whales was once a leading cause of left-wing environmental groups like Greenpeace. But offshore wind development has created an ironic twist in which conservative groups are now the loudest voices raising concerns about the North Atlantic right whale\u2019s extinction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The&nbsp;<a href=\"https:\/\/heartland.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">Heartland Institute<\/a>,&nbsp;<a href=\"https:\/\/www.cfact.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">Committee for a Constructive Tomorrow<\/a>&nbsp;(CFACT) and the&nbsp;<a href=\"https:\/\/nlpc.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">National Legal and Policy Center<\/a>, want to draw attention to what they say is a connection between an increase in dead whales along the East Coast and industrialization of the U.S. Coast. A new study by an independent acoustician concludes that they may be right.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Off the shores of the East Coast are plans for the development of&nbsp;<a href=\"https:\/\/www.boem.gov\/sites\/default\/files\/documents\/renewable-energy\/state-activities\/BOEM-NY-Bight-OCS-Renew-Energy-Lease-Area.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">massive amounts of offshore wind farms<\/a>. Among them is Dominion Energy\u2019s&nbsp;<a href=\"https:\/\/coastalvawind.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">Coastal Virginia Offshore Wind<\/a>&nbsp;project, which is expected to be the largest offshore wind farm in the world.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Last month, a coalition of conservative groups&nbsp;<a href=\"https:\/\/justthenews.com\/politics-policy\/energy\/media-and-environmental-groups-dismiss-offshore-wind-concerns-whale\" target=\"_blank\" rel=\"noreferrer noopener\">filed a lawsuit<\/a>&nbsp;against federal agencies, their top officials, and Dominion Energy, arguing the permits didn\u2019t properly assess the danger the project presents to whales. The same groups Tuesday&nbsp;<a href=\"https:\/\/justthenews.com\/nation\/states\/center-square\/groups-request-access-whale-protection-plan-offshore-wind-project\" target=\"_blank\" rel=\"noreferrer noopener\">submitted a Freedom of Information Act request<\/a>&nbsp;for Dominion\u2019s species protection plan, which they said isn\u2019t publicly available.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Greenpeace, whose&nbsp;<a href=\"https:\/\/nvdatabase.swarthmore.edu\/content\/greenpeace-campaigns-against-whaling-1975-1982\" target=\"_blank\" rel=\"noreferrer noopener\">first campaign in 1973<\/a>&nbsp;was aimed at stopping whaling, insists that concerns about the impacts to whales from extensive offshore wind developments spreading up the East and soon the West Coast are nothing more than \u201c<a href=\"https:\/\/www.greenpeace.org\/usa\/how-to-stop-whale-deaths-from-real-threats-not-lies-about-wind-energy\/\" target=\"_blank\" rel=\"noreferrer noopener\">right-wing disinformation<\/a>,\u201d and media outlets like the&nbsp;<a href=\"https:\/\/apnews.com\/article\/offshore-wind-whales-deaths-trump-5158af7f5bf0f5ef9e1530564ff791a9\" target=\"_blank\" rel=\"noreferrer noopener\">Associated Press<\/a>&nbsp;and&nbsp;<em><a href=\"https:\/\/www.theguardian.com\/environment\/2023\/nov\/12\/how-a-false-claim-about-wind-turbines-killing-whales-is-spinning-out-of-control-in-coastal-australia\" target=\"_blank\" rel=\"noreferrer noopener\">The Guardian<\/a>&nbsp;<\/em>report these concerns as \u201cunfounded\u201d and \u201cfalse.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Both the&nbsp;<a href=\"https:\/\/apnews.com\/article\/science-business-arts-and-entertainment-journalism-united-states-087d1d5dd7189c529fe5d7a21a1ffb5f\" target=\"_blank\" rel=\"noreferrer noopener\">Associated Press<\/a>&nbsp;and the&nbsp;<em><a href=\"https:\/\/www.theguardian.com\/info\/2018\/oct\/02\/philanthropic-partnerships-at-the-guardian\" target=\"_blank\" rel=\"noreferrer noopener\">Guardian<\/a><\/em>&nbsp;have received funding from anti-fossil fuel groups in support of their reporting on climate and the environment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dominion spokesperson Jeremy Slayton&nbsp;<a href=\"https:\/\/whro.org\/news\/local-news\/45843-federal-lawsuit-seeks-to-halt-dominion-energy-offshore-wind-project-in-virginia-beach\" target=\"_blank\" rel=\"noreferrer noopener\">told public broadcaster WHRO<\/a>&nbsp;that the coalition\u2019s lawsuit has no merits. He said that the Bureau of Ocean Energy Management (BOEM) has done a thorough review of the potential impacts to marine wildlife and the environment from the company\u2019s project.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe overwhelming consensus of federal agencies and scientific organizations is that offshore wind does not adversely impact marine life,\u201d Slayton told WHRO.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dr. David Wojick, policy advisor for CFACT, told&nbsp;<em>Just The News<\/em>&nbsp;he couldn\u2019t believe the company\u2019s statement. \u201cI use the word \u2018absurd,\u2019 but \u2018preposterous\u2019 is probably the right word,\u201d Wojick said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dominion received from the National Oceanic and Atmospheric Administration the&nbsp;<a href=\"https:\/\/www.fisheries.noaa.gov\/s3\/2024-02\/CVOWC-OWF-IssuedLOA-OPR1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">authorization<\/a>&nbsp;to \u201charass\u201d\u2013 in limited terms \u2014 80,000 animals over the next five years. Under federal law, offshore wind developers have to get permits, called&nbsp;<a href=\"https:\/\/www.fisheries.noaa.gov\/national\/laws-and-policies\/glossary-permits-protected-resources#marine-mammal-protection-act-terms\" target=\"_blank\" rel=\"noreferrer noopener\">incidental harassment authorization<\/a>, to conduct activities that might threaten marine animals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are two types of harassment under federal law \u2014 Level A and Level B. Level A has the \u201cpotential to injure a marine mammal or marine mammal stock in the wild\u201d and Level B has the same potential but could cause injury. Activities that cause these impacts are illegal, without the authorizations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIf you chase a whale or a dolphin with your boat, they\u2019ll take your boat,\u201d Wojick said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>New research<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Robert Rand, founder of the acoustics consultancy company&nbsp;<a href=\"https:\/\/randacoustics.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">Rand Acoustics<\/a>, is trying to draw attention to what his research is showing \u2014 there is a lack of adequate protections for the whales that migrate along this corridor where all these projects are going up.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He told&nbsp;<em>Just The News<\/em>&nbsp;he gets little in the way of response from federal agencies that are overseeing the permitting for these projects.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Last year, after increases in the&nbsp;<a href=\"https:\/\/justthenews.com\/politics-policy\/energy\/conservationists-claim-recent-increase-whale-deaths-driven-offshore-wind\" target=\"_blank\" rel=\"noreferrer noopener\">number of whale deaths<\/a>&nbsp;threatened to drive the North Atlantic right whale into extinction, Rand produced an&nbsp;<a href=\"https:\/\/img1.wsimg.com\/blobby\/go\/935d0456-a4c5-443b-9fca-ffa943ac08d3\/downloads\/RandAcoustics-SonarVesselNoiseSurvey.pdf?ver=1711722520207\" target=\"_blank\" rel=\"noreferrer noopener\">independent investigation<\/a>&nbsp;of underwater noise levels from sonar survey vessels, which map the ocean floor for the planning of the projects.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rand\u2019s study found that the incidental harassment authorizations don\u2019t impose sufficient mitigation requirements to protect marine animals. He sent the findings off to the National Oceanic and Atmospheric Administration and the Bureau of Ocean Energy Management (BOEM). He said he never received any response.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">His&nbsp;<a href=\"https:\/\/img1.wsimg.com\/blobby\/go\/935d0456-a4c5-443b-9fca-ffa943ac08d3\/downloads\/RandAcoustics_PileDrivingNoiseSurvey.pdf?ver=1711722520192\" target=\"_blank\" rel=\"noreferrer noopener\">latest study surveyed the noise<\/a>&nbsp;from&nbsp;<a href=\"https:\/\/www.youtube.com\/watch?v=e3JgXAnwlik\" target=\"_blank\" rel=\"noreferrer noopener\">pile driving<\/a>, which is when developers drive a giant steel monopile into the seabed by pounding on it. He took sound measurements as the 5000-pound, 700-foot long&nbsp;<a href=\"https:\/\/www.deme-group.com\/technologies\/orion\" target=\"_blank\" rel=\"noreferrer noopener\">pile-driving vessel Orion<\/a>&nbsp;was driving monopiles into seabed off the coasts of Nantucket Island for the&nbsp;<a href=\"https:\/\/www.vineyardwind.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">Vineyard Wind<\/a>&nbsp;project.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rand\u2019s conclusions suggest federal agencies are underestimating the impact to whales from offshore wind development. \u201cThis investigation discovered a substantial underestimation of both impulsive and continuous noise levels by current regulatory standards, suggesting that the actual exposure to harmful noise levels from pile driving for marine mammals like the critically endangered North Atlantic right whale is substantially greater than NMFS [National Marine Fisheries Service] acknowledges in its existing protective measures,\u201d Rand wrote in his report.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Wojick, who wasn\u2019t involved in Rand\u2019s research, said that the implication here is that the 80,000 estimation of \u201charassed\u201d marine animals that Dominion is permitted for is likely a way too low.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Vessel collision<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A humpback whale washed up dead Thursday on the shores of New Jersey\u2019s Long Island Beach,&nbsp;<a href=\"https:\/\/www.foxnews.com\/us\/first-dead-whale-season-washes-jersey-shore\" target=\"_blank\" rel=\"noreferrer noopener\">Fox News reported<\/a>. It was the first of 2024 in New Jersey, following 14 whale deaths in the state in 2023.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/twitter.com\/saveLBIorg\/status\/1778412945296285929\" target=\"_blank\" rel=\"noreferrer noopener\">In a post on X<\/a>, SaveLBI, a nonprofit coalition raising concerns about what they say are negative impacts of offshore wind development, reported a Dwarf Sperm found dead on April 4 on the beach of Sullivan\u2019s Island in South Carolina. They estimate the tally of dead whales since December 2022 is approaching 100.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bob Stern, president of SaveLBI, in a&nbsp;<a href=\"https:\/\/twitter.com\/saveLBIorg\/status\/1778486784906674685\" target=\"_blank\" rel=\"noreferrer noopener\">separate post on X<\/a>, called for a moratorium on offshore wind development in order for more research into the impacts of the industry to be conducted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThese continuing whale deaths unfortunately confirm our analysis of the significant expected impact on marine mammals from the noise from these projects, starting with the vessel surveys, through the pile driving of foundations and with the higher operational noise from these larger turbines,\u201d Stern said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Wojick said offshore wind proponents exploit the indirect way in which offshore wind development kills whales to say the two are unrelated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In its environmental impact statement for a wind project off the shores of New Jersey,&nbsp;<a href=\"https:\/\/www.boem.gov\/sites\/default\/files\/documents\/renewable-energy\/state-activities\/Empire_Wind_DEIS_Vol1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">BOEM explained<\/a>, \u201cIt is possible that pile driving could displace animals into areas with lower habitat quality or higher risk of vessel collision or fisheries interaction. Multiple construction activities within the same calendar year could potentially affect migration, foraging, calving, and individual fitness\u2026. The potential for biologically significant effects is expected to increase with the number of pile-driving events to which an individual is exposed.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Wojick said that the projects are built, for obvious reasons, outside shipping lanes, which also happen to be the whales\u2019 migration corridors. So, the whales impacted by pile-driving and other construction noise are going to swim to the east, where they encounter a busy&nbsp;<a href=\"https:\/\/transportationops.org\/publications\/m-95-marine-highway-corridor\" target=\"_blank\" rel=\"noreferrer noopener\">shipping lane called the M-95<\/a>, or they go to the west, where they encounter coastal barge traffic. He said both are deadly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Demonstrating that a whale died when it was struck by a vessel as a result of avoiding sonar vessels or pile-driving activity is very difficult, Wojick said. As an analogy, he uses the example of a dog getting hit by a car after running into traffic to escape a firecracker thrown at it. The car killed the dog, but it was the firecracker that ultimately led to the animal\u2019s death, and nothing about the animal\u2019s injuries would point to the firecracker.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to&nbsp;<a href=\"https:\/\/www.fisheries.noaa.gov\/search?oq=whales\" target=\"_blank\" rel=\"noreferrer noopener\">data from NOAA Fisheries<\/a>&nbsp;in 2015, 33 whales were found dead on the beaches between North Carolina and Maine. The following year, the number jumped to 54, and in 2017, 89 whales were found dead. The numbers then began to decline, falling to a record low of 24 in 2022. Then, in the first six months of 2023, 48 whales were found dead along the Atlantic Coast.
