Skinner, executive director of the Alliance for Consumers, told The Epoch Times. \u201cThat will make it<strong>\u00a0so that<\/strong>\u00a0nearly the majority of the\u00a0<strong>current products on the market don\u2019t meet the standards and have to be redesigned or removed<\/strong>\u00a0from the market,\u201d Skinner said.<\/em><\/p>\n\n\n\n<p class=\"has-text-align-center wp-block-paragraph\"><em><strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#e81515\" class=\"has-inline-color\">\u201cEveryday things that people actually want are going to get more expensive<br>or disappear, and the products that will be available will be more expensive<br>but not better. People are going to wonder why life is worse.\u201d<\/mark><\/strong><\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>The announcement touted\u00a0<strong>110 new regulations enacted by federal agencies on \u201ceverything from air conditioners and furnaces, to clothes washers and dryers, to kitchen appliances and water heaters\u2014as well as commercial and industrial equipment.\u201d<\/strong>\u00a0<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>According to the Biden administration: \u201cOnce finalized, these standards will\u00a0<strong>reduce greenhouse gas emissions by an estimated 2.4 billion metric tons,<\/strong>\u00a0equivalent to the carbon emissions from 10 million homes, 17 million gas cars, or 21 coal-fired power plants over 30 years. This was then followed by\u00a0<strong>new environmental standards from the DOE that would ban the manufacturing of 50 percent of the gas stoves available on the market today.<\/strong><\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Case in Point: DOE Rule on Boilers Vacated by DC Circuit Court<\/strong><\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">Mark Krebs explains the agency machinations in his Master Resource article\u00a0<a href=\"https:\/\/www.masterresource.org\/krebs-mark\/energy-appliance-victory-dc-circuit\/\"><strong>Energy Appliance Victory! I expect the struggle to escalate in Biden\u2019s all-of-government war against natural gas and other fossil fuels.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Beleaguered energy consumers were just handed a far-reaching victory by the\u00a0<a href=\"https:\/\/www.cadc.uscourts.gov\/internet\/home.nsf\">United States Court of Appeals for the District of Columbia<\/a>\u00a0(DC Circuit). The ruling\u00a0vacated\u00a0a<strong>\u00a0Final Rule from<\/strong>\u00a0the U.S, Department of Energy\u00a0<strong>(DOE) that would have banned the manufacture and sale of non-condensing boilers<\/strong>\u00a0for use in commercial applications. DOE\u2019s rule was\u00a0<strong>challenged several years ago<\/strong>\u00a0by natural gas interests\u2013and later joined with a separate but similar case brought by the Air-Conditioning, Heating, and Refrigeration Institute (AHRI).<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>DOE\u2019s failures were major and numerous. Previously, the Court had afforded DOE ample opportunities to rectify them,\u00a0<strong>but they didn\u2019t.\u00a0<\/strong>Ultimately (reading in between the lines), it appears that the Court lost its patience with \u201cthe Agency\u201d (DOE).\u00a0One of the far-reaching results of this victory is that<strong>\u00a0it undermines a veritable super-weapon of the administrative state: the Chevron Deference.<\/strong>\u00a0This aspect will be discussed in more detail further down.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>DC Circuit has set a\u00a0<strong>precedent that illustrates how DOE routinely bends the rules to achieve its \u201cadministrative state\u201d objectives.<\/strong>\u00a0Consequently, DOE should exercise more care and transparency going forward with both present and future developments of appliance minimum efficiency standards.\u00a0 However, it is probably more likely that DOE will find ways to get around it; perhaps drastically.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>The end-result of this (amid many other analytical biases discussed in the Court ruling) is\u00a0<strong>fatally skewed economic \u201cdeterminations\u201d that almost always favor stricter standards,<\/strong>\u00a0regardless of the true economics.. Such is clearly the case\u00a0<strong>when reviewing regulatory actions<\/strong>\u00a0like promulgating rulemaking for mandating minimum energy efficiency standards for appliances. On May 1, 2023, the U.S. Supreme Court granted review in Loper Bright Enterprises v. Raimondo, No. 22-451, on whether to overturn or limit Chevron Deference.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Subsequently, perhaps the most important victory in this case is that it becomes\u00a0<strong>a \u201cposter child\u201d for why the administrative state\u2019s abuse of the Chevron Deference should end<\/strong>.
