class=\"wp-block-paragraph\">A coalition of red states announced Wednesday that they are challenging the Biden administration over its fresh corporate emissions and climate disclosure rule, just hours after the Securities and Exchange Commission (SEC) greenlit the measure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The SEC moved Wednesday to\u00a0<a href=\"https:\/\/dailycaller.com\/2024\/03\/06\/securities-exchange-commission-biden-climate-emissions-disclosure\/\" target=\"_blank\" rel=\"noreferrer noopener\">finalize<\/a>\u00a0new rules legally requiring certain public companies to report climate-related risks to their businesses and disclose data on the greenhouse gas emissions that their business operations directly generate. A group of ten Republican state attorneys general are\u00a0<a href=\"https:\/\/ago.wv.gov\/Documents\/SEC%20Climate%20Disclosure%20Petition%20for%20Review.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">suing<\/a>\u00a0the Biden administration over the rule, arguing that it is an unconstitutional attempt to impose climate regulation through the back door using an agency that does not have much to do with climate-related rulemaking.\u00a0<strong><a href=\"https:\/\/dailycaller.com\/2023\/12\/24\/south-pole-biden-admin-emissions-rule-carbon-credits-xinjiang-china-uyghurs\/\" target=\"_blank\" rel=\"noreferrer noopener\">(RELATED: Green Firm That Advised SEC On Proposed Emissions Rule Sold Carbon Credits From Chinese Region Known For Slave Labor)<\/a><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The challenge was filed in the U.S. Court of Appeals for the 11th Circuit, and is being co-led by Georgia Attorney General Christopher Carr and West Virginia Attorney General Patrick Morrissey. The attorneys general for Alabama, Alaska, Indiana, Oklahoma, South Carolina, Wyoming and Virginia are also involved in the suit.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">The WV AG briefed the media today on a development involving the U.S. Securities and Exchange Commission. Today, the Biden administration has once again gone on the attack against America\u2019s energy industry. It actually may be one of their most egregious attempts yet, but this time, they\u2019re not using the [Environmental Protection Agency] as their tool of choice.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The final rule approved Wednesday is a weakened version of the SEC\u2019s March 2022&nbsp;<a href=\"https:\/\/dailycaller.com\/2022\/03\/21\/securities-and-exchange-commission-gary-gensler-joe-biden-climate-change\/\" target=\"_blank\" rel=\"noreferrer noopener\">proposal<\/a>. Nevertheless,&nbsp;<a href=\"https:\/\/axpc.org\/2024\/03\/06\/axpc-statement-on-sec-climate-disclosure-rule\/\" target=\"_blank\" rel=\"noreferrer noopener\">many<\/a>&nbsp;<a href=\"https:\/\/www.api.org\/news-policy-and-issues\/news\/2024\/03\/06\/api-raises-concerns-with-new-sec-risk-disclosure-rule\" target=\"_blank\" rel=\"noreferrer noopener\">opponents<\/a>&nbsp;contend that it is still illegal or needlessly onerous, or both, while some&nbsp;<a href=\"https:\/\/www.sierraclub.org\/press-releases\/2024\/03\/sec-climate-disclosure-rule-represents-important-progress-falls-short-key\" target=\"_blank\" rel=\"noreferrer noopener\">critics<\/a>&nbsp;from the left have criticized the SEC for dropping some of the most aggressive provisions included in the proposal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The final rule mandates medium-sized and large companies to report emissions attributable to the electricity they use to power their business operations starting in fiscal years 2026 and 2028, respectively. The regulation will also require all public corporations to disclose climate-related risks to their business, just as they are required to disclose other material risks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The rule also requires relevant companies to report their organizational climate goals, such as plans to ditch fossil fuels.
