The Biden administration announced in December 2022 its pledge to take\u00a0\u201cmore than 100 actions\u201d to impose significantly tighter environmental standards on consumer goods<\/strong>\u00a0is now becoming reality.\u00a0 And consumer groups are predicting\u00a0a future in which Americans pay more for products that do less<\/strong>, while manufacturers warn of\u00a0shortages and supply chain breakdowns.<\/strong><\/em><\/p>\n\n\n\n

\u201cYou\u2019re seeing, just in the last few months,\u00a0new rules from the Biden administration about clothes washers, dishwashers, and other kinds of kitchen appliances<\/strong>, and in every case, you\u2019re talking about a tightening of already very, very tight standards,\u201d O.H. Skinner, executive director of the Alliance for Consumers, told The Epoch Times. \u201cThat will make it\u00a0so that<\/strong>\u00a0nearly the majority of the\u00a0current products on the market don\u2019t meet the standards and have to be redesigned or removed<\/strong>\u00a0from the market,\u201d Skinner said.<\/em><\/p>\n\n\n\n

\u201cEveryday things that people actually want are going to get more expensive
or disappear, and the products that will be available will be more expensive
but not better. People are going to wonder why life is worse.\u201d<\/mark><\/strong><\/em><\/p>\n\n\n\n

The announcement touted\u00a0110 new regulations enacted by federal agencies on \u201ceverything from air conditioners and furnaces, to clothes washers and dryers, to kitchen appliances and water heaters\u2014as well as commercial and industrial equipment.\u201d<\/strong>\u00a0<\/em><\/p>\n\n\n\n

According to the Biden administration: \u201cOnce finalized, these standards will\u00a0reduce greenhouse gas emissions by an estimated 2.4 billion metric tons,<\/strong>\u00a0equivalent to the carbon emissions from 10 million homes, 17 million gas cars, or 21 coal-fired power plants over 30 years. The projected consumer savings from these standards would be $570 billion cumulatively, and for an average household this will mean at least $100 in annual savings.\u201d<\/em><\/p>\n\n\n\n

The stoves are just the thin end of the wedge.<\/strong><\/p>\n\n\n\n

These actions follow a familiar\u00a0pattern<\/strong>:\u00a0rumors<\/strong>\u00a0of new directives, followed by official\u00a0denials<\/strong>, followed by draconian\u00a0diktats<\/strong>.\u00a0 \u00a0<\/em><\/p>\n\n\n\n

For\u00a0example<\/strong>, reports that the Consumer Product Safety Commission would ban\u00a0gas stoves<\/strong>\u00a0over alleged safety concerns sparked a public outcry in January, which was met with denials by the Commission, together with media ridicule, that any such thing was being contemplated. This was then followed by\u00a0new environmental standards from the DOE that would ban the manufacturing of 50 percent of the gas stoves available on the market today.<\/strong><\/em><\/p>\n\n\n\n

Case in Point: DOE Rule on Boilers Vacated by DC Circuit Court<\/strong><\/h5>\n\n\n\n

\u201cThe \u2018wheels of justice turn slowly,\u2019 but they indeed turned, even within the District of Columbia\u2019s \u2018uni-party.\u2019\u00a0As for holding on to this victory, it is far from a slam-dunk for preserving consumer choice and free markets. I expect the struggle to escalate in Biden\u2019s all-of-government war against natural gas and other fossil fuels.\u201d<\/p>\n\n\n\n

Beleaguered energy consumers were just handed a far-reaching victory by the\u00a0United States Court of Appeals for the District of Columbia<\/a>\u00a0(DC Circuit). The ruling\u00a0vacated\u00a0a\u00a0Final Rule from<\/strong>\u00a0the U.S, Department of Energy\u00a0(DOE) that would have banned the manufacture and sale of non-condensing boilers<\/strong>\u00a0for use in commercial applications. DOE\u2019s rule was\u00a0challenged several years ago<\/strong>\u00a0by natural gas interests\u2013and later joined with a separate but similar case brought by the Air-Conditioning, Heating, and Refrigeration Institute (AHRI).<\/em><\/p>\n\n\n\n

DOE\u2019s failures were major and numerous. Previously, the Court had afforded DOE ample opportunities to rectify them,\u00a0but they didn\u2019t.\u00a0<\/strong>Ultimately (reading in between the lines), it appears that the Court lost its patience with \u201cthe Agency\u201d (DOE).\u00a0One of the far-reaching results of this victory is that\u00a0it undermines a veritable super-weapon of the administrative state: the Chevron Deference.<\/strong>\u00a0This aspect will be discussed in more detail further down.<\/em><\/p>\n\n\n\n

DC Circuit has set a\u00a0precedent that illustrates how DOE routinely bends the rules to achieve its \u201cadministrative state\u201d objectives.<\/strong>\u00a0Consequently, DOE should exercise more care and transparency going forward with both present and future developments of appliance minimum efficiency standards.\u00a0 However, it is probably more likely that DOE will find ways to get around it; perhaps drastically.<\/em><\/p>\n\n\n\n

The end-result of this (amid many other analytical biases discussed in the Court ruling) is\u00a0fatally skewed economic \u201cdeterminations\u201d that almost always favor stricter standards,<\/strong>\u00a0regardless of the true economics.. As a result of this Court Order, such routine biases are now on public display to demonstrate the full intent of regulatory failures that occur within the intentionally opaque bureaucratic processes to ostensibly overcome so-called market failures.<\/em><\/p>\n\n\n\n

\"\"<\/figure>\n\n\n\n

Most important<\/strong>\u00a0of all, fossil fuel industries should exploit this victory to illustrate just\u00a0how fallible government agencies can be.\u00a0\u00a0<\/strong>This decision goes far\u00a0beyond the particulars of packaged commercial boilers.<\/strong>\u00a0It goes to the heart of the question of government agency standing relative to actual stakeholders.<\/em><\/p>\n\n\n\n

Ever\u00a0since the \u201cChevron Deference\u201d<\/strong>\u00a0was put in place\u00a0in 1984, federal courts have deferred<\/strong>\u00a0to an agency\u2019s ostensibly unique \u201csubject matter expertise\u201d for interpretating ambiguous statutes. Such is clearly the case\u00a0when reviewing regulatory actions<\/strong>\u00a0like promulgating rulemaking for mandating minimum energy efficiency standards for appliances. On May 1, 2023, the U.S. Supreme Court granted review in Loper Bright Enterprises v. Raimondo, No. 22-451, on whether to overturn or limit Chevron Deference.<\/em><\/p>\n\n\n\n

Subsequently, perhaps the most important victory in this case is that it becomes\u00a0a \u201cposter child\u201d for why the administrative state\u2019s abuse of the Chevron Deference should end<\/strong>. At least in this instance, the Courts found DOE to be not worthy of deference.\u00a0Perhaps SCOTUS will follow their lead.<\/strong><\/em><\/p>\n\n\n\n
