class=\"wp-block-paragraph\">The Biden administration communicated about changes to a landmark environmental law with a major eco-group that is suing the federal government over the law in question, emails obtained by the Functional Government Initiative (FGI) and shared exclusively with the Daily Caller News Foundation show.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The emails, exchanged in May 2021, show that\u00a0<a href=\"https:\/\/earthjustice.org\/staff\/kristen-boyles\" target=\"_blank\" rel=\"noreferrer noopener\">Kristen Boyles<\/a>, a managing attorney for\u00a0<a href=\"https:\/\/dailycaller.com\/2018\/10\/01\/house-environmental-earthjustice-foreign-ties\/\" target=\"_blank\" rel=\"noreferrer noopener\">Earthjustice<\/a>, contacted the Department of Justice (DOJ) to request information about the White House Council on Environmental Quality\u2019s (CEQ) forthcoming rulemakings on the National Environmental Policy Act (NEPA), a decades-old environmental law. The communications occurred as Earthjustice was suing the Biden administration in an ongoing NEPA\u00a0<a href=\"https:\/\/earthjustice.org\/wp-content\/uploads\/ceq-nepa-rulemaking-complaint.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit<\/a>\u00a0and show that President Joe Biden\u2019s CEQ was willing to provide at least some information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the time of these communications, the Biden administration had not yet made public its specific proposal for the NEPA rulemakings. The administration&nbsp;<a href=\"https:\/\/www.federalregister.gov\/documents\/2021\/10\/07\/2021-21867\/national-environmental-policy-act-implementing-regulations-revisions\" target=\"_blank\" rel=\"noreferrer noopener\">published<\/a>&nbsp;the new rules in the Federal Register in October 2021.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThese emails certainly raise suspicions that there is some inappropriate conduct by the DOJ lawyer,\u201d Steve Milloy, a senior legal fellow for the Energy and Environment Legal Institute, told the DCNF. \u201cThat the information being privately provided to Earthjustice is then redacted in the FOIA request makes the exchange doubly suspicious.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NEPA has been one of the most important and contentious environmental laws on the books. Former President Richard Nixon signed it into law in 1970. The law dictates how federal agencies must assess potential ecological impacts of major projects, like new highways,\u00a0<a href=\"https:\/\/www.epa.gov\/nepa\/what-national-environmental-policy-act\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a>\u00a0to the Environmental Protection Agency.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NEPA is also the most frequently-litigated federal environmental statute,&nbsp;<a href=\"https:\/\/crsreports.congress.gov\/product\/pdf\/IF\/IF11932\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a>&nbsp;to the Congressional Research Service. Environmental groups often use NEPA lawsuits as a way to hold up energy projects they oppose.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Trump CEQ\u00a0<a href=\"https:\/\/trumpwhitehouse.archives.gov\/wp-content\/uploads\/2020\/01\/20200716Final-NEPAPress-Release.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">modernized<\/a>\u00a0NEPA to make it easier to build infrastructure projects in July 2020, reducing the rule\u2019s complexity and its vulnerability to excessive litigation. The emails also show that CEQ officials were willing to provide at least some of the information that Earthjustice requested. Further, some of the DOJ officials included in the correspondence were also involved in Earthjustice\u2019s NEPA lawsuit against CEQ.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Notably, the government redacted the relevant sections of the communications, citing (b)(5) exemptions. Therefore, it is not possible to decipher the specific information that CEQ was willing to provide to Earthjustice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A (b)(5) exemption covers \u201cinter-agency or intra-agency memorandums or letters that would not be available by law to a party other than an agency in litigation with the agency,\u201d&nbsp;<a href=\"https:\/\/foia.blogs.archives.gov\/2023\/07\/12\/foia-advisory-committee-recommends-exemption-5-transparency\/\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a>&nbsp;to the National Archives. Effectively, the (b)(5) redaction exempts the government from having to disclose its own internal \u201cdeliberations about application of law to specific factual scenarios,\u201d&nbsp;<a href=\"https:\/\/www.justice.gov\/media\/1010021\/dl?inline\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a>&nbsp;to the DOJ.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThank you for convening the conference call today and giving us the information about CEQ\u2019s plans for 3 NEPA rulemakings,\u201d Earthjustice\u2019s Boyles wrote on May 25, 2021, to&nbsp;<a href=\"https:\/\/www.justice.gov\/opa\/pr\/united-states-files-civil-action-collect-unpaid-civil-penalties-and-reclamation-fee-debts\" target=\"_blank\" rel=\"noreferrer noopener\">Clare Boronow<\/a>, the DOC attorney serving as the government\u2019s counsel in the NEPA lawsuit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI\u2019m hoping you can convey our thanks to CEQ and also our request for details about the second and third rulemakings, as those are going to be very important for our clients to decide how to proceed in the litigation,\u201d Boyles wrote to Boronow.&nbsp;\u201cParticularly for the second rulemaking, the parts of the 2020 Regs that CEQ wants to address more quickly, details of what parts of the 2020 Regs will or will not be addressed, repealed or re-instated.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Boyles copied&nbsp;<a href=\"https:\/\/www.linkedin.com\/in\/gregory-cumming-77949544\/\" target=\"_blank\" rel=\"noreferrer noopener\">Gregory Cumming<\/a>, a DOJ counsel working on the concurrent NEPA case,&nbsp;<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.363293\/gov.uscourts.cand.363293.54.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a>&nbsp;to court documents. The DOJ officials then relayed her request to bureaucrats working in the CEQ, who then responded with redacted information that they were \u201copen to providing.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The next day, Bonorow forwarded Boyles\u2019 message to the CEQ\u2019s&nbsp;<a href=\"https:\/\/www.linkedin.com\/in\/amy-beth-coyle\/\" target=\"_blank\" rel=\"noreferrer noopener\">Amy Coyle<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.linkedin.com\/in\/justin-pidot-8465a98\/\" target=\"_blank\" rel=\"noreferrer noopener\">Justin Pidot<\/a>, asking if \u201cCEQ is in a position to provide that information.\u201d Coyle responded later that day, outlining what CEQ was willing to provide in response. However, the section of Coyle\u2019s message that would reveal what information CEQ provided was redacted under a (b)(5) exemption.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cEarthjustice is getting inside information in so-called litigation against the government with DOJ\u2019s assistance and apparently participating in CEQ\u2019s rulemaking on matters of national significance, all outside of the public eye,\u201d Pete McGinniss, a spokesman for FGI, said of his organization\u2019s discovery.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Biden administration had been working for months to effectively undo the Trump CEQ\u2019s moves to&nbsp;<a href=\"https:\/\/dailycaller.com\/2017\/04\/01\/trump-has-repealed-these-7-pieces-of-obamas-environmental-legacy\/\" target=\"_blank\" rel=\"noreferrer noopener\">streamline<\/a>&nbsp;NEPA, and ultimately&nbsp;<a href=\"https:\/\/dailycaller.com\/2022\/04\/19\/joe-biden-white-house-nepa-environmental-regulation\/\" target=\"_blank\" rel=\"noreferrer noopener\">reversed<\/a>&nbsp;many Trump administration reforms. The Biden CEQ finalized \u201cphase one\u201d of its NEPA rulemaking in April 2022.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Earthjustice&nbsp;<a href=\"https:\/\/earthjustice.org\/press\/2022\/earthjustice-applauds-restoration-of-nepa-protections-and-urges-biden-administration-to-fully-reverse-trump\" target=\"_blank\" rel=\"noreferrer noopener\">applauded<\/a>&nbsp;the announcement, and encouraged the Biden administration to go further in subsequent rulemakings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In July 2023, the administration proposed a \u201cphase two\u201d NEPA rulemaking that would bolster the statute to more strongly consider \u201cenvironmental justice\u201d implications and greater community input, which Earthjustice also&nbsp;<a href=\"https:\/\/earthjustice.org\/press\/2023\/earthjustice-hails-biden-administrations-nepa-phase-ii-proposed-rule\" target=\"_blank\" rel=\"noreferrer noopener\">commended<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On May 27, 2021, Pidot forwarded more follow-up questions from DOJ to CEQ Chief of Staff&nbsp;<a href=\"https:\/\/www.linkedin.com\/in\/matt-lee-ashley-30a34968\/\" target=\"_blank\" rel=\"noreferrer noopener\">Matt Lee-Ashley<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.linkedin.com\/in\/jayni-foley-hein-8033586\/\" target=\"_blank\" rel=\"noreferrer noopener\">Jayni Hein<\/a>, who also worked for the Biden CEQ at the time. It is unclear what information was relayed in response, as the relevant sections were again redacted under a (b)(5) exemption.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While neither Pidot nor Hein appear to have been directly involved in the NEPA lawsuit, Lee-Ashley submitted an&nbsp;<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.363293\/gov.uscourts.cand.363293.54.1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">affidavit<\/a>&nbsp;on June 3, 2021, several weeks after the emails had been exchanged.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThat\u2019s a lot of cheek to claim deliberative process privilege to hide a thread which also happens to reveal a call about disclosing the administration\u2019s deliberative process. With an extant litigant, about its litigation no less,\u201d Chris Horner, a practicing attorney with an extensive background in environmental litigation, told the DCNF about the messages and the government\u2019s justification for redacting crucial parts of the emails.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cStill, if I didn\u2019t know better I would suspect there are two standards in applying the law. Shrug it off for friends\u2014that\u2019s what phone calls are for!\u2014 and, to the disfavored, indignantly declare the law to be a sacred shield,\u201d Horner said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The DOJ declined to comment, referring the DCNF to the CEQ regarding NEPA lawsuit questions.
