The Biden administration has attempted to push new standards for both appliances since coming into office in 2021 as part of a wider push to nudge the market toward more energy efficient appliances, which in some cases are generally\u00a0 less effective than their other models, the court asserted in its opinion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In March 2018, the Competitive Enterprise Institute (CEI)\u00a0<a href=\"https:\/\/cei.org\/news_releases\/cei-applauds-doe-for-granting-its-petition-to-speed-up-dishwashers\/\" target=\"_blank\" rel=\"noreferrer noopener\">proposed<\/a>\u00a0standards for dishwashers that allow the sale of models that run faster cycles, using more energy and water than standard dishwashers in the process. The Trump administration then\u00a0<a href=\"https:\/\/dailycaller.com\/2020\/12\/29\/trump-energy-department-sued-dishwashers-environment\/\" target=\"_blank\" rel=\"noreferrer noopener\">adopted<\/a>\u00a0similar guidelines as policy in 2020, but the Biden DOE\u00a0<a href=\"https:\/\/news.yahoo.com\/biden-administration-moves-repeal-trump-215500228.html\" target=\"_blank\" rel=\"noreferrer noopener\">repealed<\/a>\u00a0those standards in 2021 before\u00a0<a href=\"https:\/\/www.energy.gov\/sites\/default\/files\/2023-05\/dishwasher-ecs-nopr.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">advancing<\/a>\u00a0its own standards that crack down on the faster models advantaged by the Trump administration\u2019s rules in May 2023.<strong>\u00a0<a href=\"https:\/\/dailycaller.com\/2023\/10\/06\/biden-administration-environmental-protection-agency-war-appliances-refrigerators-air-conditioning\/\" target=\"_blank\" rel=\"noreferrer noopener\">(RELATED: Biden Admin Fires Next Salvo In War On Appliances)<\/a><\/strong><\/p>\n\n\n\n<div data-wp-interactive=\"core\/file\" class=\"wp-block-file\"><object data-wp-bind--hidden=\"!state.hasPdfPreview\" hidden class=\"wp-block-file__embed\" data=\"https:\/\/climatescience.press\/wp-content\/uploads\/2024\/01\/697582822-Fifth-Circuit-Opinion.pdf\" type=\"application\/pdf\" style=\"width:100%;height:600px\" aria-label=\"Embed of 697582822-Fifth-Circuit-Opinion.\"><\/object><a id=\"wp-block-file--media-b141692f-f15a-42e4-a423-31de4076c6b0\" href=\"https:\/\/climatescience.press\/wp-content\/uploads\/2024\/01\/697582822-Fifth-Circuit-Opinion.pdf\">697582822-Fifth-Circuit-Opinion<\/a><a href=\"https:\/\/climatescience.press\/wp-content\/uploads\/2024\/01\/697582822-Fifth-Circuit-Opinion.pdf\" class=\"wp-block-file__button wp-element-button\" download aria-describedby=\"wp-block-file--media-b141692f-f15a-42e4-a423-31de4076c6b0\">Herunterladen<\/a><\/div>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cBut even if DOE has water-usage authority over the relevant appliances, the Department (b) failed to adequately consider the negative consequences of the Repeal Rule, including the substitution effects of energy-and-water-wasting rewashing, prewashing, and handwashing,\u201d the opinion states. \u201cIn promulgating the Repeal Rule, DOE stated that its energy conservation program must promote \u2018water conservation\u2019 and regulate \u2018water use\u2019 \u2026 But it is unclear how or why DOE thinks it has any statutory authority to regulate \u2018water use\u2019 in dishwashers and washing machines.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIn our court, however, DOE pretends it repealed the 2020 rules because it committed merely procedural errors by \u2018failing to adequately consider the [Energy Policy Conservation Act\u2019s] requirements \u2026 It borders on frivolous to say the 2020 Rules failed to consider\u201d the relevant statutes, as \u201cthe 2020 Rules considered these sections extensively,\u201d the opinion states.&nbsp; The DOE \u201camplified its capriciousness by throwing the baby out with the bathwater.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court\u2019s opinion also points out that there is \u201cample evidence\u201d to support that DOE\u2019s dishwasher standards actually accomplish the opposite of their intent, stating that \u201cthey make Americans use more energy and more water for the simple reason that purportedly \u2018energy efficient\u2019 appliances do not work.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Beyond clothes washers and dishwashers, the Biden DOE has also sought to impose energy efficiency regulations for items like&nbsp;<a href=\"https:\/\/dailycaller.com\/2023\/07\/22\/biden-admin-targets-water-heaters-with-new-rule-proposal\/\" target=\"_blank\" rel=\"noreferrer noopener\">water heaters<\/a>,&nbsp;<a href=\"https:\/\/dailycaller.com\/2023\/09\/30\/biden-admin-issues-new-rule-targeting-gas-furnaces-in-latest-crackdown-on-appliances\/\" target=\"_blank\" rel=\"noreferrer noopener\">furnaces<\/a>&nbsp;and pool pump&nbsp;<a href=\"https:\/\/dailycaller.com\/2023\/10\/02\/biden-new-energy-regulations-swimming-pool-pump-motors\/\" target=\"_blank\" rel=\"noreferrer noopener\">motors<\/a>. The administration has also spent&nbsp;<a href=\"https:\/\/dailycaller.com\/2023\/12\/19\/biden-administration-500-million-building-electrification-gas-stove\/\" target=\"_blank\" rel=\"noreferrer noopener\">hundreds of millions<\/a>&nbsp;of dollars on helping state and municipal governments pursue building codes<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIn this opinion, the court has forced DOE to follow the law and even noted that one of the positions DOE took in this suit \u2018borders on frivolous.\u2019 This decision allows manufacturers to build better dishwashers, not be encumbered by counterproductive federal regulations,\u201d Devin Watkins, an attorney for CEI, said of the opinion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The DOE did not respond immediately to a request for comment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>All content created by the Daily Caller News Foundation, an independent and nonpartisan newswire service, is available without charge to any legitimate news publisher that can provide a large audience.
