AUTHOR, FIXING AMERICA\u2019S CRUMBLING UNDERGROUND INFRASTRUCTURE<\/p>\n\n\n\n

Residential and commercial buildings throughout the United States are in the bull\u2019s eye of a White House plan \u201cintended to help move the building sector to net-zero emissions.\u201d<\/p>\n\n\n\n

A \u201cpre-decisional\u201d draft<\/a>\u00a0released with little fanfare in January outlines the vast scope of an initiative aimed at nothing less than the decarbonization of one of the nation\u2019s largest economic sectors.<\/p>\n\n\n\n

Couched in the turgid bureaucratic prose common to regulatory schemes, the White House draft seeks a \u201cbroadly accepted minimum definition of a zero-emissions building.\u201d \u201cThe intent of the National Definition of a Zero Emissions Building,\u201d it says, \u201cis to create a standardized, consistent, measurable basis for zero emissions buildings.\u201d<\/p>\n\n\n\n

\u201cThis clear market signal and consistent target, backed by measurable data,\u201d are intended \u201cto influence the design and operation of buildings to substantially reduce building sector emissions.\u201d  In other words, the same people intent on forcing the driving public to buy EVs, and to mandate \u201call-electric\u201d appliances<\/a> in the nation\u2019s kitchens, now see themselves as architects of resilient green structures that can withstand anything the climate throws at them. (RELATED: DAVID BLACKMON: The Terrible News For Electric Vehicles Keeps Rolling In)<\/strong><\/a><\/p>\n\n\n\n

And which buildings are to be included in this scheme? \u201cThis definition can be applied to existing buildings and to new construction of non-federally owned buildings,\u201d the White House explains.\u00a0 \u201cThe definition applies to whole building operational emissions, including those from tenants.\u201d<\/p>\n\n\n\n

To meet the administration\u2019s net-zero emissions criteria, a building must be highly energy efficient, free of on-site emissions from energy use, and powered solely from \u201cclean energy,\u201d defined as \u201ccarbon-free sources.\u201d  Fossil fuels need not apply.<\/p>\n\n\n\n

Verification of each building\u2019s compliance with the net-zero-emissions regime is a key element of the Biden program. \u201cEPA\u2019s ENERGY STAR Portfolio Manager will generate standardized documentation that can be independently verified through licensed professionals and\/or third-party certification bodies or others as determined by organizations using the zero-emissions building definition.\u201d<\/p>\n\n\n\n

A Roadmap To Control<\/h4>\n\n\n\n

Anyone wishing to know how the administrative state seizes power need look no further than the White House\u2019s net-zero building emissions plan. It starts with a \u201cbroadly accepted minimum definition of a zero-emissions building \u2026 to transition the building sector to zero greenhouse gas emissions.\u201d\u00a0 The White fails to say by whom the definition is \u201cbroadly accepted\u201d but quickly moves on to a scheme that will put the federal government in every building \u2013 existing and not yet constructed \u2013 in every community in the country.<\/p>\n\n\n\n

Several well-trodden pathways are at its disposal, including regulation of fossil-fuel sources of energy that might otherwise make their way into buildings. Another is EPA\u2019s ENERGY STAR Portfolio Manager, who is accountable to absolutely no one, but nevertheless has the power to generate standardized documentation that can be \u201cindependently verified\u201d by third parties with a financial stake in the net-zero program.<\/p>\n\n\n\n

The White House draft places no restrictions on the size of the buildings subject to the program, meaning even smaller structures could fall under its purview.<\/p>\n\n\n\n

Building Codes<\/h4>\n\n\n\n

The administration\u2019s move comes amid a nationwide fight \u2014 playing out in such places as North Carolina, Michigan, and Idaho \u2014 over efforts to adopt\u00a0\u201cclimate friendly\u201d building codes<\/a>\u00a0at the state and local level. Climate advocates, often under the banner of energy efficiency, demand that building codes for homes be updated to include thicker insulation, super airtight windows, and upgraded wiring to accommodate all-electric appliances and in-home chargers for EVs.<\/p>\n\n\n\n

With home prices already at record-high levels, the 140,000 members of the National Association of Home Builders (NAHB) are mobilizing against state and local efforts to enact what are said to be more energy-efficient building codes for residences.<\/p>\n\n\n\n

Last year, NFIB\u2019s North Carolina affiliate successfully lobbied against a Tarheel State plan to tighten energy efficiency standards<\/a> designed to lower the carbon footprint of residential buildings.  Ron Jackson, a home builder in predominantly rural Moore County, worried that the code would put the affordable housing he specializes in out of reach for nurses, police officers, and teachers.<\/p>\n\n\n\n

\u201cAll that energy code was going to do in my price range is make it where the working man and woman would not be able to buy a home,\u201d he told<\/a> The Washington Post. Jackson, who sells homes in the $250,000 range, cited figures from NAHB\u2019s North Carolina affiliate, saying the code would add $20,000 to the price of such a home. (RELATED: KEVIN MOONEY: How Free Market Activists Dismantled SEC Proposal Enabling China To Stifle US Energy Production)<\/a><\/strong><\/p>\n\n\n\n

What the White House says is merely a \u201cdefinition\u201d of a zero-emission building, won\u2019t stay a definition for long. It will be a launching pad for regulations \u2014 ideally at the federal, state and local levels \u2014 that mandate which materials throughout the supply chain can go into a green building.<\/p>\n\n\n\n

Politically connected purveyors of those materials stand to profit handsomely from this arrangement.<\/p>\n\n\n\n

By contrast, perspective home buyers, particularly those on a tight budget, will ultimately pay the price exacted by the administrative regulatory state and its partners the climate cartel.<\/p>\n\n\n\n

Note that the Biden White House refers to its definition of a zero-emissions building as a \u201cclear market signal.\u201d But that signal did not come from the market.<\/p>\n\n\n\n

It originated with an administration in Washington whose \u201cwhole-of-government\u201d approach to what it says is a \u201cclimate crisis\u201d extends to every nook and cranny in American society.<\/p>\n\n\n\n
