACT\u2019s friends and supporters know that federal agencies such as EPA, the Department of Energy, and the Bureau of Land Management routinely far exceed their legislative mandates in pursuit of radical goals that are not supported by law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We posted both the Supreme Court summary and the&nbsp;<a href=\"https:\/\/www.cfact.org\/2024\/06\/28\/loper-bright-enterprises-v-raimondo-read-the-full-supreme-court-decision\/\">entire decision in&nbsp;<em>Loper Bright Enterprises v Raimondo<\/em>&nbsp;to CFACT.org<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Loper Bright<\/em>&nbsp;overturns&nbsp;<em>Chevron v. The Natural Resources&nbsp;<\/em><em>Defense Council, ending&nbsp;<\/em>the doctrine that courts should defer to regulator\u2019s interpretation of the law wherever ambiguities in the law exist.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For decades, this \u201c<em>Chevron&nbsp;<\/em>deference\u201d has left a gaping hole in our constitutional system of checks and balances wide enough to drive a regulatory freight train through.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Loper Bright&nbsp;<\/em>empowers courts to judge for themselves what our laws say, do not say, and what legislators actually meant when they wrote them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court narrowed its decision by holding that ending the Chevron&nbsp;<em>deference<\/em>&nbsp;will apply primarily to future regulatory action rather than providing wholesale relief from past regulatory abuse.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You can also&nbsp;<a href=\"https:\/\/www.cfact.org\/2024\/06\/27\/ohio-v-epa-read-the-full-supreme-court-decision\/\">read the Court\u2019s decision<\/a>&nbsp;granting states at least temporary relief from EPA\u2019s plan to limit emissions such as ozone that drift across state lines.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ohio Attorney General Dave Yost said, \u201cThis is a significant victory for states\u2019 sovereignty and the rule of law. This plan, if implemented, would have imposed undue regulatory burdens on states \u2013 and the EPA doesn\u2019t have the power to do that.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The press quoted me saying, \u201cThe Supreme Court\u2019s 1984&nbsp;<em>Chevron v. NRDC<\/em>&nbsp;decision set the stage for an accelerated expansion of federal regulatory power the likes of which America never experienced before.
