Nice of the 2\/20\/24 Chicago Sun-Times<\/em> \u201cChicago sues five giant oil companies<\/a>\u201d article to inadvertently point directly to what the potentially lawsuit-killing combined problem is with this latest \u201cExxonKnew\u201d lawfare effort: the apparent need to bring in the California law firm Sher Edling for assistance<\/a>, and the collective idea that fossil fuel companies knew of the harm of \u201cclimate change\u201d fifty years ago<\/a> but hid that from the public. Same story at the Chicago Tribune<\/em><\/a>. The same Tribune<\/em> which reported fifty years ago (2024-50=1974<\/strong>) that the changes in the climate caused by the burning of fossil fuels was global cooling.<\/em><\/strong><\/a><\/p>\n\n\n\n

A climate changing to a cooler one in 1974. A climate changing to a hotter one in 2024. You can\u2019t have it both ways. So much for elemental fact-checking \/ investigative journalism in 2024. And of course, neither newspaper could be bothered to check the veracity of accusations presented in this \u2013 yes it is \u2013 latest boilerplate copy<\/strong> filing<\/a> straight out of Sher Edling\u2019s San Francisco offices. How do I know it\u2019s another boilerplate copy where Chicago\u2019s own city lawyers very likely had little or no input to offer? Let\u2019s dive into Chicago v BP PLC et al.<\/em><\/a>: (my own PDF download file here<\/a>, if that link ceases to function)<\/p>\n\n\n\n

First, however, I was thinking Sher Edling would not be able to come up with any new way to hand its head on a silver platter to the defendant companies in any new lawsuit they wished to add to their boilerplate copy pile. I was wrong. They did \u2014 hold that thought until my checklist item about their citation source switch<\/em> for their accusation against astrophysicist Dr Willie Soon.<\/p>\n\n\n\n

\u2713 Chicago v BP<\/em> claims Exxon et al. \u201cknew\u201d (hence, the \u201cExxonKnew\u201d lawsuits label) as far back as the 1970s<\/a> that they were harming the planet. Same basic accusation back in the 2017 start for Sher Edling with their San Mateo County v Chevron<\/em> filing<\/a>. In two places, identical words<\/em><\/strong> shared<\/a> between this latest one and their first filing. Want to see an even closer matchup? Try Sher Edling\u2019s Dec 2023 twin<\/a> Indian Tribes lawsuits. That pair just left out the bit<\/a> in Chicago<\/em> about \u201cin the minds of<\/em> \u2026\u201d and instead had three other extra words. Want to see where all of those words were previously included<\/em>? Try Sher Edling\u2019s Honolulu v Sunoco<\/em><\/a>. No need for your own municipality\u2019s lawyers to get in the way, just bring in the San Fran law firm.<\/p>\n\n\n\n

But just like I pointed out up above using one of the old newspaper clippings from Tony Heller\u2019s RealClimateScience blog, I\u2019ll point out again using one of his most recent finds<\/a>, one way to stop the climate from changing to a cold one was \u2013 no joke \u2013 to dam the Bering Strait to keep the cold water way up north<\/a>. 1974 geo-engineering. These days, the proposal is to pump particles into the air to induce cooling and stop runaway warming<\/a>. What was the suggestion to stop runaway global cooling fifty years ago, though? Stop pumping particles into the air<\/a>. Fail to do so \u2013 drought \/ extreme weather<\/a> results, leading to famine \/ wars \/ climate refugees<\/a>.<\/p>\n\n\n\n

Exxon knew use of their products caused climate change as far back as the \u201970s? Right. Climate change \u2026 to what??<\/em><\/strong> And who is it that\u2019s actually deceiving the public in this situation today?<\/p>\n<\/blockquote>\n\n\n\n

What also proves Chicago<\/em> here is just the latest boilerplate copy traveling circus act?<\/p>\n\n\n\n

\u2713 Ye olde<\/em><\/a> reposition global warming memos \u2013 shown on multiple occasions here at GelbspanFiles as the the memo set which was sent unsolicited<\/a> to a public relations campaign that rejected the whole set outright<\/a>, including its illogical narrow audiences targeting suggestions<\/a>. The accusation surrounding the phrase has been a Sher Edling trademark from day 1<\/a>. Similar to when I did my first cursory word searches into Sher Edling\u2019s Indian Tribes lawsuits where the word \u201creposition\u201d didn\u2019t come up, I didn\u2019t find it right away in this Chicago<\/em> filing either. They didn\u2019t turn it into a non word-searchable illustration snippet like they did in their prior twin lawsuits<\/a> \u2013 they instead put the \u201cr\u201d between brackets<\/a>. They did that once before (I noted in my Nov 2020 dissection of Maui v. Sunoco<\/em><\/a>), while adding an \u201cing\u201d after it<\/a> (their Honolulu<\/em> filing did not<\/em><\/strong><\/a>).<\/p>\n\n\n\n

A small minority of text writers use those kinds of brackets<\/a> who want to reproduce quoted phrases so deadly accurately that they can\u2019t bring themselves to put an uppercase letter in the middle of a sentence. Kert Davies, operator of the Climate Investigations Center \/ Climate Files sites, doesn\u2019t use brackets for the \u201creposition global warming\u201d memos (e.g. at this page<\/a>, showing a deceptively cropped<\/a>, never-published<\/em><\/strong> newspaper advertorial) \u2026. except for the brackets seen in his 2018 page here<\/a>. Sher Edling, don\u2019t forget, says they source documents, such as the \u201cChicken Little\u201d advertorial<\/a>, from ClimateFiles.<\/p>\n<\/blockquote>\n\n\n\n

\u2713 \u2018Advertorials\u2019 attributed (falsely, in 2 of the 3 on Chicago<\/em>\u2018s PDF file page 84<\/a>) to the Western Fuels Association \u201cICE\u201d-acronym public relations campaign. The same ads which the head of Sher Edling cannot describe accurately<\/a>.<\/p>\n\n\n\n

\u2713 Ye olde<\/em> \u201cvictory will be achieved<\/a>\u201d worthless, never-implemented<\/a> memo set. Nothing different here from any of Sher Edling\u2019s prior boilerplate copy filings \u2013 their citation goes to the same innocuous-looking \u201cDocument Cloud\u201d file link they used in all their prior filings, where with just four small changes to that weblink<\/a> reveals \u2013 here\u2019s that name again \u2013 Kert Davies uploaded it to Document Cloud when he worked at Greenpeace<\/a>. This problem keeps looming larger every time Sher Edling repeats it. Davies, for any new readers unaware of it, traces back to the old Ozone Action group<\/a> where the above-noted \u201creposition global warming\u201d memos first began getting their major ongoing media traction<\/a>.<\/p>\n\n\n\n

Missing Richard Lawson memo \u2013 I pointed out\u00a0this omission twist<\/a>\u00a0to the standard Sher Edling boilerplate pattern in my\u00a0combined dissection<\/a>\u00a0of their identical twin Dec 2023 Indian Tribes lawsuits. The \u201cammo handed on a silver platter to the defendants<\/em>\u201d\u00a0I spoke of there<\/a>\u00a0is the massively problematic Lawson memo citation source being\u00a0Naomi Oreskes\u2019 obscure book chapter<\/a>\u00a0containing it\u00a0and other<\/a>\u00a0fatally\u00a0flawed accusations<\/a>.<\/p>\n\n\n\n

She is on retainer with Sher Edling, an even bigger problem for them as I detail at length here<\/a>, and in my dissections of her Friends of the Court filings<\/a> she filed for the plaintiffs in these \u201cExxonKnew\u201d lawsuits (her especially inept enslavement<\/a> in those to the \u201creposition global warming\u201d memos is an acute embarrassment).<\/p>\n<\/blockquote>\n\n\n\n

Naomi Oreskes isn\u2019t missing \u2713 in this filing, however. Just like in the Indian Tribes lawsuits<\/a>, Sher Edling features her in Chicago<\/em> as an extraneous citation source<\/a> surrounding a controversial IPCC topic. The potentially fatal problem for Sher Edling is Oreskes\u2019 ties<\/a> to a 1992-era Senate staffer<\/a>, said to be associated<\/a> (more than once<\/a>) with Al Gore, over the \u201creposition global warming\u201d memos. This could sink the entire accusation around those worthless<\/a> memos. Investigators might want to explore whether one of the \u2018municipality partner government attorneys\u2019 advised Sher Edling that the Richard Lawson memo \/ Oreskes My Facts book chapter was something they didn\u2019t want to draw attention to.<\/p>\n\n\n\n

By this point, just like in the other Sher Edling boilerplate copy lawsuits, readers may see how Sher Edling isn\u2019t merely brought into the local municipalities to offer random advice, they have every appearance of running the show<\/a>. But let\u2019s now examine what I mentioned up at the top \u2014 the firm\u2019s latest ill-advised maneuver:<\/p>\n\n\n\n

\u2713 \u201cBankroll\u201d \/ \u201cpaid\u201d \/ \u201cfunded scientists\u201d \u2013 Sher Edling was very consistent from San Mateo County v Chevron<\/em><\/a> in 2017 to October 2022 in Platkin v Exxon<\/em><\/a>,<\/em> regarding the use of the word \u201cbankroll\u201d to accuse skeptic climate scientist, Dr Willie Soon, of being industry-corrupted. When it came time for Sher Edling to file their September 2020 Delaware v BP<\/em> lawsuit, however, they needed to switch their Smithsonian Institution press release citation source for the accusation to an Internet Archive version<\/a> because the Smithsonian had taken their page about Dr Soon offline \u2013 Sher Edling continued using the Archive link through to their Platkin<\/em> filing, and while their Dec 2023 Indian Tribes twin filings swapped the word \u201cpaid\u201d for \u201cbankroll,\u201d the archive Smithsonian press release page citation remained<\/a>. The Smithsonian Institution never said he was \u201cpaid\u201d or \u201cbankrolled\u201d by any fossil fuel company, they simply stated they were beginning to look into whether there was a problem<\/a> with his funding disclosures.<\/p>\n\n\n\n

I thought it was hugely suspicious that the supposedly unrelated<\/em><\/strong> law firm of Milberg Coleman seemingly plagiarized Sher Edling\u2019s collection of \u201cbankroll\u201d paragraphs for their Nov 2022 Puerto Rico v Exxon<\/em> filing \u2014 albeit with an alternative weblink<\/a> to the Smithsonian press release page. I thought it was significantly more suspicious when the also-supposedly unrelated Attorney General of California\u2019s office apparently plagiarized<\/em><\/strong> the \u201cbankroll\u201d paragraph out of Platkin<\/em> nearly word-for word<\/a> \u2026.. but rather than cite the Smithsonian press release page as all the others do, CA v Exxon<\/em> cited something different out-of-the-blue<\/a>: A Smithsonian Magazine<\/em> article written by William Allman who cited widespread news<\/a> about Dr Soon\u2019s \u201ccorruption\u201d revealed by Greenpeace\u2019s \/ Climate Investigation Center\u2019s Kert Davies.<\/p>\n\n\n\n

Want to see what\u2019s in the \u2013 again \u2013 supposedly unrelated CA AG\u2019s\u00a0CA v Exxon<\/em>\u00a0repeated word-for-word identically, including the citation switch to the William Allman article source? It\u2019s easier here to just drop in a translucent blue rectangle at the point where the identical wording\u00a0stops.<\/em><\/strong><\/p>\n\n\n\n

Chicago v BP<\/em>.<\/strong> Sher Edling now has every appearance in the world of plagiarizing from CA AG Rob Bonta\u2019s CA v Exxon<\/em> \u2026. who had apparently previously plagiarized from Sher Edling\u2019s boilerplate pile.<\/p>\n\n\n\n

If this latest wrinkle in the climate issue law fare is not one more huge gift on a silver platter to the defendant companies, piled on top of what I detailed above, I don\u2019t what can be better. Dr Soon pointed out that the Smithsonian Institution didn\u2019t tell anyone<\/a> how their 5-year investigation concluded that he had not failed to disclose his funding properly. If he had, Kert Davies would have broadcasted the results from the mountaintops \u2013 the report would be in all of the Sher Edling lawsuits post-2020.<\/p>\n\n\n\n

Enviro-activists are brimming with confidence that this \u2018flood\u2019 \u201cExxonKnew\u201d lawsuits<\/a> and the handlers pouring them out are all above reproach. What could possibly go wrong? If the case can be made that each \u2013 in domino fashion \u2013 should be dismissed due to a total lack of evidence for the claims about \u2018industry-paid shill climate scientists,\u2019 and that the core people behind these lawsuits should be investigated and prosecuted, those enviros will never see this coming<\/a>.<\/p>\n\n\n\n
