Each suffers the same analytic and procedural defects that caused the Circuit Court to vacate DOE\u2019s Final Rule for commercial boilers. \u00a0DOE\u2019s continued flaunting of its authority, despite the Court\u2019s action inspired my post title (above).\u201d<\/em><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">On July 10, 2023, MasterResource published\u00a0<a href=\"https:\/\/www.masterresource.org\/krebs-mark\/energy-appliance-victory-dc-circuit\/\">Energy Appliance Victory! (DC Circuit vs. DOE)<\/a>.\u00a0The \u201cvictory\u201d was overturning a DOE Final Rule that would have banned non-condensing commercial boilers.\u00a0 In so doing, it also rejected the long-standing assumptions with the administrative state\u2019s super weapon; its cherished \u201cChevron Deference.\u201d<strong>[1]<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The opening paragraph of my July 10th article read:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><em>\u201cThe \u2018wheels of justice turn slowly,\u2019 but they indeed turned, even within the District of Columbia\u2019s \u2018uni-party.\u2019\u00a0As for holding on to this victory, it is far from a slam-dunk for preserving consumer choice and free markets. I expect the struggle to escalate in Biden\u2019s all-of-government war against natural gas and other fossil fuels.\u201d<\/em><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">I had a gut feeling DOE would do something reactionary, and it didn\u2019t take long.\u00a0The DC Court vacated DOE\u2019s commercial boiler efficiency rule on\u00a0<a href=\"https:\/\/www.masterresource.org\/wp-content\/uploads\/2023\/07\/D.C.-Circuit-CPB-Decision.pdf\">July 7<\/a>. On July 28,\u00a0<em>DOE issued three notices for more stringent appliance efficiency mandates<\/em>. One of these has been published in the Federal Register as a\u00a0<a href=\"https:\/\/www.regulations.gov\/document\/EERE-2017-BT-STD-0019-0063\">Docket EERE-2017-BT-STD-0019: Energy Conservation Standards for Consumer Water Heaters; Notice of Proposed Rulemaking<\/a>\u00a0(NOPR), thus starting a comment period (closing August 28, 2023). The other two are pre-publication versions yet to be published in the Federal Register. Once final versions of these are published in the Federal Register, they become official and posted to regulations.gov under their corresponding Docket ID. Then, the comment period starts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All three of these notices demonstrate the same anti-consumer biases of the Executive Branch\u2019s Department of Energy: to ban non-condensing appliance products. Each suffers the same analytic and procedural defects that caused the Circuit Court to vacate DOE\u2019s Final Rule for commercial boilers. \u00a0DOE\u2019s continued flaunting of its authority, despite the Court\u2019s action begs the question of this article\u2019s title.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is a big deal. It speaks to the separation of powers between two ostensibly co-equal branches of government: the Executive and the Judicial. The third branch, Legislative, has a significant role to play here<em>. The Energy Policy Conservation Act (EPCA) should be modified to effectively mitigate the chronic regulatory failures and self-serving nanny state behaviors that are chronic within DOE\u2019s\u00a0 administration of EPCA<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Three Rulemakings<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The escalation didn\u2019t take long.\u00a0On July 28, 2023, DOE issued three new notices for more stringent appliance efficiency mandates. One of these has been published in the Federal Register as a Docket EERE-2017-BT-STD-0019: Energy Conservation Standards for Consumer Water Heaters; Notice of Proposed Rulemaking (NOPR), thus starting a comment period (closing August 28, 2023). The other two are pre-publication versions yet to be published in the Federal Register. (Once Federal Register versions are published, they\u2019ll be posted to regulations.gov under their corresponding Docket ID and the comment period started.)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All three of these notices demonstrate the same sort of anti-consumer biases of the Executive Branch\u2019s U.S. Department of Energy: to ban non-condensing appliance products. Each also suffers the same defects that caused the Circuit Court to rule against DOE in the commercial boilers case. Behavior driven by that bias that led to the DC Circuit vacating a Final Rule.\u00a0 DOE\u2019s apparent disregard of the Court\u2019s action begs the question of this article\u2019s title.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Going forward, the third branch, legislative, also has a significant role to play here. Specifically, it is to exercise control and restraint of the Energy Policy and Conservation Act (EPCA).\u00a0 Enacted in 1975 as a reaction to oil embargoes, EPCA has been subject to constant \u201cmission creep\u201d ever since.\u00a0 EPCA should at least be modified by the legislative branch to correct DOE\u2019s regulatory failures and self-serving gaming of its analytical processes that are endemic within its administration of appliance efficiency standards.\u00a0 Alternatively, Congress should \u201creimagine\u201d EPCA.\u00a0<em>Perhaps EPCA should be scrapped given how it has been hijacked by scores of renewable energy eco-warriors and electrotechnology zealots<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Overview of DOE\u2019s Three July 28th Appliance Efficiency Standards<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The following discussion provides a rudimentary summary of these three notices:<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\">\n<li><a href=\"https:\/\/www.regulations.gov\/document\/EERE-2017-BT-STD-0019-0063\">Docket EERE-2017-BT-STD-0019: Energy Conservation Standards for Consumer Water Heaters; Notice of proposed rulemaking and announcement of public meeting<\/a><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">While residential gas storage heaters for the most popular sizes (20 to 55 gallons) would not require condensing technology, minimum efficiency levels being proposed could adversely affect consumer safety due to increased condensation within conventional exhaust systems.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Specifically, reduced temperatures of exhaust gases can, over time, result in excessive condensation within venting systems that could eventually lead to corrosion and leakage of combustion products (including carbon monoxide) into homes. \u00a0Additionally, new mandates being proposed call for an additional inch of insulation on the sides, top and bottom of storage tanks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Accommodating larger tanks (due to additional insulation) can and will significantly increase replacement costs and, at least in typical \u201ctight-fit\u201d situations, prevent replacements with like-sized water heaters.\u00a0 Additional hassle factors being proposed include the addition of flue dampers and electronic ignition (eliminating continuous pilot light) thus requiring gas water heaters to have electric connections.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These increased cost issues are especially important for low-income consumers, and comments are already being filed that express such concerns (<a href=\"https:\/\/www.regulations.gov\/comment\/EERE-2017-BT-STD-0019-0064\">20230724_Kramer Subject_Proposed water heater rules<\/a>). The following is an excerpt:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><em>I believe these new standards will HARM a very high percentage of the poor population in our nation. Less hot water consumption equates to less stringent minimum efficiency requirements. &nbsp;How DOE will go about determining individual household hot water consumption is not explained.&nbsp; Like their recent&nbsp;<a href=\"https:\/\/www.masterresource.org\/krebs-mark\/doe-vs-gas-cooking-comments\/\">notice of proposed rulemaking (NOPR) for cooking products<\/a>, DOE\u2019s objective for establishing usage patterns&nbsp; may include a&nbsp;<a href=\"https:\/\/www.regulations.gov\/comment\/EERE-2014-BT-STD-0005-2271\">move towards rationing controls<\/a>.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.regulations.gov\/document\/EERE-2019-BT-STD-0036-0001\">EERE-2019-BT-STD-0036: Energy Conservation Standards for Consumer Boilers<\/a><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Also on July 28th, 2023, DOE issued a\u00a0<a href=\"https:\/\/lnks.gd\/l\/eyJhbGciOiJIUzI1NiJ9.eyJidWxsZXRpbl9saW5rX2lkIjoxMDIsInVyaSI6ImJwMjpjbGljayIsInVybCI6Imh0dHBzOi8vZW5lcmd5Lmdvdi9zaXRlcy9kZWZhdWx0L2ZpbGVzLzIwMjMtMDcvYm9pbGVycy1lY3Mtbm9wci5wZGY_dXRtX21lZGl1bT1lbWFpbCZ1dG1fc291cmNlPWdvdmRlbGl2ZXJ5IiwiYnVsbGV0aW5faWQiOiIyMDIzMDcyOC44MDM2MTU2MSJ9.RWwC2V56rZ4rYCEM0TP4GQi77vviNuI3O0bU6w03J2w\/s\/13788391\/br\/223399735283-l\" target=\"_blank\" rel=\"noreferrer noopener\">pre-publication<\/a>\u00a0Federal Register NOPR pertaining to energy conservation standards for consumer boilers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Note: \u00a0The term \u201cpre-publication\u201d means that it is not yet posted on regulations.gov as it has not been published in the Federal Register and may therefore be changed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this NOPR, DOE is proposing a 95% AFUE (condensing) minimum efficiency requirement for consumer (residential) hot water boilers that are gas-fired. \u00a0For gas-fired steam boilers, an 82% AFUE minimum efficiency requirement.\u00a0 This places such boilers on the same \u201cbleeding edge\u201d of safety to guard against vent corrosion (as previously explained above under 1: Energy Conservation Standards for Consumer Water Heaters).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Regarding non-gas boilers, DOE is proposing a slight increase for consumer oil boilers but\u00a0no increase for consumer electric boilers.\u00a0 According to DOE in several previous rulemakings, electric resistance heating is so close to 100% efficient, there is essentially no room for additional improvements. The answer is affirmative because DOE has clearly demonstrated its vindictive nature towards anyone legally challenging their \u201cauthority\u201d in the past.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Case-in-point: DOE\u2019s actions after the \u201csettlement\u201d with the American Public Gas Association (APGA). \u00a0This case was documented with a July 15, 2015, article of mine published in MasterResource titled\u00a0<a href=\"https:\/\/www.masterresource.org\/energy-efficiency\/gas-furnace-rule-part-ii-return-of-the-scorched-gas-policy\/\">Gas Furnace Rule Part II: Return of the \u201cScorched Gas\u201d Policy<\/a>. At that time, I asked DOE to account for these changes.&nbsp; At page 127, line 21-22, of the transcript, DOE\u2019s explanation was:<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\">\n<li><em>BROOKMAN: Okay. We\u2019re going to move on now to manufacturer impact analysis.<\/em>]<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Clearly (to me at least), DOE can and does hold grudges and the above table aptly demonstrates a certain vindictiveness.\u00a0 I expected that our\u00a0<a href=\"https:\/\/www.masterresource.org\/wp-content\/uploads\/2023\/07\/D.C.-Circuit-CPB-Decision.pdf\">\u201cvictory\u201d of July 7<sup>th<\/sup>, 2023<\/a>\u00a0would at least cause DOE going forward to think twice about its unsubstantiated claims based upon misleading and opaque models.\u00a0 But it apparently didn\u2019t even slow DOE down. The similarities between DOE\u2019s energy efficiency models and IAM models used to justify the \u201cexistential threat\u2019 of global warming appear to be cut from the same centralized \u201ccommand and control\u201d cloth; but I digress (somewhat).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The same \u201cerrors\u201d made by DOE in the commercial boiler rule that was just vacated by the CD Court also exist in the present batch of edicts issued on July 28<sup>th<\/sup>.\u00a0 Apparently, DOE\u2019s lawfare tactic is to wear out their opposition.\u00a0 After all, they have a \u2018weaponized\u201d Department of Justice on their side with virtually unlimited legal budgets (assuming the Federal printing presses keep printing money and unwitting consumers continue to pay for such waste).\u00a0 In stark contrast, \u201cindustry\u201d has limited legal resources and funding.\u00a0 This is a war of attrition where \u201cindustry\u201d must litigate or capitulate (likely followed by elimination shortly thereafter).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I realize that the documents issued on July 28th, 2023, were already in the que for release prior to the July 7<sup>th<\/sup>\u00a0\u201cvictory.\u201d Regardless, DOE decided to simply go with what they have rather than avoid making the same mistakes that led to the Court vacating the commercial boiler rule. For whatever reason, DOE chose not correct its errors, so to me, that is tantamount to rendering the middle-finger salute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Path(s) Forward<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So now what? Back to square one of appealing more biased Final Rules as they are \u201cdetermined\u201d by DOE? &nbsp;Or will \u201cindustry\u201d begin to comply with the Borg-like administrative state? &nbsp;There are other (non-mutually exclusive) alternatives that can fundamentally correct DOE\u2019s rampant abuse of its congressionally granted authority.<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\">\n<li>One possibility may be filing for a temporary restraining order holding DOE from adopting anything until the technical and procedural issues from the commercial boiler are \u2018resolved\u2019. We could easily argue that the faults in the just vacated commercial boiler are still occurring in this and other rulemakings, thus &nbsp;perpetuating regulatory failure.<\/li>\n\n\n\n<li>Additionally, Congress could defund DOE\u2019s ability to conduct activities that limit consumer choice as this recent&nbsp;<a href=\"https:\/\/www.grassley.senate.gov\/imo\/media\/doc\/grassley_to_doe_-_home_appliance_regulations.pdf\">letter from Senator Grassley to DOE<\/a>&nbsp;may be implying.<\/li>\n\n\n\n<li>Another possibility is to get Congress to revoke (or at least overhaul) the appliance efficiency authority they vested with DOE via EPCA way back in 1975 (at a time when world energy situation was&nbsp;<em>way<\/em>&nbsp;different) and rebalance the powers of the three branches. Given the present buzz about gas stove bans (etc.), and \u201cadministrative state\u201d tactics, this might get traction. Senator Grassley and Cruz, are you listening?<\/li>\n\n\n\n<li>Expand H.R.1640, the&nbsp;<a href=\"https:\/\/www.congress.gov\/bill\/118th-congress\/house-bill\/1640\">Save Our Gas Stoves Act<\/a>, to protect&nbsp; other gas fueled appliances that DOE plans to replace with electric appliances.&nbsp; That said, H.R. 1640 has a slim chance at best getting through the Senate and probably zero chance of Biden signing it if it were to get through the Senate. Consequently, it may have to wait for a more conservative\/free-market oriented Administration.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Again, none of the alternative strategies are mutually exclusive.\u00a0 Many if not all of them can be executed simultaneously to increase effectiveness. \u00a0Even though more members of both the House and Senate sound willing to take on the administrative state, they need more understanding of what it will take to correct an errant DOE.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I was interviewed by Thomas Catenacci, a Fox News journalist for an article published on July 26<sup>th<\/sup>, 2023 titled\u00a0<a href=\"https:\/\/www.foxnews.com\/politics\/experts-warn-biden-admins-water-heater-crackdown-hike-prices-reduce-consumer-choice\">Experts warn Biden admin\u2019s water heater crackdown will hike prices, reduce consumer choice<\/a>.\u00a0 Representative Bill Johnson (R-OH) was also interviewed.\u00a0 The video clip of that interview clearly demonstrates that Rep, Johnson has a solid grasp of the situation and is remarkably fluent in expressing his knowledge about it.\u00a0 We hope Rep Johnson can spread his knowledge and enlist more like-minded Congress members then take decisive action to change the course from the self-serving nanny\/administrative state culture that is manifested by DOE s chronic overreach within its appliance efficiency programs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consider the opening of DOE\u2019s press release for these new notices:\u00a0\u00a0<a href=\"https:\/\/www.energy.gov\/articles\/doe-announces-efficiency-standards-save-americans-more-1-billion-annually-utility-bills\">DOE Announces Efficiency Standards to Save Americans More Than $1 Billion Annually in Utility Bills<\/a>.\u00a0 It states:\u00a0<em>Congressionally-Mandated Appliance Standards Will Save Americans Nearly $20 Billion Over 30 years and Slash Carbon Pollution in Communities Across the Nation.<\/em>\u00a0The purpose of that sentence is to give DOE cover that it is simply implementing the will of Congress. \u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What the \u201cvictory\u201d accomplished by getting DOE\u2019 commercial boiler rule vacated was to display that DOE couldn\u2019t exhibit its burden of proof for its \u201cregulatory determinations.\u201d\u00a0 This judicial action adversely impacted the administrative state\u2019s cherished Chevron Deference.\u00a0 DOE wasn\u2019t then and still isn\u2019t now playing by the rules\u00a0 to expand their regulatory domain over appliance efficiency\u00a0 (and\/or they change the rules as they deem fit on the go). DOE is not going to change its ways.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, Congress must change DOE. \u00a0What Congress giveth, Congress can taketh.
