href=\"https:\/\/www.bizjournals.com\/denver\/news\/2023\/04\/24\/scotus-suncor-exxon-boulder-lawsuit-petition.html\"><strong>US Supreme Court rejects Boulder\u2019s $100M climate lawsuit against Suncor, Exxon.<\/strong><\/a>&nbsp; That headline is misleading in that SCOTUS declined to rule on the motion to restrict such lawsuits to federal courts.&nbsp; Excerpts in italics with my bolds.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>The United State&nbsp;<strong>Supreme Court on Monday declined to take up a lawsuit<\/strong>&nbsp;Boulder and two other local governments filed against oil refiners Suncor Energy and ExxonMobil and deemed similar climate change-related lawsuits matters for state courts.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>The nation\u2019s highest court<strong>&nbsp;issued orders Monday rejecting oil companies\u2019 request<\/strong>&nbsp;to take up the Boulder case and similar lawsuits filed against other oil industry giants such as BP, Sunoco and Shell by the governments of Baltimore, Maryland; San Mateo County, California; and Honolulu, Hawaii.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em><strong>Boulder city and county governments<\/strong>&nbsp;and San Miguel County, home to Telluride, joined together in 2018 and sued Calgary-based Suncor Energy and Irving, Texas-based ExxonMobil. The plaintiffs<strong>&nbsp;argued the communities face at least $100 million in costs over 30 years \u201cto deal with the impacts of climate change<\/strong>&nbsp;caused by the use of fossil fuel products like those made and sold by Suncor and Exxon.\u201d<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Oil companies and local governments bringing similar legal cases have been jostling over&nbsp;<strong>whether state courts or the federal bench should have jurisdiction<\/strong>. Monday\u2019s denial by the Supreme Court settles the jurisdictional matter, but doesn\u2019t end the cases.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>\u201c<strong>We will continue to fight these suits, which are a waste of time and resources<\/strong>&nbsp;and do nothing to address climate change,\u201d said Todd Spitler, a&nbsp;<strong>spokesperson for ExxonMobil.<\/strong>&nbsp;\u201cToday\u2019s decision does not impact our intention to invest billions of dollars to lead the way in a thoughtful energy transition that takes the world to net zero carbon emissions.\u201c<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Justice Samuel&nbsp;<strong>Alito took no part<\/strong>&nbsp;in the consideration and decision, while Justice Brett&nbsp;<strong>Kavanaugh would\u2019ve taken up Boulder\u2019s case<\/strong>&nbsp;at the Supreme Court, the order noted.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Suncor owns the three oil refineries in Commerce City, the only refineries in Colorado.&nbsp; A j<strong>urisdictional fight<\/strong>&nbsp;arose about which level of court \u2014 state or federal \u2014 is appropriate for such cases.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Local governments and the U.S. Department of Justice argued the cases belonged in state courts.&nbsp;<strong>&nbsp;Oil companies asked the U.S. Supreme Court<\/strong>&nbsp;to take up the Boulder case and&nbsp;<strong>settle issues the companies said are common among more than a dozen lawsuits working their way through lower courts.<\/strong><\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Allies of the oil and gas industry expressed&nbsp;<strong>disappointment at the Supreme Court\u2019s decision.&nbsp;&nbsp;<\/strong>Having state courts handle the cases could lead to<strong>&nbsp;a patchwork approach to policy questions that are inherently federal or international in scope<\/strong>, said Phil Goldberg, special counsel for the Manufacturers\u2019 Accountability Project, in a statement issued Monday.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>The good news is that&nbsp;<strong>state courts likely will, after the substance of the liability claims is heard,<\/strong>&nbsp;dismiss them like a New York City lawsuit against Exxon was two years ago, he said.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>\u201cThe<strong>&nbsp;challenge of our time<\/strong>&nbsp;is developing technologies and public policies so that the world can&nbsp;<strong>produce and use energy in ways that are affordable for people and sustainable for the planet,\u201d<\/strong>&nbsp;Goldberg said.<\/em><\/p>\n\n\n\n<p class=\"has-text-align-center wp-block-paragraph\"><em><strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#e81515\" class=\"has-inline-color\">\u201cIt should not be figuring out how to creatively plead lawsuits that seek<br>to monetize climate change and provide no solutions.\u201d<\/mark><\/strong><\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>The Boulder and San Miguel County case was called a stunt by the state oil and gas industry when it was first filed.&nbsp;<strong>&nbsp;Companies shouldn\u2019t face legal liability for \u201cdoing nothing more than engaging in the act of commerce<\/strong>&nbsp;while adhering to our already stringent state and federal laws,\u201d said Dan Haley, president and CEO of the Colorado Oil and Gas Association, at the time.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>But supporters of community&nbsp;<strong>claims<\/strong>&nbsp;point to evidence that\u2019s shown<strong>&nbsp;oil companies understood but did not publicly disclose<\/strong>&nbsp;the potential ramifications of carbon dioxide pollution in the atmosphere.<\/em><strong>&nbsp;[There is again the lie of labelling the harmless trace gas plant food as \u201cpollution.\u201d]<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>They argue that climate-change-inducing\u00a0<strong>emissions are at the root of incidents<\/strong>\u00a0like the unusual, deadly\u00a0<strong>deluges<\/strong>\u00a0of September 2013, and out-of-season\u00a0<strong>wildfires<\/strong>, like those that destroyed over 1,000 Superior and Louisville-area homes on New Year\u2019s Eve, 2021, and have forced communities to bear the costs of responding to such disasters\u00a0<\/em>.[Yet in the<strong>\u00a0UN report<\/strong>\u00a0they say there is\u00a0<strong>virtually no evidence of a relationship between extreme events and climate change<\/strong>.]<\/p>\n\n\n\n<p But contrast this with the<strong>\u00a0incredibly specific claims in these cities\u2019 lawsuits.\u00a0<\/strong>\u00a0In 2017,\u00a0<strong>San Francisco<\/strong>\u2019s city attorney, Dennis Herrera, filed a lawsuit in state court\u00a0<strong>against five energy companies,<\/strong>\u00a0alleging they are responsible for very specific effects of climate change and\u00a0<strong>should pay for infrastructure such as sea walls to deal with its ongoing and future consequences.<\/strong><\/em><\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><img data-recalc-dims=\"1\" class=\"wp-block-paragraph\"><em>In a 2018 petition in&nbsp;<strong>Texas<\/strong>&nbsp;state court, Exxon alleged the<strong>&nbsp;\u201cstark and irreconcilable conflict\u201d between<\/strong>&nbsp;the municipalities\u2019&nbsp;<strong>allegations in the lawsuits and their disclosures in bond offerings<\/strong>&nbsp;indicated the suits were brought \u201cnot because of a bona fide belief in any tortious conduct by the defendants or actual damage to their jurisdictions, but instead&nbsp;<strong>to coerce ExxonMobil and others operating in the Texas energy sector to adopt policies aligned with those favored by local politicians in California.\u201d<\/strong><\/em><\/p>\n\n\n\n<p class=\"has-text-align-center wp-block-paragraph\"><em><strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#e81515\" class=\"has-inline-color\">Its petition was denied, but the concern about the \u201cstark and irreconcilable conflict\u201d<br>has quietly simmered ever since \u2014 and for good reason.<\/mark><\/strong><\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em><strong>Disclosures<\/strong>\u00a0in other areas have been\u00a0<strong>a source of angst for muni bondholders<\/strong>.\u00a0 In 2016, the Securities and Exchange Commission issued a\u00a0<strong>cease and desist order against the City of Boulder<\/strong>\u00a0for misstating that it had complied with prior agreements to provide continuing disclosure to its investors.<\/em><\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><img failure but also the<strong>&nbsp;solicitor general\u2019s recent<\/strong>&nbsp;recommendation to the Supreme Court,&nbsp;<strong>urging the justices to reject ExxonMobil and Suncor\u2019s petition<\/strong>&nbsp;for their case to be heard in federal rather than state court.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Credit Suisse\u2019s AT1 investors have reason to be upset but not necessarily all that surprised.&nbsp; After all, those&nbsp;<strong>bonds were yielding 9.75%, suggesting the risks were high.<\/strong>&nbsp; For comparison, the average yield on ostensibly much safer 10-year muni bonds is about 2.49%.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>But what&nbsp;<strong>if<\/strong>, in addition to the risks laid out in disclosure documents,&nbsp;<strong>Credit Suisse had been aware of other material risks<\/strong>&nbsp;it had failed to disclose to its bondholders?&nbsp; Well,&nbsp;<strong>that would be securities fraud.<\/strong><\/em><\/p>\n\n\n\n<p class=\"has-text-align-center wp-block-paragraph\"><em><strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#e81515\" class=\"has-inline-color\">Might the same hold true for these municipalities doing the bidding<br>of trial lawyers pushing an extreme climate agenda?<\/mark><\/strong><\/em><\/p>\n\n\n\n<figure class=\"wp-block-image size-full
