if finalized in its current form, the policy would impose tighter standards on 23 \u201cupwind\u201d states whose emissions are thought to cause air pollution in \u201cdownwind\u201d states. The Supreme Court will hear oral arguments for four emergency challenges against the regulation in February 2024,\u00a0<a href=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docket\/docketfiles\/html\/public\/23a349.html\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a>\u00a0to the Supreme Court\u2019s website.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The rule could cost American firms up to $910 million each year in compliance costs, and it would have particularly acute effects on industrial companies in the Midwest,\u00a0<a href=\"https:\/\/www.epa.gov\/newsreleases\/epa-announces-final-good-neighbor-plan-cut-harmful-smog-protecting-health-millions\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a>\u00a0to the EPA. However, Republican Ohio Attorney General Dave Yost, who is leading one of the challenges against the rule,&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23A349\/284940\/20231013090543221_SCOTUS%20Stay%20Application.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a>&nbsp;in court papers that the EPA \u201cignored obvious problems with its attempt to twist the Clean Air Act into a system of top-down regulation instead of the system of cooperative federalism that Congress intended.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Other states involved in a challenge against the EPA\u2019s regulation assert in&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23A349\/288395\/20231030154012598_Respondents%20NY%20et%20al%20Opposition%20to%20Stay%20Applications.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">court documents<\/a>&nbsp;that it would jeopardize power grid reliability and impose excessive, unreasonable costs. The rule was designed with an eye toward emissions sources such as natural gas pipelines, iron and steel mills, cement manufacturing, paper manufacturing, according to the EPA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the Supreme Court takes up the case, its decision could ultimately end up being the second major ruling pertaining to the extent of EPA\u2019s authority in the last several years. In June 2022, the nation\u2019s highest court dealt a blow to the agency in West Virginia v.
