explained by U.S. Attorney Cole Finegan:\u00a0 \u201d<em>One way the United States Department of Agriculture supports farmers and ranchers is by providing federal funding for crop insurance programs that pay indemnities when there is less than the usual amount of precipitation<\/em>.\u201d [\u00a0<a Esch]&nbsp;<em>through his crop insurance, the&nbsp;<a href=\"https:\/\/www.rma.usda.gov\/en\/News-Room\/Press\/Press-Releases\/2023-News\/USDA-Announces-Modifications-to-the-Annual-Forage-and-Rainfall-Index-Program\" target=\"_blank\" rel=\"noreferrer noopener\">Rainfall Index Annual Forage Insurance Plan,<\/a>&nbsp;which is one of several agriculture subsidies administered by the U.S. Department of Agriculture\u2019s&nbsp;<a href=\"https:\/\/www.rma.usda.gov\/Federal-Crop-Insurance-Corporation\" target=\"_blank\" rel=\"noreferrer noopener\">Federal Crop Insurance Program<\/a>.&nbsp;<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Federal crop insurance is typically sold through private insurance companies who are subsequently reimbursed by the federal government. The Rainfall Index plan covers annual crops and \u201cis focused on the amount of precipitation, not on actual crop production,\u201d as described by prosecutors in a case document. \u201cThis means that a farmer can receive a payment when precipitation is below the historical normal level even if the relevant farmland suffers no loss in productivity.\u201d<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Colorado, this deals with \u201cforage\u201d \u2014 as in&nbsp;<a href=\"https:\/\/www.rma.usda.gov\/en\/News-Room\/Press\/Press-Releases\/2023-News\/USDA-Announces-Modifications-to-the-Annual-Forage-and-Rainfall-Index-Program\" target=\"_blank\" rel=\"noreferrer noopener\">Annual Forage Insurance Program<\/a>&nbsp;:&nbsp;<em>\u201cHistorically, the term forage has meant only plants eaten by the animals directly as&nbsp;<a href=\"https:\/\/en.wikipedia.org\/wiki\/Pasture\" target=\"_blank\" rel=\"noreferrer noopener\">pasture<\/a>,&nbsp;<a href=\"https:\/\/en.wikipedia.org\/wiki\/Crop_residue\" target=\"_blank\" rel=\"noreferrer noopener\">crop residue<\/a>, or immature&nbsp;<a href=\"https:\/\/en.wikipedia.org\/wiki\/Cereal\" target=\"_blank\" rel=\"noreferrer noopener\">cereal<\/a>&nbsp;crops, but it is also used more loosely to include similar plants cut for&nbsp;<a href=\"https:\/\/en.wikipedia.org\/wiki\/Fodder\" target=\"_blank\" rel=\"noreferrer noopener\">fodder<\/a>&nbsp;and carried to the animals, especially as&nbsp;<a href=\"https:\/\/en.wikipedia.org\/wiki\/Hay\" target=\"_blank\" rel=\"noreferrer noopener\">hay<\/a>&nbsp;or&nbsp;<a href=\"https:\/\/en.wikipedia.org\/wiki\/Silage\" target=\"_blank\" rel=\"noreferrer noopener\">silage<\/a>.<sup>\u201d<\/sup><\/em>&nbsp;[&nbsp;<a href=\"https:\/\/en.wikipedia.org\/wiki\/Forage\" target=\"_blank\" rel=\"noreferrer noopener\">wiki<\/a>&nbsp;]<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Paying indemnities means the US government pays farmers if it doesn\u2019t rain enough \u2013 rainfall below average \u2013 based on the local rain gauges at&nbsp;<a href=\"https:\/\/www.weather.gov\/asos\/#:~:text=What%20is%20ASOS?,primary%20surface%20weather%20observing%20network.\" target=\"_blank\" rel=\"noreferrer noopener\">Automated Surface Observing System<\/a>&nbsp;stations regardless of actual crop yields.&nbsp; For these ranchers, if there is less rain, there will be less forage for their cattle, which means less growth, which means less weight when sold, which means less profit.&nbsp; At least that\u2019s the idea.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is as hard to make it rain less as it is to make it rain more.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But it was apparently easy to make it&nbsp;<strong><em>look like<\/em><\/strong>&nbsp;it rained less.&nbsp; Just jigger the rain gauges at the local ASOS.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>\u201cThe group allegedly damaged rain gauges located in Springfield, Ordway, La Junta, Walsh, and Ellicott, Colorado, and others in Syracuse, Coolidge, and Elkhart, Kansas. Wires were cut, funnels to rain collectors were filled with silicone, holes drilled or punched in collectors, parts of collectors were disassembled, and objects such as cake pans or pie tins were placed over the gauges during rainstorms.\u201d&nbsp;<\/em>[&nbsp;<a href=\"https:\/\/www.cbsnews.com\/colorado\/news\/colorado-ranchers-patrick-esch-ed-dean-jager-sentenced-rain-gauges-tampering-federal-crop-subsidies-nws-fcic\/\" target=\"_blank\" rel=\"noreferrer noopener\">CBSNews<\/a>&nbsp;]<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The US Attorney\u2019s Office gives this version:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>\u201cThe conspirators used various means and methods to tamper with the rain gauges. Mr.&nbsp;Esch covered gauges in southeastern Colorado with agricultural equipment and used other means as well, such as filling gauges with silicone to prevent them from collecting moisture, cutting wires on the gauges, or detaching and then tipping over the bucket that collected precipitation. Mr. Jagers typically used an agricultural disc blade to cover up a rain gauge in Lamar, Colorado.
