class=\"wp-block-paragraph\">A number of current and former government officials, ex-military personnel and legal scholars are pushing for the Supreme Court to pick up a key climate change liability lawsuit in Hawaii and take it out of the state\u2019s jurisdiction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An organization led by former U.S. Attorney General Bill Barr, former high-ranking military officials, a number of state attorneys general and two prominent legal experts have each filed amicus briefs with the Supreme Court this week, urging it to take on Honolulu\u2019s lawsuit against oil corporations, which alleges that the companies deliberately misled the public about their role in global warming. In their amicus briefs, the petitioners effectively point out that the case should be in the Supreme Court\u2019s domain given the implications it could have for the U.S. economy, national security and federalism more broadly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The defendants in the case \u2014 which include Chevron, Exxon Mobil and Shell&nbsp; \u2014 have&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/02\/29\/energy-companies-scotus-hawaii-climate-lawsuit\/\" target=\"_blank\" rel=\"noreferrer noopener\">asked<\/a>&nbsp;the Supreme Court to hear their case; the nuisance lawsuit will proceed to trial in a lower court pending any substantial developments,&nbsp;<a href=\"https:\/\/www.reuters.com\/sustainability\/cop\/honolulu-climate-case-against-oil-cos-can-go-trial-hawaii-top-court-2023-11-01\/#:~:text=Nov%201%20(Reuters)%20%2D%20Hawaii's,to%20go%20ahead%20to%20trial.\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a>&nbsp;to Reuters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In November 2023, the Hawaii Supreme Court rejected the corporations\u2019 argument that the legal challenge effectively intends to regulate emissions and interstate commerce, subjects which are the domain of the federal government, according to Reuters.<strong>&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Notably, the state supreme court\u2019s chief justice has previously worked with the Environmental Law Institute (ELI), a Washington, D.C.-based environmental organization that has close ties to Sher Edling, the law firm representing the plaintiffs, a May 2023 Daily Caller News Foundation\u00a0<a href=\"https:\/\/dailycaller.com\/2023\/05\/17\/climate-lawsuit-lawyers-environmental-group\/\" target=\"_blank\" rel=\"noreferrer noopener\">investigation<\/a>\u00a0found. The Hawaii Supreme Court also tried to argue in February that the so-called \u201c<a href=\"https:\/\/dailycaller.com\/2024\/02\/08\/hawaii-supreme-court-claims-spirit-of-aloha-overrules-second-amendment\/\" target=\"_blank\" rel=\"noreferrer noopener\">spirit of Aloha<\/a>\u201d overrides the second amendment.\u00a0<strong><a href=\"https:\/\/dailycaller.com\/2023\/11\/04\/hawaii-supreme-court-justice-handling-lawsuit-against-oil-companies-calls-climate-change-an-existential-threat\/\" target=\"_blank\" rel=\"noreferrer noopener\">(RELATED: Hawaii Supreme Court Justice Handling Lawsuit Against Oil Companies Calls Climate Change An \u2018Existential Threat\u2019)<\/a><\/strong><\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">Rhode Island Official Admits State\u2019s Climate Lawsuit Is Meant To Wring Money Out Of Big Oil: Court Docs <a href=\"https:\/\/t.co\/ZuG4u3GMi4\">https:\/\/t.co\/ZuG4u3GMi4<\/a><\/p>&mdash; Daily Caller (@DailyCaller) <a href=\"https:\/\/twitter.com\/DailyCaller\/status\/1238638529833512967?ref_src=twsrc%5Etfw\">March 14, 2020<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe Environmental Law Institute is an internationally recognized, non-partisan research, publishing, and education organization that has been operating for over 50 years,\u201d a spokesperson for ELI told the DCNF. \u201cELI does not have close ties to Sher Edling.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, ELI co-<a href=\"https:\/\/www.aaas.org\/programs\/scientific-responsibility-human-rights-law\/judicial-seminars-climate-science\">founded<\/a>\u00a0the Climate Judiciary Project, which crafted a climate and law\u00a0<a href=\"https:\/\/www.eli.org\/climate-judiciary-project\">curriculum<\/a>\u00a0for judges handling environmental\u00a0<a href=\"https:\/\/www.eli.org\/sites\/default\/files\/files-pdf\/Overview%20of%20Climate%20Litigation_FINAL%20WORD_formatted.pdf\">litigation<\/a>\u00a0like the Hawaii case, and the organization has worked closely with people who have consulted for or been employed by Sher Edling, the DCNF reported in the May 2023 investigation. The two entities also have received funding from several of the same left-of-center nonprofit organizations, Republican Texas Sen. Ted Cruz wrote in a February\u00a0<a href=\"https:\/\/www.commerce.senate.gov\/services\/files\/F2BB1C79-7627-4CF5-A146-6814341CEB2B\" target=\"_blank\" rel=\"noreferrer noopener\">letter<\/a>\u00a0to Jordan Diamond, the president of ELI.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Climate Judiciary Project\u2019s \u201cfunding and ties to plaintiffs in climate change cases further belie ELI\u2019s claim of neutrality,\u201d Cruz wrote in the letter. \u201cELI and climate litigation juggernaut, Sher Edling, share staff,\u201d Cruz also pointed out.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Hawaii suit \u2014 one of several similar cases working their way through lower courts in which Sher Edling is intimately involved \u2014 could present the Supreme Court with a clear opportunity to address the issue of whether oil companies can be held liable for their alleged deception if it decides to take up the case. An&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23-947\/306428\/20240401153258127_2024.04.01%20--%20Amici%20States%20Brief%20in%20Honolulu.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">amicus brief<\/a>&nbsp;filed by the state of Alabama and 19 other states outlines this potential explicitly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe time for this Court\u2019s intervention is now. The question presented has percolated for years, albeit in a removal posture that complicated review. Such complexity is absent here, and there is now a clear split between courts that will entertain state lawsuits over interstate emissions and courts that will not,\u201d the states\u2019 filing reads. \u201cThe grave threat these suits pose to equal sovereignty and our Nation\u2019s energy infrastructure are reason enough for this Court to grant review.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The filing also asserts that the plaintiff\u2019s \u201ctheory used against energy companies can be expanded to allow targeting of any cross-border activity that purportedly \u2018exacerbate[s] the impacts of climate change.&#8217;\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Two former chairmen of the Joint Chiefs of Staff, retired Air Force Gen. Richard Myers and retired Navy Adm.&nbsp;Michael Mullen, filed their own&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23-947\/306364\/20240401120634945_23-947%20and%2023-952%20Amicus%20Brief.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">amicus brief<\/a>&nbsp;echoing the states\u2019 concerns about the potential for negative national security ramifications if the Supreme Court does not hear the case. Hawaii, Chicago, Massachusetts and numerous other jurisdictions pursuing nearly-identical lawsuits against the energy industry could impose an onerous and inconsistent legal environment for the companies in lower courts, undermining production and leaving the U.S. more vulnerable in the event of conflict, the former officials asserted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThere is potential that the upshot of this litigation and the broad relief it seeks would negatively impact strong national interests in fuel security and military readiness,\u201d the two former military officials wrote in their filing. \u201cFuel security is a crucial national interest and is especially critical to the U.S. military, in times of both war and peace, to power ships, tanks, and aircraft, provide energy to run bases, stations, and detachments, and enable numerous operations.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">John Yoo, a professor of law at the University of California, Berkeley, and Richard Epstein, a legal scholar at New York University, similarly highlighted potential national security ramifications, as well as concerns about the balance of the federalist system, in an&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23-947\/306405\/20240401141106074_23-947%20-952%20Amici%20Brief%20Final.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">amicus brief<\/a>&nbsp;they filed in&nbsp;support of the corporations\u2019 request for the Supreme Court to hear the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe Hawaii Supreme Court\u2019s misapplication of tort law is not a matter of state law, but instead represents the erroneous incorporation of a state tort standard into the federal common law of interstate pollution. Given the national importance of the energy industry, no further delay is prudent,\u201d the scholars wrote in their brief. \u201cControlling energy has long constituted an important national security goal that not only supports economic independence and stability but also U.S. diplomacy and military capabilities. If this Court were to allow these tort cases to proceed, states and localities could handicap an interstate industry critical to the nation\u2019s economy and security.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The American Free Enterprise Chamber of Commerce, led by Barr, also threw its support behind the oil companies\u2019 petition to the Supreme Court and emphasized the possible national security ramifications. Barr also took aim at the lawsuit\u2019s central allegation that the fossil fuel companies engaged in a deliberately deceptive marketing campaign to obscure the damage their products purportedly cause, surmising that the Supreme Court should intervene to close off that avenue of legal attack against the American energy industry.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cHumans don\u2019t use fossil fuels because of a \u2018public relations campaign.\u2019 They use fossil fuels because they are necessary to the technologies that underlay global human prosperity\u2014from synthetic fertilizer, to cement, to plastics, to internal-combustion engines, to steel,\u201d Barr and his colleagues wrote in their&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23-947\/306396\/20240401135224892_AmFree%20Amicus%20Brief.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">filing<\/a>. \u201cGiven all this, how is a jury supposed to isolate the effect of a \u2018public relations campaign\u2019 on the additional use of fossil fuels, the effect of those additional fossil fuels on the climate, and the consequent effect of that in Honolulu or some other place?\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe stakes could hardly be higher,\u201d they added. \u201cIf Hawaii and like-minded states succeed in imposing an unwieldy patchwork of carbon penalties on private energy firms, the United States could soon become dependent on energy companies owned by foreign states to meet its energy needs, since foreign states alone can claim sovereign immunity.
