National Marine Fisheries Service<\/em>:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe men and women of America\u2019s energy industry take seriously their responsibilities to the communities and the environment where they live and work. This private settlement agreement between the federal government and environmental activists places unfounded restrictions on operations in the U.S. Gulf of Mexico that severely hamper America\u2019s ability to produce energy in a region that is responsible for the lowest carbon-intensive barrels in the world. Despite no evidence to warrant this far-reaching ban on operations after extensive data collections, today\u2019s agreement undermines the integrity of legitimate conservation and habitat protection efforts, violates the explicit directives of Congress in enacting the Inflation Reduction Act, and harms America\u2019s energy independence.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">[\u2026]<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.api.org\/news-policy-and-issues\/news\/2023\/07\/21\/energy-trades-condemn-administrations-baseless-offshore-restriction\">American Petroleum Institute<\/a><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Where\u2019s Joe Manchin When You Need Him?<\/h3>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<h3 class=\"wp-block-heading\">API provides additional details on objections to federal deal with environmentalists<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Kurt Abraham, Editor-in-Chief, World Oil<\/strong>\u00a0July 24, 2023<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After sounding the alarm last Friday evening about a deal reached between the federal government and environmentalists that is considered hostile to the oil and gas industry, API has provided\u00a0<em>World Oil<\/em>\u00a0with additional details on why this agreement is so damaging.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Not justified by science and data.\u00a0<\/strong><em>Earlier on Monday, API provided World Oil with additional comments on the situation. \u201cThe government has cut a deal with environmental interests that is simply not justified by science and data,\u201d said API. \u201cThere is little to no evidence that the Rice\u2019s whale species \u00a0<\/em><strong>(Fig. 1<\/strong><em>) allegedly protected by this settlement is in the expanded protection areas created by today\u2019s agreement. In the agreement, the government states that they have no \u2018reason to believe\u2019 that incidental take of the whale may occur in the newly expanded protection areas.\u201d<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Furthermore, said API, \u201cThe agreement\u2019s proposed operating recommendations would impose significant burdens on operators and increase emissions from vessels forced to operate at suboptimal speeds.\u00a0 An initial assessment found that abiding by the terms of the agreement could cut transit windows to less than 40% of the time annually and 25% during the winter, putting industry in an untenable position. These restrictions would unfairly single out oil and gas traffic in an area that is one of the most used maritime areas in U.S. waters by a variety of industries. Thousands of vessels pass through this area every day.\u201d<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Casting a shadow on lease sales.<\/strong><em>\u00a0API also noted that the Biden administration has also agreed to exclude approximately 11 million acres in the heart of the Central and Western GOM from future lease sales. This acreage was contemplated by Congress to be available for future lease sales mandated by the Inflation Reduction Act.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Where is Manchin in all of this?\u00a0<\/strong>One has to wonder what Sen. Joe Manchin (D-W.Va.) thinks about this turn of events. After all, it was Manchin, who voted for the Inflation Reduction Act, only because he thought he had made a good horse trade to include pro-oil-and-gas planks in the legislation. Now, the spirt of that agreement and vote is being gutted by the crafty Biden operatives.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/worldoil.com\/news\/2023\/7\/24\/api-provides-additional-details-on-objections-to-federal-deal-with-environmentalists\/\">World Oil<\/a><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">You Can\u2019t Fix Stupid<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The settlement would restrict the speed of vessels supporting oil &amp; gas operations. It would not affect the operations of all other vessels operating in the Gulf of Mexico. Apart from clearly violating the Equal Protection Clause, this is just plain stupid.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">And the federal government will impose new\u00a0<a href=\"https:\/\/www.foxnews.com\/politics\/biden-indefinitely-blocks-millions-acres-land-water-future-oil-drilling\" target=\"_blank\" rel=\"noreferrer noopener\">restrictions on oil and gas vessels<\/a>, but not the thousands of vessels operated in other industries in the area. So the sale can\u2019t legally be delayed and it\u2019s a little late in the game to be carving out even more exclusion areas. I\u2019ll post follow-ups as this latest act of lawlessness evolves.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Fake whale species<\/h3>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Rice\u2019s whale<\/strong>\u00a0(<em><strong>Balaenoptera ricei<\/strong><\/em>), also known as the\u00a0<strong>Gulf of Mexico whale<\/strong>, is a\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Species\">species<\/a>\u00a0of\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Baleen_whale\">baleen whale<\/a>\u00a0endemic to the northern\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Gulf_of_Mexico\">Gulf of Mexico<\/a>. Initially identified as a\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Population_ecology\">subpopulation<\/a>\u00a0of the\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Bryde%27s_whale\">Bryde\u2019s whale<\/a>,\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Genetics\">genetic<\/a>\u00a0and skeletal studies found it to be a distinct species by 2021. In outward appearance, it is virtually identical to the Bryde\u2019s whale.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/en.wikipedia.org\/wiki\/Rice%27s_whale\">Wikipedia<\/a><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Up until 2021, Rice\u2019s whales were a small group of Bryde\u2019s whales peacefully coexisting with the oil &amp; gas industry in the Gulf of Mexico for decades.\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Bryde%27s_whale\">Bryde\u2019s<\/a>\u00a0whales are listed as \u201c<a href=\"https:\/\/en.wikipedia.org\/wiki\/Least-concern_species\">Least-Concern Species<\/a>\u201d by the IUCN.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">A\u00a0<strong>least-concern species<\/strong>\u00a0is a\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Species\">species<\/a>\u00a0that has been\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Conservation_status\">categorized<\/a>\u00a0by the\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/International_Union_for_Conservation_of_Nature\">International Union for Conservation of Nature<\/a>\u00a0(IUCN) as evaluated as not being a focus of species conservation because the specific species is still plentiful in the wild. They do not qualify as\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Threatened_species\">threatened<\/a>,\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Near-threatened_species\">near threatened<\/a>, or (before 2001)\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Conservation-dependent_species\">conservation dependent<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/en.wikipedia.org\/wiki\/Least-concern_species\">Wikipedia<\/a><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Two years ago, Rice\u2019s whales were also part of a Least-Concern Species. Now they are considered \u201cCritically Endangered,\u201d one step above Extinct in the Wild. Here\u2019s some food for thought: Before 2021, the population of Rice\u2019s whales was zero-point-zero and they were part of a Least-Concern Species.
