Board of County Commissioners of Boulder County,&nbsp;<strong>U.S. Solicitor General Elizabeth Prelogar<\/strong>&nbsp;recently told the Supreme Court&nbsp;<strong>that climate-change cases should be heard not in federal courts, but in deep-blue, progressive state courts.&nbsp;&nbsp;<\/strong>Calling this proposal politically opportunistic would be an understatement.<\/p>\n\n\n\n<p class=\"has-text-align-center wp-block-paragraph\"><strong><em><mark style=\"background-color:rgba(0, 0, 0, 0);color:#e81515\" class=\"has-inline-color\">Sixteen states disagree, as we have made known through a brief<br>filed by my office. Federal law should govern this and similar cases,<br>according to legal precedent.<\/mark><\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">My office always stands for the rule of law and fights for it in the courtroom. But the current solicitor general\u2019s abrupt departure from that position confirms that&nbsp;<strong>politics has replaced law in her office.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The solicitor general<\/strong>&nbsp;represents the United States before the Supreme Court and is the&nbsp;<strong>only federal officer required by statute to be \u201clearned in the law\u201d<\/strong>\u2014a high calling. Past solicitors general described their obligation to speak \u201con behalf of the rule of law.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The Supreme Court relies on<\/strong>\u00a0the solicitor general to be\u00a0<strong>a non-partisan, trustworthy representative and interpreter of the law<\/strong>. In the\u00a0<a href=\"https:\/\/www.justice.gov\/osg\/solicitor-general-historical-context\" target=\"_blank\" rel=\"noreferrer noopener\">words<\/a>\u00a0of Seth P. Waxman, solicitor general during the Clinton administration, this \u201cspecial relationship to the Court is not one of privilege, but of duty\u201d\u2014<strong>a duty that includes an obligation \u201cto respect and honor the principle of stare decisis,\u201d<\/strong>\u00a0meaning consistency over time\u00a0<strong>regardless of the political interests of the current class=\"wp-block-paragraph\"><strong>Interstate environmental issues,<\/strong>&nbsp;especially those relating to air pollution and climate change, have&nbsp;<strong>long been governed by federal law and resolved by federal courts.&nbsp;<\/strong>&nbsp;<strong>&nbsp;In 2011, the Supreme Court&nbsp;<a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/564\/410\/\" target=\"_blank\" rel=\"noreferrer noopener\">reaffirmed<\/a>&nbsp;it \u201cwould be inappropriate\u201d to apply state law to claims<\/strong>&nbsp;arising from transboundary greenhouse-gas emissions and&nbsp;<strong>climate change.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This makes good sense.\u00a0<strong>Greenhouse gas emissions inherently transcend state borders<\/strong>\u2014the term, after all, is \u201cglobal climate change\u201d not \u201cBoulder County climate change.\u201d<\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><img class=\"wp-block-paragraph\">The Supreme Court has&nbsp;<a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/479\/481\/\" target=\"_blank\" rel=\"noreferrer noopener\">recognized<\/a>&nbsp;that allowing state courts&nbsp;<strong>to interfere with federal regulation of energy production<\/strong>&nbsp;and emissions would \u201cundermine the important goals of efficiency and predictability\u201d and&nbsp;<strong>\u201clead to chaotic confrontation between sovereign states.\u201d<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Office of the Solicitor General has embraced this position<strong>\u00a0for decades, and solicitors general appointed by presidents from both parties have defended it<\/strong>\u2014including left-wing\u00a0<a href=\"https:\/\/www.newsweek.com\/topic\/democrats\">Democrats<\/a>\u00a0who used climate change as part of their political platform.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"wp-block-paragraph\">So, in 2022, when the Supreme Court asked the Office of the Solicitor General if lawsuits seeking damages for climate change implicate state or federal issues, and whether they should proceed in state or federal court,<strong>&nbsp;the answer should have been simple<\/strong>. But the solicitor general instead said these cases should proceed in state court.<\/p>\n\n\n\n<p class=\"has-text-align-center wp-block-paragraph\"><strong><em><mark style=\"background-color:rgba(0, 0, 0, 0);color:#e81515\" class=\"has-inline-color\">This flip-flop lacks credible explanation.<\/mark><\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Here, the solicitor general seems to be&nbsp;<strong>acting for special interests and attempting<\/strong>&nbsp;to fix President&nbsp;<a href=\"https:\/\/www.newsweek.com\/topic\/joe-biden\">Joe Biden<\/a>\u2018s failure&nbsp;<strong>to achieve the climate change outcomes he promised.<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-center wp-block-paragraph\"><strong><em><mark style=\"background-color:rgba(0, 0, 0, 0);color:#e81515\"
